    I read here on VJ that they really look into the last 3 years more than anything when come for overstaying! This is right?

    To be honest, I don't know how long they look into it. It didn't even enter our minds to take that paperwork, we have since found the approval notices - 2005 and 2008. I would have thought if there was an issue (which there wasn't as it was approved) it would have been raised/brought to our attention before the interview.

    BTW - passport has not arrived. Mom now thinks it was 10-15 business days.

    My mom had her interview at 8.30am this morning at the Embassy in London. She got it, but not without them giving her a real hard time over the Visa extensions (two over about 10 years) that she had got.

    The lady was "horrible" (my mom's words). Told my mom she had obviously been living in the US and had overstayed on two occasions. My mom insisted that she had not lived in the US - had visited me for approximately 4-5 months - returned home to UK, where she pointed out she had another daughter - stayed there for 2-3 months and came back to me etc etc. The final point was the lady stated that although they couldn't find proof that mom had applied for an Extension to her B1/B2 visa it was over 3 years ago so they would go ahead and issue her the Green Card. We didn't think for her to take the paperwork with her - so for all you out there whose parents have legally stayed longer than there visa - remember to take the paperwork with you!

    The Courier said she should get her passport back within 5-10 business days. It's all over!!!!

    I called NVC this afternoon and was told that my mom didn't get assigned an interview date in London for July - call back 2nd week of July for an August date. How disappointing, I was sure she'd get her interview in July sad.gif.

    Does anyone know if this is a "definite" NO for July interviews? My mom said that she'd come out here for a few weeks if she didn't get a July appointment ... I don't want to tell her to come if there's the possibility they could come up with a date in July.

    Called this morning. Was told Case Closed. Interviews being scheduled in July, if we hadn't heard anything by the middle of next week, call back ... oh if you insist good.gif

    I mailed my mother's DS230 yesterday to NVC (Express - they will get it today). I have searched for the following answers, but can't find them anywhere!

    (A) A rough idea on how long before "case closed" and do I call next week, daily yes.gif to inquire?

    (B) Do NVC notify me of the date of my mom's interview in London (approximate timing)? I am the "agent" here in Florida.

    © Approximate time-frame for interview in London (this month, next month etc etc). I've searched members time-lines, but can't find anyone going through London.

    A quick question. I sent the AOS on April 19th - they have now sent an email RFE stating I needed to include 2011 tax return. My fault, I completed the paperwork in December all ready to send and sent 2008, 2009 and 2010, but anyway - no problems - I have ordered the transcript from the IRS - but I have also downloaded a copy of my tax return from Turbo Tax (I filed in January). Can I send the 2009 & 2010 transcripts (again) and the copy of my filing from Turbo Tax - or should I wait for the actual transcript from the IRS?

    Hello and I'm very happy for your results so far...Well if you filed for Consular Processing..YES she will have to come back to the UK for her interview...!Now you are going through NVC processing forget about CSC because you are done with them!!Thanks God on you...lol...Now you are working with NVC...what about your DS 3032= Choice of Agenthave you done that already??after that is sending the I-864 because you paid already the fee and DS-230 and paying the IV fee.Go to the top of the page and have a look into the Wiki...click on see all wiki...scrow down and look for NVC or probably you done all that already! :whistle:

    Sent the Choice of Agent form this morning - got the paid notice tonight, so have I-864 ready to mail tomorrow. It says to check back for the opportunity to pay the IV fee ...

    We have just paid the AOS fee of $88.00 for my mother, who lives in the UK. We are going through CSC.

    Can anyone give me an idea of what happens now? My mother is actually out with me in Florida visiting for a couple of months and is not sure if she'll have to return for her interview within this time?

    Any replies would be greatly appreciated!

    I should also have included that we have all paperwork ready, police certs obtained etc etc. Just medical and interview needed!

    Well, you decide between two paths. She cannot enter with the intent to immigrate, so if your plan is now to send in the I-130 and then file I-485 when she comes back from xmas that would be illegal. Since she didn't have intent to immigrate on this trip, she can file I-130/I-485 concurrently now, but this will be her only chance to do that legally. Otherwise you can file I-130 alone and follow that separate process which results in an embassy interview and triggering her permanent residence when she enters the US after visa approval.

    Reading further on this last night, is there any reason that we cannot file the I-130 and I485, along with a I-131? It states the following on USCIS website (only the travel bit applies to my mom).

    If your parents are in the United States and have applied to adjust to permanent resident status by filing Form I-485, they are eligible to apply for employment and travel authorization while their case is pending. Your parents should use Form I-765, Application for Employment Authorization and Form I-131, Application for Travel Document, to apply for travel authorization. The fee for Form I-485 also covers Form I-765 and Form I-131 until a decision is made on the application to adjust status.
