  1. You need a fiance visa if your intent when entering the country was to get married. I have a multiple entry B1/B2/BCC and have been in the US literally hundreds of times on daytrips, but I still had to file for a K1 because my intent is to get married. As simple as that.

    Factual inaccuracy: You do not need a K1 to get married in this country, you can do it on whatever visa you are here, as long as you observe your visa terms. You can get married on a B1/B2 visa, as long as you leave at the end of the term stamped in your passport; you can get married on a student visa, as long as you observe the visa conditions etc. You need a K1 to be able to claim AOS after marriage and gain residency rights, if you intend to live here. Do not confuse the intention to be a US resident with the intention to marry, the first does not necessarily follow from the latter.

  3. Thanks a lot everybody. In the meantime, I found it! I just raked my mind to figure out where I could have put it safely for the move.

    By the way, I had my biometrics on September 10. At that time, my GC was still missing in action. However, according to the ASC Appointment Notice: "You must bring photo identification. Naturalization applicants must bring their Alien Registration Card. All other applicants must bring a passport, driver's license, national ID, military ID, or State-issued photo ID." Not being a naturalization applicant, there was no mention of having to bring the green card, which is why I did not panic. I brought my passport and drivers license. The security guard asked for my green card and I explained that I misplaced it and that according to the ASC notice, a passport should be enough. He agreed that is correct, but cautioned me that according to the law, I should be carrying my GC on me all the time. He let me keep my biometrics appointment nonetheless. So the reason you need your GC for biometrics is not because the notice says so.

  4. I applied for removal of conditions on my green card and received the one year extension letter. Recently I moved and in the process have misplaced my (already expired) green card.

    Two questions:

    1. Will I ever need the expired green card in the future? What are the consequences? Should I start a thorough search in my house?

    2. If I wish to travel, notably Canada, do I need to present the expired green card along with the extension letter or is the letter enough? I think I know the answer, but just checking with my more experienced fellow VJ-ers.

  7. Be truthful, don't give more information than asked, i.e. don't rush to explain how you guys are getting a CR1.

    Do you have a job? Ask for a letter stating when you'll be back to work.

    Money saved? Show some account statements.

    Show the return plane ticket, copy of your lease from an apartment/house, etc etc.

    Great reply! I got married in the US on a tourist visa and left the country afterwards. Had no problem coming in, answer only when asked.

    * Form I-130:

    Part C, question 17

    "Information about your alien relative" "List husband/wife and all children of your relative"

    Who do I have to listin that part? In the form example they put the USC name. In my case I'm the alien(wife), he is the USC.. what name do I have to put there?

    Remember, this is your husband's form, not yours, so technically he is completing it. So fill it from his perspective. By this logic: you are his relative, and he is your husband, therefore list him under this question. This question does not care who is the USC, just who is the spouse of the relative for whom the petition is made.

    Question 19

    "Your relative's address abroad"

    If I'm already in the United States, do I have to write down my address abroad (well were I used tolive before coming to USA and getting married?

    You are not abroad, you are in the US and live here with him (presumably), therefore the answer is "N/A" - not applicable.

    * I-130 package:

    Do I need to submit an original of my marriage certificate? Or just a photocopy?

    Always submit photocopies, never originals. If they need originals, they will request them and will return them when done. This information is contained in the instructions, read the instructions carefully.

    What about my birth certificate? Is it the original + translation or a photocopy + original translation?

    Again, photocopy plus translation. A computer printed translation done by yourself suffices. Just add at the bottom the "Certification by Translator" paragraph, found here: General Tips on Assembling Applications for Mailing.

    In my country we also use the mother's last name, so I had two last names, for example PerezRodriguez … in almost all forms it ask me "Other names used (include Maiden Name)"..I list my second last name (Rodríguez in the example, because my I-94 has thislast name on it… and my last name after marriage is hyphen so I still have my maidenname… What do you guys think?

    The way I would answer this is: under Name put your current name AS IT APPEARS ON YOUR OFFICIAL CURRENT IDENTIFICATION, presumably a passport. If your current passport reflects your married name, then use that under Name. Under Other Names Used put your previous name used before marriage; if that name is double and includes your mother's name, then put that down.

    * Form I-765:

    Question 16:"Eligibility categories"… I think mine is C9, can somebody confirm please? C9 is correct.

    Do I have to pay tosubmit this form? Under this category? I read something about not having to paythe $340 it cost…

    The current instructions to this form do not say anything about not paying the fee for this category. On page 8 of the instructions, found here, it does say that there is no need to pay if filed together with I-485, but that was back in 2007. The instructions look like they have been updated in Feb-10, so I think now there is a fee.

    * Form I-485:

    Part 2: application type: I'm not sureif I have to check the letter a, since I'm submitting this form with the I-130package… ?

    Letter A is correct.

    * Form I-864:

    My husband is going tobe my sponsor. So in part 6, number 23: "My current individual annual incomeis"… should I write there the amount of money he reported in 2009 taxes?

    Not necessarily: say someone makes 50,000 a year, but if they put away 10,000 in an IRA retirement account, only 40,000 will be reported on the tax return. Put here the gross income earned from his job: if it's a salary then the gross salary - take the gross pay as per his paycheck and multiply by the number of pay periods per year; if it's an hourly job, multiply the hourly rate by the number of hours he expects to work this year. Hope this makes sense.

    * I-485 package:

    I have two passports(my actual non expire one) and an expire one where my visitor USA visa is on…do I have to photocopy biographical page and entry stamps on the old passporttoo? Or just the photocopy of the page where the visitor visa is?

    Just the photocopy of the page with your current visitor visa, that you used to enter the US the last time.

    * I'm confuse on how manychecks do I have to send? Is it one for the I-130 form ($365), one for theI-864 ($70), one for the I-485 ($1,010)… and one for the I-765 ($??) That's all?

    Let me check my own package tonight and I will post back about that.

  9. I think if the G-325a is with the I-130 then you should put OTHER - I-130 PETITION

    and if the g-325 is with the I-485, you should put ADJUSTMENT FOR PERMANENT RESIDENT

    :yes:

    If you are appying at the same time (I-130 and I-485) you should have 8 copies of G-325 i.e 4 of each one.

    3 copies of G-325A:

    - one for the USC in connection with the I-130

    - one for the alien in connection with the I-130

    - one for the alien in connection with the I-485

    Each copy has 4 pages, for a total of 12 pages (3 copies x 4 pages).

Yep, been there done that: AOS interview was 10 days before 2nd anniversary, but due to adjusting from a tourist visa, had to file for AOS asap and was happy even with a 2 yr conditional green card. The immigration officer also said that the removing conditions process does not always result in an interview. I think she said that because our AOS interview was mostly a formality (we were not grilled) and she thought we will sail through the removal of conditions, as long as we send in a complete file.

    sounds like EAD first is better.

    i wonder if anyone has ever filed AOS 90 days to their 2nd year of marriage and given the 2 yr GC b/c the AOS interview or the GC was approved before the 2nd anniversary? That would really suck to lift conditions real close to your 2nd year.

  11. What citizenship does it say on your green card? You should use whichever passport matches that

    Not an easy question to answer: the green card does not mention country of citizenship, but county of birth. I assume the OP was born in South Africa and later obtained British citizenship, however applied for his/her green card as a South African (alexpapa, please correct me if my assumption is wrong). The question is whether the green card is linked in any way to the passport with which the OP applied for permanent residence, or s/he could use the other passport?

    My case is the reverse: I was born in Moldova (and therefore hold Moldovan citizenship), but applied for green card as a Romanian citizen and will be traveling with my Romanian passport in the future; however my green card states Moldova as country of birth.
