This is a non-issue at this time.  In future forms, tell the truth.  You know you have a middle name and you know the proper spelling is the one on your birth certificate.  Be truthful and accurate.  Answer the actual questions asked.  When asked for your name, give your full name.  The question does not ask for the name on your passport or the name on your driver license.  It asks for your NAME.  You know your name.

lol I have no reason to lie. On everything that doesn’t require my middle name I use my first and last. I have a long name so it’s just easier. I only have it on the documents where they told me “oh we have to add your name like it is on the birth certificate”

otherwise I never think about it. Thank you for your reply and it’s weird to think someone would lie about that. I work for the government and wouldn’t intentionally try to mislead them…they have all of my info

  2. Hello, I recently filed the I-130 and just put my first and last name as it is all that’s on my passport. I received an RFIE for proof of US Citizenship which I provided my passport already but was not sure if it was a bad scan or got lost so I uploaded it again as well as my birth certificate which I realized has my middle name. Then I realized my marriage license does as well. On the application I just didn’t put anything. Is this something I need to submit unsolicited evidence for? Can we be denied for me not writing my middle name? Also, my middle

named is misspelled on my drivers license and marriage license because it has to match my drivers license that I originally obtained with my short birth certificate that had the typo, long form is correct. I can send in proof of everything or should I wait?

Why is his birth certificate take that long? , it is easy to get and you get it same day at the Oficialia in DR. all you need is a pdf form and print , you dont need original to send with the i-485. Some family member can get the birth certificate and scan and send it to you by email or whassapp

I was told it had to be the original but if I can just get it sent to me that actually would solve this all. Thank you!

Are you adjusting status or are you going through the consulate?
The consulate is more forgiving with past income and present income but generally USCIS is more strict.

If going through consulate you should be fine. If adjusting status, I would prepare for an RFE for joint sponsor.

Yes I am going through USCIS for the AOS. Thank you so much for your reply! Good to know that worse case it’s an RFE and not just a denial

While his I-94 is unexpired he has lawful status. The second the I-94 expires he moves to unlawful presence and is deportable, but once you file I-485 (in your case it would be concurrent filing of I-130 and I-485) and the filing has been accepted by USCIS he moves to being in a period of authorized stay and unlawful presence is no longer accrued. The I-797 is his proof of authorized stay at that point. Since he's in an immigration gray zone at that point he needs Advance Parole to be able to leave and reenter the US at that point until AOS is approved.

Note that you will face questions at the interview about adjusting from B2 since it is illegal to enter on B2 with the intention to AOS.

    Thank you so much!

Your "current income" is how you qualify.  For the "employed" current income does not come from a tax return.  In that section state your current income from your job.  Calculate it as your gross for a pay period, times the number of pay periods in a full year, ie: every two weeks is 26.  Document the current income with a copy of that same pay stub.

You will get a case not saying your income doesn't qualify and you MAY want to use a joint sponsor, BUT "the Consular Officer will decide...."

    Just ignore that message.

    Thank you so much!

  7. Hi! My husband came on a B2 visa. It expires in April and while we are trying to get everything filed before his stay expires in April we are having difficulty with getting his birth certificate so it might take longer than we hoped. My question is after his stay expires can we still file the AOS? If so, is he no longer subject to being deported once the application is received or since it was after his overstay will he be at risk until it is approved or denied? I am a US Citizen by birth. Thank you in advance!

  8. Hello! I am currently starting the AOS and Spousal Visa for my Husband. We had a baby last year and I was considered high risk so I was off of work on maternity leave for almost a year. While I have since returned, my 2023 taxes does not meet the requirement by almost $900. I have a 401K and I do make my rate from my 2022 taxes now. Will this be an issue? Or if I provide my previous year and pay stubs or VOE letter will that suffice? And if they declare I do NOT meet the income requirements do I we get a chance to add a joint sponsor or is it just denied?
