    We Received a letter scheduling my wives Citizenship interview June 20, 2012. Although we paid for the Biometrics the letter does not schedule Biometrics..

    Has anyone heard of soomeone bypassing the Biometrics?? She did the Biometrics about 2 yrs ago when she got her 10yr green card..

    Your biometrics is only good for 1 year. If your spouse had one last year (within 1 year), she's fine. If not, you can call USCIS and ask about service request regarding biometrics.

    I had my interview without having a biometrics, but after the interview, I was scheduled for a biometrics because my biometrics was expired before the oath ceremony.

    I would prefer not to do a 2009 tax amendment as we just want to get the N-400 filed and done with. Just making sure should the letter say that we were unaware that we were supposed to file married jointly or that I just didn't file because I had no income?

    I think it's safer for you to amend your 2009 tax return to the correct filling (married filling jointly). You don't want to complicate you N-400 application by filling your tax return incorrectly.

  3. I am finally getting around to applying for naturalization on the basis of having lived in the US continuously as a permanent resident for five years.

    (Did not leave the country for more than 6 months, only small 2-3 week trips)

    I was looking through the application form, it seems like the needed evidence is pretty straight forward:

    - Payment/cheque

    - Application

    - Photocopy of PR card

    - 2 identical colour photos

    - Form G-1145 e-notification

    Can the community confirm this is correct? Should I send along other information (like copies of my driver's license, my last three years' tax returns) or should it be okay the way it is? I don't want to be NTE'd but I also would prefer not to confuse the immigration official as well.

    For the interview, I am planning to bring

    - Your evidence of being a lawful permanent resident for 5 years is your Green Card.

    - Your evidence that you haven't been outside the U.S. for too long is your passport.

    - Your evidence that you have filed your income taxes is your past 3 years' worth of tax transcripts.

    When I applied for my N-400, I also included: IRS tax return transcripts for the past 3 years, copies of apartment lease, and checking and savings account.

    We are back!

    We are thinking of applying for Citizenship this month, the 3-year marriage based route. Scrolling through the guides and the forums, I've noticed some posters having difficulty with the 3-year process. Is it that much of a headache? Is it better to wait for the 5-year route?

    I also noticed some posters having difficulty because of their tax returns. Does USCIS scrutinize the returns more meticulously than they do for AOS and ROC? Or is it the same deal? Also, do we have to send in certified copies of the returns? We never have before. I was thinking to just send in transcripts for 2009, 2010, and then a regular photocopy of our signed return for 2011.

    Sorry for all the questions... Just seemed like others were having a lot of difficulty.

    I applied for N-400 with 3-year route and I didn't have any problems during the process.

    As far as tax return, I just sent IRS tax transcript for the past 3 years. I don't think it's necessary to send certified copies.

    I don't think USCIS scrutinize tax return more meticulously for N-400. As long as your tax returns show joint filling, you're going to be fine.

Yesterday i got a hold of an atty that is willing to work on my case with a payment plan. Im so thankful about it.. Now my question is.. Does my ex husband letters in the past asking me to marry him will help me prove that i entered the marriage in good faith?? And if there is anyone here who have the same situation lile me. Please let me know what happen after filing the papers?

    Any documentation that shows your 1st marriage was in good faith and documentation about abuse from your 1st husband, it will help with your case. Your attorney should know what to do. Make sure you have a really good attorney that knows and familiar with immigration cases like yours. If you have time, go to www.superlawyers.com

    You need to file the ROC as soon as possible. I don't know about USCIS rules about late filing. I just know that USCIS is very strict about filing ROC 90 days before your 2nd anniversary as a conditional resident. You don't want to complicate your case by missing deadline for ROC filing.

  6. hi everyone, my wife still has another year to go to send out her 751 roc package. however, we had just move to the apartment next to our old apartment but it is still the same address but different apartments.do we still have to fill out the ar-11 and the 865 form even if we still live at the same address but moved to the apartment next door. thanks everyone.

    Yes, you still need to notify USCIS about address change.

  7. Is it possible that they would use your biometrics from your last visit (i.e I-751) - I got mine done in April 2011.

    OR do they still mail you for a biometrics appointment for your N-400.

    Is there anyone on this forum who has gone straight from submitting their N-400 application to having an interview because they (USCIS) will be using your previous biometrics?

    I went straight to interview without biometrics, but after my interview was done, the USCIS officer told me that my biometrics will be expired before the oath ceremony, so he scheduled me for a biometrics.

    I was wondering if you guys can help me with my case. I filed to remove the conditions of the I-751 on early January and but did not receive a letter of extension for 1 year. However, I did receive a biometrics screening appointment in February and completed that.

    Has anyone else had this happen to them? Does anyone know any place to contact to try to clear this up and actually obtain a letter of extension? Thank you so much!!

    Did you receive an NOA1 letter for your I-751? If you do, that's your extension for your PR.

    I checked that document and my concern was that do I need to send all the supporting documents I sent to remove the conditions on CR-1 almost year and half ago again?

    In my opinion, you don't have to send the ROC supporting documents unless the supporting documents are the same. I just followed the instructions on USCIS and everything was fine for me.

    I am concerned about what supporting evidence to send...I am sending...

    Mandatory Items:

    1. Form N-400

    2. Two 2X2 Color photographs

    3. Check for $680.

    Supporting Items:

    1. Copy of tax returns for 2008, 2009, 2010 (haven't filed 2011 yet....)

    2. Copy of IRS tax transcripts for 2009, 2010 (don't have 2008 transcript because during Removal of Conditions for green card, I only requested 2009 & 2010)

    3. Copy of marriage certificate

    4. Copy of apartment lease for past 1 and half years.

    5. Copy of Joint bank account summary

    Are these enough? Do I need to add more supporting documents like 401(k) Beneficiary, Credit card statments showing same address, Driver's License with same address.

    I have one more concern about tax returns. How do I get IRS to "certify" copies of tax returns that I am sending??? I know I can send IRS "Transcripts". But I am not sure about "IRS-Certified Tax Returns".

    Additional to what you just put, you also need to include:

    1. Copy of front and back of your PR card

    2. Copy of your spouse (US Citizen) birth certificate

    Go to this link: http://www.uscis.gov/files/article/attachments.pdf for complete details of what you need to include for your N-400.

    As far as IRS tax transcript, just include the IRS tax return transcripts.

  11. Grr I am finding myself to be extremely annoyed and frustrated today and I really hope you guys can help.

    I applied for my first social security card, before we were married in my maiden name. It arrived with no issues and had the expected "Valid for work only with DHS Authorisation" writing on it.

    We got married. I changed my name with the social security office and received my new social security card again with the expected "Valid for work only with DHS Authorisation" text.

    I get my green card, chill out for a few months and then decided I need to get that "Valid for work only with DHS Authorisation" text removed as per all the VJ forums.

    I go to the social security office, wait and wait and wait, speak to a guy who takes ages and finally tells me the details between the immigration systems and the social security systems don't match. He says this is typical and that it will just cause a slight delay but no issues.

    Today I get a letter in the mail stating I should get my new card within 2 weeks but it will be only Valid for work only with DHS Authorisation. Can anyone tell me where I go from here?

    You can try to go to the same or different SS office and say that you want the wording "Valid for work only with DHS Authorisation" to be removed from your SS card because you're a PR now.

    If I'm not mistaken your NOA1 letter should indicate that your PR is extended. I couldn't remember for how long, but it should be enough time until you're done with your ROC. Look at your NOA1 letter. For biometrics, it can take up to 30 days after your NOA1. If after 30 days, you still haven't received put, you can call USCIS and put a service request.

  13. And my sponsor never changed his address...I-865 is for the sponsor change of address. By the way, I took an appointment next week at the local Immigration office to make sure they got it in their database and that I'm not hiding or whatever

    As long as you have the receipt from USCIS about address change, you will be fine. I believe your spouse also needs to do the address change. That's what my spouse and I did when we moved.

    I just got done with my N-400 today and it was approved. The officer who interviewed me told me that I needed to wait for oath ceremony letter. After waiting for about 30 min, he came back and told me that my biometrics from last year will be expired before my oath ceremony (I didn't do biometrics for my N-400).

    He said that he will schedule me for fingerprinting before the oath ceremony. Is this normal?

    He also said that he already scheduled me for fingerprinting, but he didn't give me the letter for biometrics. Is this normal? Is the biometrics letter (after N-400 interview) usually delivered by mail instead of the same day after the interview? Is the oath ceremony letter also usually delivered by mail?

  15. It is possible that they will do your biometrics the day of the interview if they are done in the same facility, or they will arrange for the biometrics and make a decision afterwards. A third possibility is if you did biometrics for your Removal of Conditoins within the 15 month period before the scheduled interview date, then the biometrics you did for ROC would still be valid and they may be re-using those. Biometrics are valid for 15 months generally. I have heard of this happening for others, although it isn't common.

    I actually did my biometrics for my ROC about 12-13 months ago.

    I applied for N-400 early Nov'11. My NOA receipt date is Nov 14. I placed a service request for my biometrics appointment on Dec 15, but I still haven't heard anything back from USCIS about my biometrics appointment. Few days ago, I checked the case status of my N-400 from USCIS.com and it said that my N-400 was placed in line for interview scheduling.

    Is it normal that I never receive my biometrics appointment, but already in line for N-400 interview scheduling?

    I called USCIS today and was told that I needed to call back next week to put a service request regarding my biometrics. Do I need to do that?

    I'm in the process of completing N-400. I have few questions I'd like to ask:

    1.) I don't have a middle name. Do I need to write "None" or just leave it blank?

    2.) I didn't spend time outside the US for the past 5 years and my wife and I don't have child yet, so I put "0" for questions 7a and b and 9a. For question 7c (about the list of the trips outside the US) and 9b (information about child/children), can I just leave it blank or write "None"?

  18. If she divorce and are in divorce proceeding when applying to remove the condition on her permanent resident she would have to apply for a waiver. If both spouse jointly signed the I-751, Petition to Remove the Conditions of Residence knowingly that they are going through a divorce or already divorce then they may committed fraud and/or misrepresentation which will trigger a bar for the Alien spouse and removal from the United States and also a big fine the U.S Citizen spouse. When she apply for her N-400 she will have to state on the form the date of the divorce and sent a copy of the divorce decree and they will know that a fraud and/or misrepresentation act have been committed.

    Read this;

    Remove Conditions on Permanent Residence Based on Marriage

    If You Are No Longer Married To Your Spouse or if You Have Been Battered or Abused by Your Spouse

    f you are no longer married to your spouse, or if you have been battered or abused by your spouse, you can apply to waive the joint filing requirement. In such cases, you may apply to remove the conditions on your permanent residence any time after you become a conditional resident, but before you are removed from the country.

    If You Are In Divorce Proceedings But Are Not Yet Divorced

    If you are still married, but legally separated and/or in pending divorce or annulment proceedings, and:

    * You filed a waiver request. We will issue a request for evidence (RFE) specifically asking for a copy of the final divorce decree or annulment (if applicable).

    * You filed a Form I-751 petition jointly. We will issue a request for evidence (RFE) specifically asking for a copy of the final divorce decree or annulment and a statement that you would like to have your joint filing petition treated as a waiver.

    Upon receipt of the final divorce decree or annulment within the specified time period, we will amend the petition, to indicate that eligibility has been established for a waiver of the joint filing requirement based on the termination of the marriage.

    How to Get a Waiver of the Requirement to File a Joint Petition

    If you are unable to apply with your spouse to remove the conditions on your residence, you may request a waiver of the joint filing requirement. You may request consideration of more than one waiver provision at a time.

    You may request a waiver of the joint petitioning requirements if:

    * Your deportation or removal would result in extreme hardship

    * You entered into your marriage in good faith, and not to evade immigration laws, but the marriage ended by annulment or divorce, and you were not at fault in failing to file a timely petition

    * You entered into your marriage in good faith, and not to evade immigration laws, but during the marriage you or your child were battered by, or subjected to extreme cruelty committed by your U.S. citizen or permanent resident spouse, and you were not at fault in failing to file a joint petition

    Note: Refer to Form I-751 for more specific information on waivers

    When she filed for ROC, the divorce was already finalized, so she filed it by herself (without joint petition) and requested a waiver.

  19. Hi,

    I'm trying to help out a friend with N-400.

    She is a permanent resident and her ROC was approved about 5 years ago. Her ex husband divorced her before ROC, so when she applied for ROC about 5-6 years ago, she was already in divorce status.

    Now, she was thinking to apply for N-400. Is it gonna be a problem for her since she got divorce before her ROC?
