  1. So...here's a little background info. I'm the USC, and my fiance is from the UK. He had his interview yesterday and it is now pending blood results. He had his medical in May and everything was fine, but since he had a DUI 18 years ago, his interviewer wanted to do a toxicology blood test on him before granting the visa. Here's the problem, I don't know if they are just testing for alcohol, or other things...he did have a joint last weekend, but this was actually not even realized immediately by him. He bummed a cig from someone and it had pot in it, it's very common in the UK for them to roll their own cigarettes and alot of times, if they roll a joint, it has tobacco in it aswell. He said he smoked about half of it and thought it didn't taste right so tossed it, he's now worried it had pot in it, but he is not a drug user!! I can't believe this is happening, he police report was fine, passed his medical, but I'm afraid they will find pot in his blood test. Is there anyway I can fight this? I mean, could he possibly take another blood test or take random drug tests here in the US to prove he doesn't do drugs?? I'm not sure what to do at this point, I'm not sure if I should get a lawyer and try to waive this or what I should do. Any answers would be appreciated!

  2. A k3 visa is for a foreigner, so you don't need one to join him in the UK. The UK does require a visa for you to go and marry him though. If I were you, I'd prepare for the fall back plan of living in the UK. If they detect the pot in his system and deny the visa, you'll need an attorney's assistance but with no assurance of a positive outcome.

    Do you have any information on the visa I would need for me, the USC, to go to the UK and be married to him? Also, if they deny the visa, do you think an attorney would be beneficial for me?

  3. The just stated it would be a toxicology test...but with a previous DUI, I'm wondering if they just checked for alcohol, do they have to specify if they are doing a drug test? I know in the US, they inform you if they are testing for drugs.

    I'm really wondering what my options are...could I hire a lawyer and try to fight this, saying he smoked a joint thinking it was a cigarette(in the UK, they roll their own cigs, and if they roll joints, most of the time they have quite a bit of tobacco in them as well.) Is there anyway to fight this?? He's not a drug user, the rest of our petition and interview were fine. I'm wondering if we could do another drug test in the future to prove he doesn't use, and maybe he could do random drug testing for awhile while he is in the U.S.

    If the worst happens and he isn't able to immigrate to the US there would be no reason why you couldn't immigrate to the UK....it is a whole lot easier and quicker....good luck :thumbs:

    Under which circumstances should I apply? If we got denied a K1 for US entry, will that hurt our chances of being together on say a K3 or something? How soon after denial can I reapply? Thanks for all your help, I'm just frantic at this point, all this time and hoping, it really is a mess right now.

  5. Do you think I have any other choices here....could I apply for a visa to be married and live with him in the UK? My report is clean, don't do drugs, we really are legit. I've come to terms that he probably can't come to the U.S. now, but would there be any reason why I couldn't go there?

He is by no means an alcoholic, maybe has a beer here and there, but they asked for him to go to the same place he had his medical to get a toxicology report and our visa is pending at this time. I've never heard of them asking for a toxicolgy report and I think this is out of character. My main problem is that my fiance does smoke pot from time to time(very rarely), but he did have like 2 puffs last night so it will more than likely show up on the toxicology report. At this point, I don't know what to do but I would love any help and any answers on this would be greatly appreciated.

  8. So...my fiance sent out packet 3 on June 7th....he gave me the LND# and I plan on calling the Dept. of State tomorrow morning to see what is going on, just wondering if the LND# is all I need. We are kinda planning on him coming to stay on Oct. 1st and then marrying the end of Dec. I don't want to start wedding plans without knowing when the interview will be but I assume it's coming soon?!?! Wish us luck! :)

  9. Okay...so I'm getting a bit impatient....packet 3 was sent out June 7th...just wondering a roundabout figure on how long it takes for packet 4 stating our interview date. It seems like it takes 3-4 weeks roughly on what I gather, we're about 2 weeks in, is there any way to see if our interview has already been set? Should I be getting nervous that it's been over 2 weeks and we haven't heard anything??? We are on the last leg of this whole visa experience and I can't wait for it to be over!!! :wacko:

  10. I called the Dept. of State yesterday and found out when my fiance's interview is. Just curious and tired of waiting on P4 to arrive in the mail. So they must be tied in to one big database. He told me London scheduled it Wednesday and the letter would probably be there next week. Maybe if you the USC called the DOS and explained your concern, they might have information about your case. If he doesn't have info then tell him your story about the one month old letter not being good enough and ask him what can be done to find out where the visa is. My guy that answered was very nice and very cheerful. They just asked for the LND2008xxxx case number and the beneficiaries name.

    Dept. of State (202) 663-1225. Press 1 for first menu choice and press 0 for second to get to the live person. The messages by the automated answering recording are very long, so just skip over them.

    Where do you find this LND number...I was thinking about calling Dept. of State in near future but not sure where to find this case number. Any help would be appreciated! Thanks!! :star:

  11. So the 4 month expiration date for the NOA2 is for the whole process to be completed, interview done, visa in hand? I'm getting mixed answers, some say the 4 months is to send back packet 3, others say you have 4 months to interview date. I'm so confused right now!! Should I just go ahead and send him another letter of intent to marry? Our NOA2 expires July 10th, he send packet 3 out June 7th...maybe he should call someone to schedule interview closer? I don't know, any other answers would be great! :thumbs:

    This was a big concern for me as well...my fiance just sent out packet 3 on Saturday....our NOA2 expires July 10th. I was under the impression that you had to had your visa by then, not the sending out of packet 3. If it's meant that packet 3 is to be sent within 4 months then no worries for me!! I'm wondering however, if we should get a hold of someone to possibly get our interview sooner because if we need the visa completed by the time the NOA2 expires(in about a month's time!! ) then we better be on it as it's a month away. If anyone knows where I can get info on this, I would greatly appreciate it!

My fiance is coming here from May 22-May 31, I've got my stuff sent over to him for packet 3 and he can schedule his medical at pretty much anytime....what I'm wondering is, if he should wait to send back the packet 3 info or schedule the medical to get done before he gets here because from the sounds of it, the interview could very well be scheduled whilst he is over in The States. Can you request a time for an interview? Should he wait til closer to coming over for the visit to go to the medical as I believe once the results from the medical are forwarded, packet 4 is closely followed. Please any advice here would be great!! :wacko: Is it safe to send Packet 3 back soon and hope that the interview isn't scheduled to maybe June? God I never thought I would want to put it off at all lol, just maybe a week or so :star:

So I(the USC) got my info for the I-134 all set and notarized and sent it to my fiance in England today...what we were wondering was if you sent back packet 3 before the medical or do you take the medical first and send that information along with Packet 3. He has called about the medical and can pretty much get scheduled at any time, just wondering if the medical is to be included in Packet 3 or if it's seperate.

  16. Ok....so here is my dilemma. My UK fiance received packet 3 in the post late last week, from what he can gather, he must have his medical completed aswell before sending it to the Embassy. He called for his medical today and they basically asked when he would like to get it done, even saying he could come in tomorrow!! Can you believe this?!?! For once things are moving quickly!! Anyways, from what he says, I only need to send him the 1-134, and then he can send out the rest of stuff, divorce decree, proof of medical etc. After this "Packet 3" step, do they then send him the "Packet 4" stuff, of which basically just is information on the Interview...this is all that I can see of which "Packet 4" consists of. Anyways...back to my dilemma lol, he is planning to come here to the US May 22-May 31 for my brother's wedding, he suggested bringing all of his packet 3 stuff here so that we could help each other fill it out properly and that way, if Packet 4 did come straight away if we sent out 3, then there would be no way of them scheduling it whilst he's here in the States and then having to reschedule. I remember with the NOA2, I believe it said something along the lines of having to have the whole process completed in 4 months or something, have others waited a couple of months before sending back Packet 3? It seems as though everyone that I've come across on here has sent it back within a couple of days....I'm just afraid if we wait to schedule the medical, we may not be so lucky and they may make us wait months before he can get it. What a messed up experience this can all be at times lol. Any help would be very much appreciated!! :blush:

  17. Okay now I'm stressed once again lol. So....after what seemed like forever, but in actuality only about a month, my fiance received his Packet 3 last night. I should have been on the ball, but I haven't gathered anything to send to him yet :unsure: I know I need the 1-134(affadavit), can I get this online? I feel so unprepared!! How long does it take to gather all the necessary things so that I can get this to him asap?!?! I think I'm going to get my letter from employer tonight at work, probably head to the bank by end of week/beginning of next week, have some pay stubs, can copy my last W2 form...is this enough??? God this experience is really something else!! Any advice would be greatly appreciated!

    Background checks, overstays, making sure your relationship is a bona fide relationship, etc. etc.

    Have to prove you are the real deal.

    Everything went ok and the interviewer had decided to send the petition back to the USCIS (denieing the petition). To be honest till this moment we do not know the reason for denial, despite we have contacted the senator ,but nothing was received from the embassy about the reason.

    we have been so sad ,so confused ,and nothing to do.

    we have pictures, emails ,SMS messages ,call records, and they did not take care of those evidences...........

    That truly must be the worst feeling in the world, it's #### that these people that don't even know you choose whether or not your relationship is real.

  19. Am I just doing some wishful thinking here or do you think that if your 1-129F bit gets approved, that the whole process will eventually get approved? It's so stressful because at any time these people could deny your petition and probably ruin your life! God that sounds depressing lol, but anyways....I'm thinking chances are good for a K1 as I believe the hardest part is over with. Has anyone got a NOA2 but eventually denied a visa??? :wacko:

  20. How fun is all this waiting?!?! I got NOA2 approved March 11, and I've read the other posts and others are still waiting for their transition to packets 3 and 4. I did get a letter from I presume the NVC last week saying they would that the beneficiary would be receiving something as they would be sending out in the next week, is this packet 3? What the hell is taking so long :protest: Oh well...just another waiting game, that completely sucks, and nobody else you talk to really understands it all unless they are going through it. Just wanting to vent a little, so thank VJ for letting me "get the lead out" :P
