  1. Friend of mine: In the USA on a R-1 visa. Just married a USC and want to file for AOS. She is currently in the USA. What are the first steps? Medical exam?? Does filing for the AOS from a R-1 any different in requirements from filing it from off a K-1 or K-3? Can she leave the USA during filing for AOS or does she have to wait till she gets her AP document??

    Please help me out with the proper requirements and steps.

  2. My friend is in the USA on a religious work visa. She is engaged to a USC. She is a Canadian. Her fiance and her decided to get married July 5th 2009. She doesn't have a K-1 visa or such but is CURRENTLY in the USA legally. Can she get married on July 5th, 2009 without being here on a K-1 Visa and file for AOS right after they get married? She isn't leaving the USA anytime soon so she can stay here thru the process. Is there anything different she needs to do when filing for AOS since she is not a K-1 or K-3 holder but only a Religious Work Visa holder??

  3. I have a friend who is in the USA on a Religious Work Visa. She met a guy and wants to get married July 5th to him. She wants to know if she can file for AOS right after they get married on the 5th of July 09. She had no intentions of getting married when she came here on May 5th. Does anyone have any suggestions???? Can you she file for AOS using her religious work visa??

    I have searched all forums for a topic close to the one I am submitting without luck. I have found some info but I am not sure how up to date it all is.

    I had my AOS interview Dec. 17th 2008. My interview officer told us that the only reason we had an interview was because of my lack of vaccines. She said we would need to file a waiver. She got her superior to initial a certain form which she then mailed to me. I had to fill out form 601 and write a letter stating my beliefs were for religious convictions. I mailed it, including the filing fee of $545 USD in the beginning of January. They needed to have it back no later then the 17th of January. About a week after I mailed it, I received a receipt for my check and a letter saying they will notify me if they need anything more. I've left everything as it was. I haven't talked to them about it and I also have not heard anymore. Now my question is: How long does it take to get my greencard after filing the 601 form? My immigration officer told me that that was all they needed to grant me my greencard. She told me that I had filed everything else correctly. I have read from other places that it can take up to 15 weeks to get a reply back from them after filing the 601. Does anyone have knowledge in this sorta case? I would appreciate any answers. You can look at my timeline in my signature for when I filed AOS.

  5. Well nothing new here for the AOS portion. Still sitting at CSC. No touches since it was transferred. Thankfully Kris did find out yesterday that he starts working next Monday Dec. 1st. So he's extremly happy. I think that has been more stressful than waiting on some action on the AOS itself LOL.

    Congratz to those who have progress and patience to those of us who haven't. Let the holidays be wonderful for everyone!!

    Your situation sounds similar to mine except I had a lot of touches after being transferred and nothing ever changed. Just about a month ago, I got a random letter in my mail saying I was going to have an interview for Dec 17th. So even if you are transferred, it seems like they can still send you for an interview.

    Just some random info.....lol.

  6. mox, you are misunderstanding my position on intimacy. I don't have a fixation on it but rather a healthy perspective about intimacy, understanding that it is a very important part of a relationship, especially in the beginning (before marriage) and early in a marriage. It is huge milestone in a relationship to reach. It can be the "glue" in a relationship when times are tough and people can be less critical on their partner when they have a healthy intimacy. so...very important. I think most people reading this would agree.

    I hope I'm misunderstanding you, but I don't think that I am. You said in an earlier post that you are very inexperienced relationship-wise. Based on that, and what you've said in the intervening time, I think you're putting too much of an emphasis on it. Intimacy is not the "glue" in a relationship, and it sure as hell is not going to get you through tough times. Trust, honesty, and respect...these are all "glues." Intimacy is an expression of all these things, not a thing in and of itself. Without these other things, it's not intimacy, it's just sex. And hey, "just sex" is fine and dandy, but if you believe it can be a foundation of your relationship then you will be disappointed.

    The picture of your relationship that you've painted in your posts says that you don't have a full set of trust, honesty, and respect in your relationship. This is why I believe she's not willing to be intimate with you. So I'll say it again: The lack of intimacy is a symptom, not a problem. Work on the rest of your relationship and the intimacy will follow.

    Anyway, that's my last word on the subject. You're an adult and should make your own decisions. I really do wish you the best of luck, and please drop back by the RU forum with whatever happens. :thumbs:

    Just to add a girl's point of view. There are alot of girls out there that could live their lives perfectly fine without sex. She may be one of them. Also pressure from guys to have sex, can turn a girl away from them. Alot of girls appreciate quality time more then intimacy. Just something to think about. Anyhow, good luck with your challenges. :thumbs::)

I am confuse about changing my signature when me and my husband will file for my aos by the end of november....i didnt know what to do...i used my last name b4 i get married in my signature...my husband want me to change my signature into his last name as my signature now and i will really have to change everything...i just dont know if its ok or not?anyone can help me there?

    And also...can i change my last name b4 i get i married as my middle name now that im married when i file for my aos forms?

    Whatever last name you want to use for the rest of your life on your immigration documents, then use that name. If you want it to be your husbands last name, then fill out your AOS forms with your husbands last name. USCIS will know its legal as you send in a copy of your marriage license with your AOS. So go ahead and use your husband's last name as your last name on the AOS forms.

  8. I don't freaking get it... my wife and I got her case transfered to California on July 30th and we have yet to hear from them! This really sucks! Now we moved and I am not sure if i submit a change of address if that is going to delay things even more. Can someone help me please. I could always leave the old address there since the people who are living there are my ex-roommates and good friends. So i don't know what to do. Plus i thought i only had to change the address for my wife and now i heard that i as the sponsor also need to update my address.

    Hi, I was transferred to California too and had a few touches on my AOS and then just randomly one day, I checked the USCIS website and my AOS had an update saying I was transferred to my local office which happened to be Atlanta. Then a week or so later, I just got a letter in the mail saying that I was to come to such and such place which I am assuming is the local office in Atlanta for Dec 17 on a official matter. Anyhow, they told me a list of what to bring with me for my interview which they noted it was an interview on the list of stuff. Not on the first page of the letter. And I was transferred way back in the middle of July to Cali. So I guess they are just very random people. I am sure they will notify you soon about it. Hopefully, they will email you first and not be so random..lol.

    I don't think changing your address causes delay but then I can't be sure on that. Maybe someone else will answer that part. Oh and yes, you have to file for change on the USC address and name as well. My husband had to do that and his he had to mail in. Mine was able to do over the internet.

    Anyhow, hope all goes well and you hear soon from USCIS!!

  9. Received interview letter in the mail on Wednesday set for Dec 17th. We were transferred to CSC but still got sent for an interview so I guess not everyone who is transferred gets a greencard without an interview. Also, no email about the interview, just a letter in the mail.

  10. My passport is expired .. At the interview, IO looked at it but didn't say anything. I have a current U.S. driver license, though.

    Thankyou so much for you post. Gives me some hope and now I don't feel as stressed! I still don't have an interview date but its coming soon as they have told me already. So, I guess I should not apply for a new passport then because when I do, I have to send back my old one with the application. And what if my interview is before it comes back? So anyways, thanks again for your answer! and all you guys answers!

  11. Well, this is not what we expected after being transferred to CSC. Personally I wish they never did transfer us if they were going to make us have an interview after all. Oh, and I never got this in an email. I have just been checking the USCIS site everyday and tonight, this is what I came upon. I guess its better then getting an RFE for sure. Now I know we'll have to prepare for an interview. Wish I knew when because I have a job interview next Friday. I hope it won't be hard to get time off work to go for an interview in Atlanta. Anyways, good luck to all those who are transferred to CSC too. I hope you get your greencards without an interview!!!! :thumbs:

    Nothing good here. Went with my wife for an Infopass meeting on Friday to ask what's up with the EAD and AP that haven't arrived. Tried to show the lady the message from the National Benefits Center, dated July something, saying that they received our RFE information and that we should expect to hear something within 60 days. I noted to the Infopass lady that the 60 days had passed and we had heard nothing. Then she said to come back in 30 more days if we still haven't got anything.

    I pointed again to the ¨60 days¨and asked her if what the National Benefits Center tells us is wrong.

    She kept saying that, since we had an RFE in July, our process started all over again for the EAD and the AP.

    And I kept asking if what the National Benefits Center tells us is wrong.

    She eventually said that she doesn't know why they put that 60 days thing on their ¨Internet Form Letter.¨

    I asked her again if what the USCIS National Benefits Center tells us is wrong.

    After going in circles again and again with my question, she stated something like, if it made me feel better to think of it as wrong, then I should think of it as wrong.

    So I wasted my time taking a day off work and making my students go with a substitute teacher on Friday. The Infopass meeting was worthless.

    She said if we haven't heard anything in another month, then I can make another Infopass and come back to the office and ask the same question. Since I'm almost positive nothing is happening with our case, I'm sure I'll be taking another day off from work to go back on the Infopass and get some more wishy washy do-nothing answers.

    This immigration process is a bad joke. It's a game of chance as to which individual is handling our case.

    Later in my life, if I ever have the time, I'm going to become an official activist screaming at anyone who will listen about the mess that is the USCIS. Nobody who immigrates the right way, like my wife has, should be forced to live so much time without the right to work or to leave the country. Her grandma, who she lived with for a couple years, died during this process, and my wife couldn't attend the funeral because the AP isn't here. My wife fruitlessly mentioned that fact on Friday and it meant zilch. Neither attempts to pull at the heart of the USCIS lady, nor actual evidence from the USCIS National Benefits Center, meant squat.

    At this point in the process, I hold nothing against those who do it the illegal way. If it's this hard for the wife of an American citizen to legally work and travel, then it must be impossible for immigrants who have no familial ties to this country.

    Before the government even considers fixing the complicated illegal immigration problem, they first ought to fix the legal immigration mess.

    I am sooo sorry to hear all about this. I agree with you about how complicated they make legal immigration. I don't foresee it ever getting better though. They like to take their sweet time. I am still waiting for my GC but thankfully I have received my EAD. I hope your wife gets hers soon. Chin up!!!

    No you didn't come here overnight and that is why you should understand the severity of this situation. It is people like your SIL's babydaddy that make this process even harder on the rest of us.

    I feel for him and your SIL but we all had to go through paperwork and lotsss of money to get where we are today. It makes it difficult for us who want to do things the legal way. I think it was right of him to tell the truth. The truth is the best way!! :) Good luck

  14. That is the problem.... anytime after or beginning with a 6 mos outside stay (either one time or even sometimes aggregated) the DHS can deem you LPR status as abandoned and you will need to prove otherwise to get it back.

    yes, you are right..... and try to prove it at POE.... major headache if even possible

    So are you all saying that they still give you problems even with the reentry permit?? From what I can tell it seems that the reentry permit is good for two years....in other words, you can be gone from the USA living in another country for UP to 2 years and still return. Does that sound correct to ya'll????

  15. My father in law comes every 6 months to the US to keep his green card. CBP once told him to have in mind that after 6 months one may be subjected as residing OUTSIDE the US.

    Thankyou for the reply!! So when he comes every 6 months, does he just cross the border and then return like a day later back to Canada?? I am assuming he is from Canada?! Correct me if I am wrong.

  16. a re-entry permit is needed for a stay of 12 mos. or more. Some say that a stay of 6 mos. or more it becomes problematic. To be safe, try not to stay out for more than 6 mos.

    Ok, thankyou so much for that info. Now from my understanding, the reentry permit needs to be applied for before leaving the USA, right? and also from my understanding, the reentry permit is just like the AP or possibly it is the AP?? ???

    I found the above link on the USCIS website. Is that the correct form to fill out for the reentry permit?? If not, do you know which form? Also, do you know how long it takes to get the reentry permit from filing date??

  17. I was wondering for example, if one has their 2 year greencard, and during those two years lives in Canada for several months, when they come back, will they be legal here in the USA? Will they be allowed back in the USA? Like what if they moved there(to Canada) because of school purposes? School purposes for the USC and not for the non USC. And came back before their greencard expired. Any answer would be helpful. Thankyou! :)
