  1. Got approved yesterday at our AOS interview. It was very relaxed, I expected a grilling. My wife speaks only Spanish, so i brought a friend to interpret, but he is here on a b 1 visa, and since he is not a resident alien or citizen he was not allowed to further attend the interview, however i was allowed to translate for her.

    Only questions were

    How did we meet?

asked her for her address, phone, mother and father's first names

how many times did she meet my mother, what were the reasons for the visit

the other questions were just the basics from the application such as

do you plan to engage in espionage, etc...

    traffic or use of drugs

    prostitution

of course all of these answers are "no"

then she said "ok thank you your card will arrive in the mail".

    she took her I94.

that was it out in 10 minutes

Good luck to those of you still waiting.

It is a great feeling to know that you do not have to deal with USCIS or explain your relationship to the government for a long time

Congrats  . So they didn't ask for 2008 taxes nor copies of evidence nor pictures? Yesterday was a 100% approval day for our Jan filers. Tomorrow we expect the same for c&z. All the best

no, they did not ask for 1 document or photo, (made me waste my printer ink!) lol

  3. the key word here is "online" affair. Unless he is going to actually fly to Cebu and meet this woman I wouldn't worry about it, smack him upside the head and tell him to stop. in essence he is interacting with a computer screen, not a person. (my opinion only, i'm sure many would consider this emotionally cheating, but the physical aspect at least i not there.)

  4. Hello All,

I just returned from work and checked my mailbox to find interview letter for my wife's case. The interview date is May 08, 2009. I hope everybody gets his/her interview letter soon.

Quick question: The interview letter says: Request to appear for initial interview --- is it a standard lingo that USICS uses for its interview notification letters?

Also, the letter also talks about bringing a list of things such as Medical examination, Affidavit of support, birth certificates of applicant and kids etc. etc. Is it standard for all interview letters or am I getting a SPECIAL treatment...

    Thanks all...

Our interview letter says the same thing, I think it is standard

I hope we are not required to bring the medical exam info since we do not have it! It was sent in with the application, along with the affadavit of support. It is curious, to me, they would ask you to bring the things that have already been given to them with the AOS application.

I am not going to worry about the medical, it says to bring it (if not already submitted), I enclosed the required i 693 forms with my I485, I think this is a general letter and people that are adjusting status from other visas may require a medical at their interview

  6. just found this thread, add me to the list filed 1/20......also I am noticing that the cases that get transferred to CSC are usually transferred within a month, so is it safe to assume that if you don't see a transfer letter within 6 weeks you wont be transferred? or am I just foolishly trying to imply that USCIS has a pattern.....anyway, just an observation

Just received my appointment letter it is April 14th in San Francisco, It seems USCIS is no longer backed up, I was in no hurry for another freakin interview, but I guess it is a good thing, the green card will arrive shortly thereafter, good luck to the rest of the AOS filers of January

  7. Hi folks.

How do I file taxes without my wife having a SSN? They won't give her one until the AOS Petition has been approved and I need my taxes complete for the support document. Has anyone else run into this problem? Also which name do I use on the AOS paperwork? Her maiden or marriage name? Any help is greatly appreciated.

    Donny

Donny, someone is giving you very bad information. My wife (then fiancee) got her social security number the day after she arrived. K-1, K-3 visa holders can get the SSN right away. If you have any trouble at the SS office, ask for a supervisor. She will need to have an SSN or you cannot claim her on your taxes. She is definitely entitled to an SSN and she does not have to wait until AOS to be completed. She doesn't even have to wait until she is married, we were not.

Here is a tip at the SS office. Apply for her card in her maiden name, exactly as it is in her passport. DO NOT do a name change with SS now, it will take weeks and weeks to get the card. Use her name exactly as the passport and then change it later. If you file taxes electronically it will take TWO WEEKS for the IRS computers to catch up with the SS computers and your return will be rejected until they get your wife in the system. If you file a paper return, no problem.

We had this problem with Alla's son, who could NOT receive an SSN until AOS was complete. (k-1 and K-3 visa holders can get one right away, K-2 and K-4 cannot) We got his SSN and I filed taxes the same day. Rejected. It took two weeks until the return was accepted.

For the AOS you can file with your 2007 return right now if you want. I attached my 2007 return to our AOS filed in November (of course) and did not have the 2008 return prepared before the interview in January, no questions asked. If you have not changed her name with the SSN (I suggest you do not right now) you can file taxes with her maiden name, just be sure everything "matches", change the name later. There is NO NEED to change her name for the AOS, my wife did not (and does not plan to) change her name. You should also need an SSN to add her to your bank account, but this may be a bank policy, not law. Not sure, but we needed the SSN to add my wife at the bank. The AOS will look to a joint bank account as primary evidence you are married, however they never looked at any of our evidence in the interview, but I had it just in case.

She should get an SSN now, really, get with a supervisor and sort this out, it is not correct. Once you apply for the SSN, you can return to the office the next day and they can give you the number, but you will wait a week or so for the card to arrive. Your wife will have to return for the number, they will NOT give it to you. You can prepare your taxes as soon as you have that number and file a paper return; electronic, as I said, will have to wait two weeks.

My wife was given an SSN# 1 week after we married, go to your local office on Mon. I have read conflicting reports of when an ssn# is given, the only way to know is to just go to your local office and apply for one. I was under the assumption that my wife wouldn't qualify for one, but I went to the local ss admin office, applied with my wife, the whole process took 15 minutes, the ssn was received 1 week later in the mail with a stamp "not valid for work until authorized by DHS"

    "just do it"

I forgot to mention, by changing your filing status to Married filing jointly, you will qualify for additional money from last years econmic stimulus, which is now referred to as the rebate recovery, which was why I was so motivated to get that ssn for my wife! In my case 1200 extra on my return

  10. Hi all.

I am in DIRE need of any help you can offer. It is very worrying and perhaps stupid what I have done, but whats done is done, so let me quickly explain.

I was in the US on an overstayed tourist visa when my Girlfriend and I spontaneously got married in Vegas after 5 years dating. We then applyed for AOS and a green card for me.

We have been waiting so long just as you all have, but people on here were so helpful for the entire process thus far, including giving me the advice not to leave the country while waiting for my immigration appointment.

I have been 'stuck' in the States now for so long, and had no idea how possibly longer it could be for our AOS interview to come, that when my younger sister said she was getting married in Mexico I had to finally take a risk and leave, athough I didnt apply for advanced parole stupidly not thinking I would need it.

I had already missed my bothers wedding, have only 2wice been able to meet my nephews because I was so worried about being denied back to be with my wife, that is got to the point where I said I can be a slave to that fear of leaving the US.

Well now it has bit me in the #### big time, as I am in Mexico right now for the wedding next week, when the person checking my mail back home told me low and behold, my letter for the AOS interview arrived scheduled for 3 weeks from now. So, I am wondering about getting back into the US for this interview as if I state that as my claim for entry, I will prob be denied. People have said that leaving while in process will possible jeprodize our appeal, but why is that? Mostly because reentry is so hard? Or for other reasons?

And what is my best plan of attack. Should I perhaps just say I am coming in as a Canadian visitor?

So basically my two huge worries are....my reentry into the States.....and more importantly, will this somehow taint my appeal at the interview or can I not mention it. Anyways, I am now highly concerned that I made such a rash emotional decision to come to her wedding which might now ruin everything my wife and I have worked so hard and for so long for. You guys are the best in the biz and ANY and ALL help would be soooo appreciative and grateful. Again thanks.

maybe you can have the appointment lettr faxed to you and present it to customs, I have no idea if it will help, but couldn't hurt to try at this point

  11. Sorry but CSC is for California Service Center which I see is yours?

I am filling with Vermont. Do I still have to look for the EAC number?

Really sorry again but I don't have copy of this cheque but I want to be clear with my boyfriend when I will ask him!

CSC - WAC (Western Adjudication Center)

VSC - EAC (Eastern Adjudication Center)

NBC - MSC (formerly Missouri Service Center)

NSC - LIN (in the town of Lincoln)

thanks payxibka, I was just gonna post that

  12. Many say they see a number on the back of the check. I, myself, couldn't make anything out on ours.

Because of this post, I just looked at the back of my cashed check copy, and indeed the case number is there, it matches my NOA1, this is however for AOS, your case number I think would begin with the the letters "wac"

  13. Please help me. This is so confusing. Will this be a problem at the interview? I made $47,000 this year, took in 10,000 in rent from the tenant, and still my gross adjusted income was $35,000 after taking into account interest paid on my two mortgages and home owners association payments (it's the only property I own and it's out of state). I don't know what I should do. I have an adjustable rate interest only loan and the bank denied a mortgage modification, and I can't refinance. I've made all payments on the property. Please help. I was planning on not listing this in the assets section of the I134.

Your federal adjust gross income is what they want to see, not your taxable income, the $35,000 you mention is probably taxable income

  17. I went to the bank to get the statement for the I-134 (which might be too early considering our case isn't estimated to be approved until June)...

The guy gave me a letter that specifies date open, current balance, and average balance over last 12 months. It doesn't show total amount deposited for the past year, which the I-134 calls for.

Did anyone else experience this, and if so, was it a big deal?

If anyone else has Chase, please let me know how you got the total amount deposited for the past year.

It is no big deal, but you will need 12 months worth of bank statements to show consistent deposits, I have B of A, they provided the same letter, minus the deposits for the last year.

I have online access, I just printed my statements at home.

  18. I never thought I would be happy to say this... With MLK behind us we have no more holidays till Memorial day. You know what that means? Five full days of processing by the service centers! The only slowdown we might have is in March where moms / dads might take off for spring break. Hey given the economic situation I'll bet lots of the spring break vacations will be put on hold this year.

So there we have it. Two silver linings and its just Sunday!

Sorry, but February has 2 holidays, Presidents day, and/or Lincolns and Washingtons Birthday, Possibly three, but many agencys take off for Either Lincoln or Washington, but not both

  19. COME ON! ANYONE?

I copied this from the I-129f instructions, there may be achance you will be ok

You will not receive your original check back. We will destroy your original check, but we will keep a copy of it. If the EFT cannot be processed for technical reasons, you authorize us to process the copy in place of your original check. If the EFT cannot be completed because of insufficient funds, we may try to make the transfer up to two times.
