  1. Thank you all for your replies! I really appreciate the responses. The assignment is not due until December so I will be doing it sometime in November, if that is still ok with whoever is willing. I will start to make some more concrete plans for the interview at the beginning of November. Again, thanks so much for the willingness! I will try to make personal contact soon. THANK YOU!

  2. Hello to everyone,

A little history... my husband immigrated to the U.S. in Dec. 2009, during the time preceding his entry, I used VisaJourney religiously. It was my support through the long months. So now here we are... married and he is working in a great job and I am going back to college. So, on to the topic!

For a class assignment I have to interview someone who has immigrated to the U.S., and I can't interview my husband because the situation is to familiar to me (awwwwww). I am, therefore, looking on VisaJourney, wondering if there is anyone who would be willing to be interviewed. I think it can be via chat but I would love a phone interview. If there is anyone out there who could give me just a little bit of their time, I would really appreciate it. There is no strings and it means nothing, except for a grade for me. :)

  3. Still no greencard here!

We called USCIS and the lady only told us that we had to wait a while (not stating any specific amount of time) and that she didn't know anything else.

My husband is going back to Spain on Sunday and we figured it would be here by now. The notice says within 3 weeks, well Monday is three weeks :(

I hope his notice will be good enough for re-entry!!

It will not be good enough for rentry. He must have the card or AP document. I suggest you reschedule the trip and wait until the card arrives, or wait and make an infopass appointment and get a I551 stamp in the passport, prior to leaving. He will not be allowed back in without the stamp or card.

He has an AP document, so that won't be a problem. We just weren't sure what they were going to ask for because his AOS has been appoved so maybe the AP docs weren't necessary. Well, he has what he needs, I'm sure, we were just hoping for the actual greencard so there would be no worries on our part.

Get the I-551 stamp! That way, he comes in through the "Citizens and Residents" line and no problemo.

With the AP, he has to go through the visitors line and can be denied entry and you'd be in a lot of trouble.

Seriously, make that infopass appointment, well worth it.

Why would he be denied entry??? I thought that's why we applied for and got those AP documents?! Besides he's got the form that says he has AOS approval!

  5. I wondered if anyone can tell me something. Today Marcos received a book called "Welcome to the US" guide. This after receiving the Welcome letter saying he would receive his 2 year green card within three weeks. Has anyone received this book before the green card or after? What was your timeline for that? I know it's crazy but we are a little worried because the card hasn't arrived yet ( you know lost in the mail, etc )

Thanks (from a worried wife) to any one who responds

  7. Case was transfered to CSC today. I'm still not exatly sure if that is good news or not or what it means in regards to time frame but regardless, I am happy things are moving along now.

I would think that's good news and that you won't have an interview. How did you find out? Was it a hard copy notice in the mail? Did you get an email? Have you been able to view your case status online?

I am guessing it's good news too! let's hope... we have been watching our status online from the beginning so that's how we know, it was posted there yesterday. No hard copy yet. No email

  8. Hello to all! Biometrics was done yesterday for Marcos. He is soooo relieved, to say the least. The experience at the Milwaukee office was GREAT! We didn't have any trouble finding a place to park, in fact, it was right across the street. We were there early because we wanted to make sure we had plenty of time and I suggested we go in, the worst they could do is tell us to wait until our appointment time. But we went in and after the guard looked at the appointment letter, let us in without questioning the time. Marcos filled out a simple form. There was only one person just ahead of him so, in fact the lady at the office was kinda waiting for him to get done. LOL She did all the normal stuff and then at the end, (pointing to the barcodes/numbers for the I-485 and I-765) said, "This one (the I-765) is gonna be at the address you stated in a couple of weeks. And (pointing at the I-485 number) you're gonna receive your card in a couple of months." Sounds like the end, doesn't it? :innocent:

  9. And what does someone think of this??

The guidance states that the I-864 becomes enforceable at the time that the immigrant becomes a lawful permanent resident. Thus, the determination of whether the sponsor meets the law’s requirements must be made at the time the case is adjudicated and not when the I-864 is filed. Recognizing that usually there is a long delay between the filing of an adjustment application and its adjudication, the guidance authorizes local INS offices to decide when it is more appropriate to require the applicant to file the I-864: either with the adjustment application or at the time of the adjustment interview.

    I found that here.... http://www.nilc.org/immlawpolicy/aosupp/aosupp009.htm[/url]

  10. If you do not meet the 125% income then you will need to find a co-sponsor, if you try to apply for AOS and the EAD and AP without the required affidavit of Support then your application will be returned to you or you will get a RFE and will need to submit the affidavit of support for your Case to continue.

You will not get the EAD before you submit the affidavit of support

If someone submitted the affidavit of support (and not meeting the income requirements), would the result be the same, do you think? No EAD? Or is it possible they would issue an RFE for not meeting the income requirements but still issure the EAD. It would seem like it would be benificial so that the intending immigrant could start supporting themselves by working.

  11.:wow::dancing: HE GOT IT!!! OH MY GOSH!!! I can't believe it! Marcos has just called me. He just got out of the Embassy! HE GOT THE VISA!!!! (well, in about a week he will actually get the visa! LOL!) I am sooooo happy and soooooooooooooooo relieved!!! It's almost to good to be true!!! can I let myself believe it???

Who's with me? YYYYYYYYYYYYYYYYYYYYYEEEEEEEEEEEEEEEAAAAAAAAAAAAAAAAAAAAHHHHHHHHHHHHH!!!!!! (horns tooting, confetti flying etc etc etc)

  12. Hello my April filing buddies ;) just checking in with everyone, reading all the progress reports!! there is such great news here. it's been a long month for me so I haven't been on much. I am just worn out from waiting and then the waiting being made longer because of this delay or that :clock: Finally I am seeing light at the end of the tunnel and I can start to count down the days (assuming all goes well at the interview  ) I miss Marcos so much and it feels like life is on hold without him and to top it all off his work has consumed him so that we don't even get to talk a lot. If he can come on the first of December it will be exactly 9 months since we have seen each other (enough time to have had a baby LOL) and I know there are those out there who have been apart a longer time than that and I feel sooooo for them :crying::crying::crying: but I guess, as I have read, when this is all over and just a memory it will be so worth it and it will not seem like such a long time nor such a big deal. Sometimes life just gets overwhelming at certain points though.

SOOOOOOO, here we go, the last leg of this part of the journey to be together. Help me countdown, guys.... 20 days to interview

  13. CONGRATULATIONS TO EVERYONE!!!

    But I need some help...

I finally received Packet 3 (YAY!!) in a small envelope containing so many forms... I'm confused, do I sign the affidavit of support or not? I don't have any kids to bring with me or anything... RARR we're just sooooo close!! >_<

    Hi Perlin,

You have to read the instructions very carefully. The exact directions should be in there. I am the USC but from what I understand from my fiance's packet he had to fill out a financial form too, as well as me. In our case in Spain, they want to know what financials he has. We had questions also but we called the embassy and they were VERY helpful. :yes:I don't know about your embassy but is it something you could try? Most of all, take a deep breath :star: it will be ok! it seems like a lot but just go through it STEP by STEP.

I wish you the best! Good luck to you! and always feel free to ask here, even about little things! everyone is always so helpful on VJ :luv:

I've tried asking them questions before, but all I get is one word answers, usually "Yes" or "No". Not very helpful at all. It's kinda sad, really. :(

Maybe I should try again. I read the instructions, but how do I prove I will not be a public charge? I don't think I need to fill out the affidavit of support because seriously, I have NO ONE to support aside from myself. Or does my fiance fill one up instead?

I didn't mean that you have to fill out an I-134 for yourself, definately the USC fills out the I-134, but I only meant maybe you show the embassy your financial situation, if you have any savings, assets, etc, and your income earning potential (ie, your work history) And in our case, they wanted to know that Marcos has some place to go, that someone is going to be taking care of him when he gets here. I am NOT saying the financial information about you decides whether you get a visa. I was just trying to help you with your confusion about all the paperwork. If you fiance meets the poverty guidelines and is going to fill out the I 134 form, and it's only you and him he has to support, I really wouldn't worry about the public charge issue.

About calling the embassy, I think, maybe, they can't volunteer information, that's why they answer yes or no, because that was the way it was when we called to, they didn't answer any question but the one he was directly asking. I would say KEEP ASKING questions to them though.

    Hope this helps. ;)

  15. Hello!! :help:

I finally received a letter from NVC that my approved petition was received.

I would like to ask those who have Manila based US Embassy....Is it easy or hard to make an appointment?...Should I wait for the packet first?...

You're response will be very much appreciated!

    Salamat! ^_^

    Hi everyone!

Last week I started looking for a new house for me and my fiance, and I found this perfect one, and I was approved for it! They needed the deposit by Tuesday (today). It all hinged on whether or not Jimmy would get his Visa approval for his interview (Monday-yesterday)

AND HE DID!! HE GOT APPROVED!!!!!

He called me 40 minutes after his interview (that's all it took he said!) in tears, and they told him "congratulations"! I am still in shock. I can't believe today I get to FINALLY book wedding plans, make wedding invitations, sign papers on a house, and KNOW THAT HE WILL BE HERE FOR GOOD IN THREE WEEKS!!!!

For everyone else who is still waiting, it will happen! You will get news soon!

    Heather

:dance: congratulations to you guys!!!! sounds like there's a great future waiting for you! best wishes

  16. Hello once again and best wishes to all of you on this road to happiness.

I have discovered after calling the number given to be by USCIS that the petition ( I-129F) is on it's way to NVC now.

Could anyone perhaps help me in the following questions before it gets there as I may need some time to gather anything I will need next ?

What is the form I would need to fill out for the sponsor's affadavit of support ? I will most likely need a co-sponsor and do they use the same form or is there another one for a co-sponsor ?

Does it matter what source my income is from ? Currently, I am receiving a DIC monthly payment from the Veterans Administration on my late spouse as well as Social Security for myself and my child. Do they use your previous tax returns as a basis of income or is it solely based on current income ?

Is there any other sources I can use other than my home, car, and land ? The land I am referring to is clear of any debt as well as a car. I have one home that may have more value in it since the mortgage is close to a payoff. Is there a specific form that I need to attach to show the value of these ? Can an appraiser give me a figure for all of these or would I have to get the car valued at a dealer ?

Is it possible to use assets alone if they total enough or is it better to have a co-sponsor and use the assets along with both sponsors ?

Thanks for any help with this.

The form most often used is the I-134. Although for some embassys it is not required. I have heard of people just giving their financial history with proof (tax returns, pay stubs, assets, etc.) but I guess the I-134 puts everything together nicely. From what I understand, the co-sponser uses the same form... exactly the same as what you do.

This link might be helpful to you. http://www.visajourney.com/forums/index.ph...avit+of+support

there is a forums search option at the top of the page.. I have used that MANY times and "researched" what others have said.

About the assets, I have heard that assets have to be valued at least three times the poverty level for your situation.

I hope I have helped in some way. Good luck to you!
