    Yes, i meant beneficiary.

    Because, officially, the customs and border patrol do not want you to visit under tourist visa after you have applied for a K-1 visa. 

    What the lawyer does know is people who have applied for a K-1 visa and have come to visit and been deported because according to the agent, that is not what a tourist visa is used for and to such an issue he has written some clients a note on letter head to use as a last resort to present as evidence of the ongoing petition and that the petitioner and beneficiary are following the law and the beneficiary will return home, and for some people this letter has helped but for others it does not. It ultimately depends on the agent. There is no hard/fast rule for what is allowed.

    It depends on how it was requested most of my vital records I was able to obtain through this site: https://www.vitalchek.com/v/ 
    Once state did not support this site and I was able to get it directly through them calling the county vital records office and they sent me the record. 
    All my records arrived to me within a week which should be the case as well for Illinois. Illinois does partner with vitalcheck to get an copy and it is fast and easy.

  3. I chose to go through a lawyer for my process and he advised me to be mindful of the amount of times the visitations occur in the United States. 
    My lawyer said they look at the overall amount of time visiting over a period of visits within a year. 
    As the original post alluded to, they will always assume someone is trying to circumvent the system.
    My lawyer also said he can provide a letter to help justify that we are proceeding according to law and the petitioner will return home but that even with this he has witnessed people get deported.

    It will always depend on the person at the port of entry and what they think is unreasonable.

    It depends on when your case lands on the person's desk, the time frame is usually quick, within 2 weeks.
    That is why they say after 2 weeks you can make an inquiry to get your case number. Although, sometimes this can take up to 4 weeks.

    However, there is a time line as well that they only ship out packets every 2 weeks.  So, If your packet landed on someone's desk the day after shipping you will probably be there for 4 or 6 weeks before they get shipped to the embassy - depending on how quickly and accurately you provide them with the information they need. Some of the delays at this stage will be dependent upon how quickly you fill everything out. 

    I fully understand you want to be on the next step. It will come.

    I used the system too look at people with a similar timeline as me and there are 2 other couples one 2 weeks ahead of my NOA2 and one a month ahead of my NOA2 
    In both cases it was a little under 4 weeks that both of their NOA2 was received by NVC.

    Hopefully they get to you next week; but this is a long weekend. "First weekend of summer" and many people take vacations.  So, I'd assume the 1st week of June and if they happen to get to it sooner, then great!

    IE: check the timelines before making an inquiry as of this writing they are looking at items they received on the 16th of April which means those of us who got their NOA2 in May are not yet be entered into their system:

    It can take up to six weeks for an approved petition from the U.S. Citizenship and Immigration Services (USCIS) to arrive at the National Visa Center (NVC). Once we receive it, we will enter your petition into the U.S. Department of State's database systems.

     

    For current processing times, please visit our website at https://nvc.state.gov/timeframes for English and https://nvc.state.gov/plazos for Spanish. If your approved petition was sent to NVC later than the listed processing times, you do not need to take any action.

     

    If your petition was approved before the dates NVC is working on, please send us a scanned copy of your I-797 or I-171 Notice of Action - Approval Notice.  You can attach it to an email and send it to nvcresearch@state.gov.

    It will show you are on step 2 of 12, but don't let that fool you.  Several steps are collecting documents and uploading them to the online site so if you start that part now, you'll be well ahead of the process and you will complete several steps really quickly.

     

    I am still waiting for NVC to pick up my packet (this should happen bout 30 days after your approval)
    Once you get the case number then you will proceed.  But the link above will give you some guidance to the supporting documents you might need. 

     

    Also, I am going through a lawyer and the firm sent me some additional questions that they need to fill out the application that include where my fiancee lived and worked and went to school since she was 16. 
    Also, they wanted to know dates of her travel to the US (this link should help you get information of any travel for the last five years: https://i94.cbp.dhs.gov/I94/#/home
    So, I'm going to assume you should be prepared to see these on the application.

     

    My understanding is NVC will collect everything and open a case and send everything to the embassy so an interview can be scheduled. 
    The wait for the interview at the embassy will depend on how busy the embassy.  This site has reviews about embassies that may help you understand what that part will be like.

    My NOA1 was 12.07.2023

    My RFE was a fast turn around.
    I received it 04.22.2024
    I sent the information back on 04.23.2024

    They acknowledged receipt on 04.24.2024

    Today I received my NOA2 in the mail and it was dated 04.30.2024

     

    I wish you luck with this process, I wish they were more transparent

    When did you receive an NOA1?  If that is what you received in February, then you probably will get a response within a month.
    If you received your NOA1 back in July 2023, and Jan was just an RFE - you should have already heard back and you should reach out to them and ask.

    I got mine approved on Tuesday 23.59. 

     

    So my update is:

     

    I-129F sent: 11.30.2023

    I-129F received: 12.01.2023

    I-129F noticed (NOA1): 12.05.2023

    I-129F approved: (NOA2): 04.16.2024

    Case Sent to NVC: 04.17.2024

     


    I apologize, I thought it was a dream they were already processing our visa's and was dismayed by my RFE
    I forgot to take the time to congratulate you all!!

    They are merely requesting we send another document.
    We sent the divorce papers, but not the certificate. They needed both. 
    So that is an easy request to answer!
