  1. This forum has been very helpful to me & my wife . I wanted to thank everyone who shared their views and by reading the posting we were able to get a good sense of things.

    Our interview date was on August 5th at 9 am .

    I showed my US passport and they allowed me to enter the consulate along with my wife. There was initial screening, in that they asked questions :

    1. Date of marriage

    2. Current residence

    3. When do you plan to relocate to USA

    4. Why were you refused visa in the past (my had previous visa rejections / tourist visa)

    5. Did you know your husband before marriage and how ?

    6. Are you related to him before marriage (via relations)

    We were asked to pay fees and wait for our turn for interview. After waiting for almost 4 hrs, we were called at the interview window.

    The interview was very casual, they asked my wife the same above questions. Upon which we were told that K3 visa has been granted to her. We asked the officer if we could collect the passport the next day, then they told us to contact VFS.

    Collected passport from VFS the next day by showing the interview letter and VFS receipt. They allow collection between 4 and 5 pm . We called them around 3 pm to confirm that our passport is ready for collection.

    Received the passport and brown envlope (which we need to hand over at POE)

    Since I was stand next to my wife, she felt very relaxed. I must admit, I was more tense than her. The officer was happy to note that I was with her during interview. i.e. US citizen along with the spouse.

    From my experience, here is what I could infer :

    If you file I-130 and I-129F then USCIS assumes or believes that you are interested only in I-129F and NOT in I-130.

    Irrespective of I-130 approval being along with or ahead of I-129F, USCIS does not forward the I-130 to NVC (Even though it is stated in your NOA2 that the I-130 has been forwarded to NVC)

    I didn’t get my 130 case number yet from NVC so I believe that it was held back at USCIS.

    It may appear that I-130 and I129F are two different tracks but in reality if you have filed I-129F then you should not assume that you have 2 horses in the race.

    I called USCIS on friday late evening and they told me that if I wanted then I could always file I-824. Thats confusing! I feel it is useless to call USCIS. I-130 approval notice did not mention about the I-824, so I am little hesitant to file the I-824.

    The exact wording on the I-130 approval notice is

    ------------------------------------------------------------------

    "the above petition has been approved. We have sent the original visa petition to the department of state national visa center(NVC) , 32 Rochester ave, portsmouth, NH 03801-2909. NVC processes all approved immigrant visa petitions that need consular action. It also determines which consular post is the appropriate consulate to complete visa processing.

    The NVC will contact the person for whom you are petioning(beneficiary) concerning further immigrant visa processing steps.

    If you have any questions about visa issuance. pls. contact NVC directly. However, pls allow atleast 90 days before calling the NVC if your beneficiary has not recevied correspondance from the NVC. The telephone number of the NVC is (603) 334 0700. "

    I keep pinging NVC but they keep telling me that they donot have my file number.

    So for now I guess either my file is sitting at USCIS for I-129F or waiting at NVC for case number to be assigned

  5. Our I-130 was approved on March 17th 2008. I received notice of action from USCIS stating that petition has been sent to NVC. When I call the Interactive voice response phone# of NVC I am not able to get the NVC case number

    I-129F, we had a RFE for which we has responded and the website says "processing resumed"

    In this context I would like to ask 4 questions.

    1. When will I get the NVC case number for I-130 petition (how many days of waiting period?)...any statistics to guide us ?

    2. Should I file a I-824 for further processing of our I-130, ( it is not indicated in our approval notice that I have to file I-824)?

    3. As our I-129F has not been approved yet, is NVC withholding our I-130 processing for I-129F approval?

    4. How both petitions will be processed at NVC ie., is the processing parallel and independent or one is dependant on the other?

    Your answers to these questions will be of great help to us as we are anxiously waiting for our processing to be complete

    My confusion is that .... is NVC waiting for I-129 ? .... it is my understanding that I-130 is totally independent of I-129F .... am I wrong ?

  8. I received the I-130 approval notice on 03/25 and in that they clearly stated that it was fwded to NVC

    When I call the automated response and enter the WAC number ... this case could not be found.

    Spoke to operator almost every 4th day, and I have been told to wait for another week.

    One thing to note is that I do have I-129F (K3) still pending. There was a RFE on I-129, which I have already responded and waiting for approval

    It is my understanding the I-130 and I-192F are two saperate paths, my expectation is that I-130 approval would have reached NVC by now and I am assigned a case #

    I am little lost here ...pls. advice on the next steps I could take

  9. I just checked my I-130 forms(which I had originally submitted to USCIS), in that I had mentioned consulate to be Chennai, India

    Later, as I researched more on VJ, I found that I am eligible for Montreal as my wife lives in Windsor, Canada.

    Now the question is :

    At the time when case number is generated, will NVC look at the address of the spouce(which happens to be Windsor,Canada) and then assign a case # which starts with MTL ?

    the reason why I am getting little anxious is because I plan to james short cuts and the first THREE letters in the case indicates the consulate , thus the anxiety.

    yes, I am aware that K3 gets routed country where the marriage took place, but I was not sure if they route the I-130 to the country of current residence. thank you for that clarification.

    So , I can continue to process I-130 in parallel with the I-129F. i.e. both are independent and they both go on in parallel ......is that a fair statement?.

    Good News ... I-130 got approved on 03/17

    Bad News.... I-129F got a RFE 03/18

    This is very frustuating for me... especially after waiting for 8 months ... getting RFE on I-129F.

    my wife lives in Canada, she goes to school there.

    Marriage happened in India

    I am yet to see the I-129 RFE letter so I donot have enough details.

    could I continue to pursue I-130 ?.......

    Will the I-130 get routed to Montreal ? or will that be India ?

    Pls. advice on what should be my next steps ... I sincerely appreciate any suggestions.
