    1. How do I use my Advance Parole (AP) document?

    When you go through immigration inspection, you will present your valid passport and your valid

    Advance Parole.

    2. Do I have to carry both copies of my Advance Parole?

    You should carry both original copies of your Advance Parole. USCIS may keep one and will give you

    back one with your entry stamp on it. You should always have one original Advance Parole document. If

    you are traveling with only one original AP, you should advise USCIS that you will need to travel again so

    they will return your original AP to you.

    3. How long can I stay outside of the U.S. if I travel on my Advance Parole?

    You must return to the U.S. before the Advance Parole expires. There are no time restrictions on how

    long you can stay outside the U.S.

    4. Can I travel on my H-1B visa after I used my Advance Parole to enter the U.S. on my last trip?

    Yes.

    5. I entered the U.S. on my Advance Parole during my last trip. The immigration officer issued me

    an I-94 card with an expiration date that is one year from my date of entry. Will I be out of status

    when my I-94 expires?

    No. You are an applicant for Adjustment of Status so your I-94 card does not control your legal

    stay/status in the U.S.

    6. I received my Advance Parole renewal but my current Advance Parole is still valid. Is it okay to

    keep using the current document to travel until it expires or does the new document cancel out

    the old one?

    The new Advance Parole does not cancel the old Advance Parole. If you are outside the United States,

    you must return to the U.S. using the earlier Advance Parole approval and must return while that parole

    is still valid. The new parole document cannot be sent to you abroad. For subsequent trips, you should

    use the latest Advance Parole during its validity period. Again, you must return to the U.S. before the

    document expires. Each time you file for a new Advance Parole authorization, you must be physically

    present in the U.S. when the application is filed and received by the USCIS. While you can travel while

    the application is pending so long as you have another valid means of returning to the U.S., as stated

    above, the AP document cannot be mailed to you abroad to use to enter the U.S

    Am trying to findout the number of times travelling is allowed with an AP. i am inbetween status as i have filed for my AOS which also include the EAD, i have only been approved of the AP and i still have my biometrics unscheduled. is it possible to reschedule the biometrics appointment if it comes when am out of the country???? can i travel as many times as i want while waiting for my EAD to come????? can someone help me out on this please.......Thanks..

    I will like someone to shed more light on this please, i had my AOS sent in September including the AP and EAD. I got the acknowledgment receipt for the the packages and my cheque had been cashed as well.

    i received a notice that my i-485 had been transfered to CSC. sometimes in November. i received my AP in the mail approved on the 14th of December. my question now is, do you get approval without biometric taken? because i see other VJ's timeline and on it i see alot of people getting thier biometric done before receiving thier approvals in the mail ( i have not received my EAD approval yet). i called up the USCIS and i was told biometrics are requested based on cases and that mine does not require my biometrics.

    i do not really understand, but i only want to believe that they have my fingerprints from my k-1 interview which i did 3times and also at the point of entry @jfk or am i missing something??.....................i'll really appreciate your response please.............

    i arrived in the united states in july, on a K-1, i am inbetween status as my temporary EAD of 90 days had expired. before the expiration of my 90days EAD, i applied for a job online in october. i was offered a temporary position for the christmas season. My concern now is, can i take the job as i actually applied before the expiration of my documents or i have to wait till my i-485 goes through? i already have my SSN and presently, i need to support my wife as things are abit low financially. i will be very grateful if someone can advice.

    You can work if you have current authorization.... If you do not then you cannot...

    Your initial authorization period expired probably sometime in October

    Thanks alot for your response, my initial authorization expired on 9th of october, i have applied for the AOS including EAD and AP i have received the i-797 ( notice of Action) twice, i had a recent one for the i-485 stating my application have been transfered to the california service center from Chicago Illinois. Dose that mean the whole processing will start from the transfer date for another 3 or more months?

  5. I could be wrong, but from what I understand it does not matter when you apply for the job, what matters is what dates you EAD say. If it is expired you are not allowed to accept that position and if you are already working, you are supposed to quit/take vacation until you new EAD is approved (and possibly in you mailbox/hand)

    You work permit doesn't have anything to do with your I-485 unless you get a RFE from what I can understand, that will delay that too. You have to wait for your I-765 to go through, not just you I-485.

    I wouldn't suggest you work on an expired EAD - the penalty can be quite high from what I understand.

    My case was suspended as i have to present a police record from my country to the london consular.

    A death occured of a familly member( my uncle who was responsible for me after my father died).

    This will involve going home for the the funeral and this will take a long period of time as i will have to partake in the funeral and the final prayer after 40days.

    the police document is the only outstanding i need to provide to be issued my visa.

    with this develpoment i was wondering if i can get the police clearance in Nigeria and submit to the consular in Nigeria to obtain my visa so i would not need to come to london again as i am trying to cut cost.

    the funeral will require alot of money and time and i am trying to save to do my wedding with my fiancee as soon as i get to the US.

    So much happening i can not even think straight...........pls advice

    I would have the USC call NVC and the consulate to see what can be done. I have read of the USC requesting the interview take place in another country, but that was before any packets were sent out.

    Thanks for your response, however, i had the interview done in London already, only need to provide the police clearance from nigeria. Since i will be in Nigeria for a long period of time, i am thinking i can obtain the document and submit to the US embassy in Nigeria so i could leave to the US after the funeral. Then i don't have to spend money coming to london..... please advice

    Do you have the police report already? I would submit it ASAP, and then get the K1 in London before going to Nigeria. The K1 is valid for 6 months, so once you have completed all your duties in Nigeria you can just fly to the US.

    I don't know that the consulate in Nigeria will accept the police certificate on behalf of the consulate in London.

    Have you asked if this was possible in London?

    The process involves alot of procedures whereby i have to book an appointment with the British police to obtain fingerprints, then you send to the authorities in Nigeria. i called up to book an appointment for the print and the earliest date i can be sheduled for is June 13. i hope to be home by then and more over the price to do that in london is expensive, so i was thinking since i'll be home and is a Nigerian document that is required then that should not be a problem. i have emailed the embassy but yet to get a reply, am only curious to know if they'll not cancel and tell me to start all over again............

    I'll just like to find out how long and if usually there is a response from the embassy via e-mail. I had a reference code to email the embassy to reschedule an interview date. I emailed and i have only received an acknowledgment receipt that my email was received by the embassy. I need an advice if i have to wait for a response via E-mail or call- up the embassy as well, i have called up the embassy couple of times after but was told i'll be notified since i have emailed am really impatient cuz i haven't received a satisfactory information yet>>..

    I would like to know if anyone has experienced missing his/her K-1 interview date as a result of not receiving the interview appointment letter in the post.

    This my situation at the moment as i was told the first time i called the embassy that it usually takes about 6-8weeks to schedule an interview appointment.

    after i waited for 7 weeks, i rang back only to be informed i failed to show up on my appointment date on March 10th. i explained to the guy that i did not receive the letter in the post. he gave me a reference code and the email address to mail the consular to reschedule my interview. My concern now is if they read emails, if i would have to wait for a longer period to get another date, if this would not affect my visa as i only confirmed this 17 days after my appointed date. am so worried i need someone to shed more light if he/she knows the implication....................... mellow.gif

  13. Its funny, I returned my packet 3 documents special delivery, the royal mail somewhow managed to misplace the package!

    I resent the forms with a first class stamp, got a packet 4 only three days later.

    Lesson learnt, there is no guarantees with the royal mail!

    I totally agree with you saying there is no guarantees with the royalmail cuz am a victim of a situation whereby my K-1 interview appointment was mailed out and i never received it causing me to miss my interview date. still working on rescheduling it.........................worst situation to find oneself.

    Would like to know if it takes a longer period to have K-1 interview date rescheduled. called the US london embassy and was informed that i missed my interview date as i did not receive the prior notice of the interview in the mail and i have been waiting for it since february. the missed date was march the 10th, i was told to email the embassy which i have done already and received the acknowledgment of receipt of the mail. I have not being feeling alright since i i learnt of the missed date. can this affect my visa? i need someone to please shed more light on this type of situation, am really mad at the so-called royalmail now cuz i figured out they were on strike around that time. :unsure:

    I was just wondering if a marriage license is needed as part of the required documents at the K-1 Visa interview, do i need to get my wife to obtain one along side the affidavit of support? am still awaiting the interview date thou, as i was told could take up to 6-8weeks, please advice!

    No you don't need a marriage license for the interview. Depending on the state you plan on marrying in, both of you may need to be present to obtain one and they are not good indefinately. Here in North Carolina a marriage license is only good for 60 days from the date it's issued and we both need to be there to get it.

  18. Make sure when you are about to land you start chewing on a bubble gum so as to reduce the effect of that cabin pressure release on your ears. Gatwick is quite big but trust me you have no cause to be nervous the have very nice people working at the airport who are always ready to help. Take care and have a safe flight. :thumbs:

    Am really impressed with the way you guys have your backs as said,the power of information is great.

    My K-1 petition was approved last October 2007, i had the 3rd package which informed ne to get couple of documents ready and went for my Medical screening.

    I had all that completed and submitted ny final slip for the interview back in February 2008, i called the US embassy in london to confirm if this slip was received and how long will it take to have the interview done, i was told it takes up to 6-8weeks, i need to confirm from you guys if anyone has experienced this sort of long period before. i have been on the process for 11 months now, does it usually take that long? pls i need to you guys advice. thanks :thumbs:
