    Did you have a immigration lawyer when you applied?

    Regarding the letter from my ex .... no way ...

    I divorced him on ground of abuse. He did and would do anything he can or could to screw me.

    That's the kind of guy he is ... I guess I just have to prove that to USCIS....

    Don't worry too much about sending too much evidence, if something is missing or they want more they will just send you an RFE and then you send more. I got my case approved after getting divorce and it took exactly 13 months, so when my NOA expired I got my passport stamped and a month later my case was approved. I did not have a lawyer....I did it all by myself (including divorce).

    I am about to file I-751 with an waiver. I got my divorce based on USC abuse. Could you tell me about the waiver you filed?! Did you only mention the good faith part and joint assets/liabilities or you also described the entire relationship?

    I am very sorry that I did not reply earlier, I was on vacation and did not check the posting.

    I filled the I-751 and check off filing by myself due to divorce. I submitted evidence of the shelter I was in (they wrote a letter), I never called police so I didn't have a police report, I did have my restraining orders and also a copy of my credit card bills since he used to go on shopping sprees and I owed over $25,000 in credit cards. The rest of the bills (electric, gas, cable, etc) were from two years prior. I left the home 4 days after the interview with just my passport stamped.

  3. After 13 months of waiting I finally got the email that I was waiting for...Case Status: Card Production Ordered.

    This is not an example to follow but for those who are going thru domestic violence there is hope. I left the home only a few days after the initial interview with only my passport stamped. Went to a shelter where I received a lot of help from a psychologist and an occupational therapist. After a few months I filed for divorce. I had a restraining order since I left the home. When my 2 year GC was going to expire I filed my I-751 with all supporting evidence (Of course that the joing stuff was from two years prior since I don't know where my ex is) and waited.

  4. Hello all I'm new to this forum.

    However I have a few questions that are pressing on me.

    I'm married to a u.s citizen and I have the conditional GREEN CARD, it expires on 5-8-09; sadly we are talking about getting a divorce. What are my steps to take? We have talked many other times about this however we've never done anything; sadly this time I'm sure it will happen. We have a 2 year old together and it would be much easier for me to stay here in the U.S for me to see my daughter.

    What do I do in this case as my experitaion date on my conditional card is sorta coming up real soon but at the same time we have not yet filed for divorce.?

    I filled and I've been divorced for a year now. You are able to file even if you are divorced.

    I am a little concerned. When I sent my package to the VSC and a week later they hadn't cashed the check I got nervous and checked the copy of the paperwork I had sent. Of course in the first page I found an error. On part 2 I had checked off (a) and (d). I should had only marked (d). I did explain in the letter what had happened (domestic violence) and that's the reason I am divorced.

    They just cashed my check 6/5 (posted to my bank account today). What should I do?

    Send a letter to immigration with my A# explaining my error?

    Should I call and ask customer service?

    Or should I just let it be?

    I still haven't received the NOA or biometrics letter.

  6. Wow, I thought my case was awful but after reading your cases I see mine is pretty simple. I was in the same situation as you ladies were...verbal, economical, emotional abuse, isolation, etc. I give thank to God I have the best friends in the World. They found out all the information possible for me to leave the home and still get my green card. I went for help to a place called Help for Abused Women and Children. Immediately they told me the danger I was in and that I should get a restraining order. I said no because then my paperwork is in jeopardy. I can hold on to the economic, verbal, emotional abuse until I go to the interview. My mother flew from my home country and stayed with me at that home for almost two months until we left, only 4 days after the interview. I dropped him off at work, got a new car (he had totaled mine), packed up some of my stuff, dropped off the restraining order at the police station and on our way to 9 states far away from him and into a shelter for abused women I was. There I got all the help and the support I needed. I had left a forwarding address for my mail...so my green card arrived at my friend's address. He never showed up to divoce court. I knew he wouldn't because he knew he would have to paying my credit card and the bank account that he had cleared up. By the time I left the home I owed around $25,000; he had even bought a car with one of my credit cards.

    Now I'm filing for the removal of conditional. I got my fingers crossed since I'm filing divorced.

  7. In my opinion it would strengthen your case if you apply under the battered/abused category. for a waiver from joint filing requirement. The instructions for I-751 (http://www.uscis.gov/files/form/I-751instr.pdf) lists the extra evidence required for that. Seems like you should have all that since you had a restraining order, were in a shelter, and also have a divorce. Good luck.

    From the instructions...

    If you are filing to waive the joint filing requirementbecause you and/or your conditional resident child werebattered or subjected to extreme cruelty, also file yourpetition with the following:

    A. Evidence of the physical abuse, such as copies of reports or official records issued by police, judges, medical personnel, school officials and representatives of social service agencies, and original affidavits as described under Evidence of the Relationship; or

    B. Evidence of the abuse, such as copies of reports or official records issued by police, courts, medical personnel, school officials, clergy, social workers and other social service agency personnel. You may also submit any legal documents relating to an order of protection against the abuser or relating to any legal steps you may have taken to end the abuse. You may also submit evidence that you sought safe haven in a battered women's shelter or similar refuge, as well as photographs evidencing your injuries.

    C. A copy of your divorce decree, if your marriage was terminated by divorce on grounds of physical abuse or extreme cruelty.

    An alien can file the I-751 alone under any and all of the grounds applicable. OP, have you already submitted your I-751?

    I still haven't sent in the paperwork, my GC expires on June 18. I am currently gathering information to submit and also affidavits. Hopefully I send this at the beginning of April. What you are saying is that I can mark both divorced and abused/battered? That would be great.

    What I am afraid is that since I don't have any police reports or pictures of abuse it might not go thru under abused. But I was in the shelter plus I have prove of all the economic harship I'm in due to his spending sprees with my credit cards, plus the diary that I kept and sent to the psychologist from a shelter while still being with him.

  8. You file your I-751 with a waiver for reason of being divorced. Aside from the proof of co-ownership of assets while the marriage existed, you will attach a copy of your divorce decree. I believe some VJers who also filed a waiver included a letter explaining the reason why the marriage ended.

    Aside from the joint lease, car insurance, bank statements, and taxes I will include the divorce decree (which doesn't have written anywhere that it was because of abuse, plus he never showed to court) and I will add the list with the amount of consolidated credit cards, letter from the shelter and restraining orders. Do you think that will be enough aside from affidavits from whom used to be our landlord, my best friend, and my aunt?

    I see that most of you have applied for the removal of conditional but you are all still married. I have to apply for the removal of my conditional on my own because I got divorced due to abuse, verbal, economical and so on. I was in a shelter for abused women and children for three months and also have restraining orders. Aside from that I don't have any other police reports.

    I have the lease under both of our names, bank statements, tax returns but what else aside from the things I've just mentioned do I need to prove that I got married in good faith and I got divorced due to the abuse I was going thru.

    Should I file just under separate or under abused?
