  1. This might be helpful to all military spouses who are filing from Germany. So I filed my I-751 last August 2008 from Germany. I got the ASC notice a month after filing. And then I did not hear from them for a long time until April of this year. I got a notice that I needed to re-submit a new set of fingerprint cards (FD-258) because the first set that I sent got ruined/smudged for some reason. And so I did.

    We are moving back to the States next month. My one-year extension letter is almost expired. I was already losing hope that my case was forgotten. I have called USCIS so many times. And they did help me out too. The Immigration officer contacted me through e-mail and updated me on my case.

    And just recently, I went to check my mailbox and then I see a letter from the USCIS. My hands were shaking as I opened & tore the envelope! And to my surprise - it's an APPROVAL LETTER! I could not believe my eyes! I was jumping up and down and hugged my hubby who was watching me go crazy! It feels so good!

    So, to all of you out there who are waiting on USCIS. Do not lose hope! It's true that each case is handled differently. The best of luck to everyone here. Thank you to everyone who have helped me here - especially to my fellow military spouse Stefanie and HappyOne - big hugs for you guys! I wouldn't have survived without your help! :thumbs:

    I am here asking again for your advice. I am in a really bad situation.

    I have applied for I-751 Petition for removing condition on February,09.

    I received the NOA I-797C and I did the biometrics.

    On July 18 we received the blue letter telling us that the documentation we sent was insufficient, the evidence is insufficient. And we have to the new evidence on or about August 23. We are planning to send back this week.

    My boss just told me I have to travel overseas from August 14 to the 24.

    I am terrified if something comes up wrong with my green card if they denied my second evidence

    I am worry to leave the country because I don’t know if they‘ll let me enter again even though I have the NOA I-797C that say my residency have been extended for one year allowing me to travel and work for one year.

    Any suggestions? What should I do? Should I wait to send my paperwork right before I have to travel, so I may not have an answer after I come back?

    Hi,

    If someone is in my same position, I just want to let you know I sent my RFE and I traveled overseas with the I-797C.

    I didn't have any problem to re-enter to the country. They asked me for the I-797 C, passport and GC and they asked which was the status of my case. I told them that it was still pending, and that's it.

    Now I am waiting for the response of the RFE. Do you know how long could take? I sent it on August 14.

  3. So I am a military spouse who filed the I751 from Germany last August 2008. It is almost a year since I filed and I haven't heard anything not even a "touch". I have only received the NOA1 but that's it. We are almost going back to the U.S. very soon which could be on late October or November. My extension letter is due to expire on October 18, 2009. The US embassy here does not grant extension stamps. My dilemma here is - can I travel back to the US with an expired green card and expired extension letter? Any help would be appreciated! Thank you!!

  4. I am a military spouse. I just recently found out that I can do my naturalization here in Germany. I know I am qualified but the thing is we only have less than a year left to stay here. Can I still do the expedited naturalization because my friend did hers and it only took three months and I will still be here until March of next year...

  5. Technically, when you file your N400 last March 2009, you were not yet qualified for the 319(a) of the INA which is the reason why they returned your application. You also don't qualify under 319B of INA because you're not about to PCS to an overseas duty station.. You would need to provide a DD form 1278 signed by the commander and your orders before you lodge the application..

    Actually we already had a letter from my husband commander regarding DD 1278. But my problem is, they haven't returned my application before they scheduled my fingerprinting and my interview. I just found out that there's a lot more about 319 (B) than what they have posted on their website, and I just know about it on the day of my so called "INTERVIEW DAY" (never happened).

    did you have to pay for it? or did they give you back your check?? I am thinking of putting my N400 application together here in Germany but I only have less than a year left. I am quite hesitant...

    LOL, I was just about to follow up with you as your name was mentioned above. Congrats by the way. Did you have to do an interview for this or was just the paper work necessary? I was just told that the interview is not always necessary.

    I am currently in Germany and I am about to file for removal of conditions this June. I had to fill out an AR-11 and I865 to inform USCIS of our new duty station. Then come filing time, I will send my I751 paperwork from here and use my APO address as mailing address. Fingerprinting can be done in any military installation, U.S. Embassy or consulates here in GE. We provide our own passport pictures too. For military dependents assigned overseas, we are not required to go back to the U.S. for biometrics. But then there's still a possibility we might go back Stateside for an interview. But most get approved without interview! If you have any questions, you can also PM me. Take Care!

  8. thank you so much! But this is the part where it gets real confusing. if my hubby fills out the I865, does he need to put the physical address here in Germany where we are stationed now. or just our APO. Any insight on this matter?

    Mail them an AR-11, as well as your spouse/sponsor needs to file I-865 to change sponsor's address.

    APO should be fine, I believe this will indicate what base you are stationed at.

    Lucky thing for you, time out of the USA because of military will not be counted against you if you apply for citizenship. You may want to read the citizenship guide, there are several benefits to being married to a US Citizen in the military.

    Thank you so much for the reply! I really appreciate it! I have considered pursuing naturalization but decided not to because it would really be a hassle going back and forth from the US to Germany. It's really tempting but I don't think I am ready for that. So Lifting of conditions it is for me a few months from now. Thank you again YUandDan!

    What if we are stationed in a military base overseas? Do we need to report a change of address too? Eversince I moved to Germany, I have not informed them about this. We decided not to since this is not a permanent address for us too...

    It's safe to assume that you have to report this move as well since the law (INA Sec. 265. [8 U.S.C. 1305]) stipulating this requirement does not make an exception for military bases or temporary moves. Besides, there is a place on the form where you can indicate whether your current move is permanent or temporary (and if temporary, for how long).

  11. I am in Germany living in a military base and I am about to file lifting of conditions a few months from now. My question is this - Is it possible for me to use my APO address as my mailing address when I fill up the I751? We have a stateside address but no one's there to monitor all my incoming mails. And also, will I still have to go back to the U.S. for an interview? Any help would be greatly appreciated..
