  1. My wife moved here in 2008 on a tourist visa. She has a retirement account with 55,000 soles ($18,000)in Lima with a private company. She also owns land in Chaclacayo which is west of Lima. Does she have to get a job here in the USA before she can transfer her money here? We want to put 5K/yr into her Vanguard Roth account after we get the money. We are not allowed to roll it over into this account. Does she have to have a job here in the USA

    before she can have the money transferred? Does this need to be a full time job? I dont really understand why we can have it transferred into

    a Roth account. Is it better to just leave the money invested in Peru until she reaches retirement age?

    And what about the land? Should she sell that or hold on to it? If she sells her land in Peru, how does she get that money here?

  2. She can try to get the visa. The consul will ask her for the purpose of the trip, who is paying, if she is married and has kids. By experience, the consul could deny her the visa due lack of strong ties (in my case they told me a year ago that I was young and without family and for that he denied me the visa). But she could be the lucky one and get the visa too. The only thing I can advise is that she must answer the question with the truth, and if she has been working in the same company for a long time, maybe she will have the chance to get the tourist visa.     She does have money in the bank, enough to pay for 4 tickets perhaps to the USA. But im the one who will be paying the airfare when she comes here. So get lost!!

    is a lot of money in Peru. Im amazed that they charge people that much money, then just deny the application.

It is quite common (actually, the norm) for tourist visas to be denied in consulates of countries that are viewed as "third world" and where there would be a high incentive for the "tourist" to overstay their visa and live and work in the US. Therefore, what will be most important will be for your sister-in-law to show strong ties to her country. This could be proved to the consul by showing titles of property or properties, title to business, job letter, bank accounts, etc. If your sister-in-law does not have these financial ties to her country, it might be likely that she would be denied. Think about it. She is young and without a husband or children (relationship ties) and if she does not have financial interests in Peru, then the consul might think that she has no reason to go back to her country. Therefore, she might be seen as a risk since it might be the case that she would overstay. Despite this, there is no harm in trying to get a visa. You and your wife can craft an invitation letter and send it to her. The consul might be convinced of your sister-in-law's good intentions.

    Sounds like you think that since she is single with no kids that she might find it hard to get the VISA? What do you think the odds are? We will still try regardless.

  6. My wife who came here from back in 2008 on a K3 VISA from Peru is pregnant. My sister in law (age 37 who has no kids and still lives with her mother) who resides in Peru wants to come visit her sister and new baby (after birth in October) on a tourist VISA. We are a little disturbed at the rate of tourist visa denials for Peruvians who want to come visit relatives. For example, we have a friend who just gave birth, and the grandmother was denied a tourist VISA to come visit. Does anyone know the rate of acceptance from Peru? Does anyone has a list of do's and dont's when it comes time for the interview for the person who is seeking the VISA? Is there anything this person can do to increase her chances of getting the tourist VISA. She is under the impression that its a given and we dont want to discourage her. But we are not optimistic. She is awaiting the extension of her work contract in Lima. Once she has that, she will apply for the VISA. Should she wait until her sister in the USA has her citizenship, or does that matter? Once an application is rejected, is there a greater chance it will be rejected the next time too? Anyway, I am just seeking some all-around advice about how to proceed. We don't want to waste the money unnecessarily but we want her to be able to visit.

  7. We are getting ready to send in form 751 since my wife needs to remove conditions from her green card. The deadline for her is in Mid June. However, we just changed residences (a move of about 1 mile within the same town) back on March 17--about 21 days ago. Before we moved I called USCIS and asked if we needed to submit AR-11 since we are getting ready to send in 751 with our new address anyway. The guy actually talked like a real person and not like a robot reading from a piece of paper. He said there is no need for us to submit the AR-11--that the 751 would suffice. Then a couple of weeks later, after talking to some other people I began to question it. So I called USCIS back and they told me that I did need to do AR-11. Then I got a third opinion from USCIS and they confirmed that I needed to send AR-11.

    But both of these women sounded like robots. They were just reading regulations from a piece of paper. But now that it has been well over 10 days, Im scared to submit the paperwork. I saw on the USCIS site that you can be fined or imprisoned for not reporting a move. So now Im not sure what to do. Im thinking about calling Holmes and Lolly--the company that helped us with the K1 process. Anyone have any advice? It irritated me that I got bad advice from USCIS the 1st time I called. Or did I?

  8. We traveled 2.5 hours two times to Wichita for biometrics. Now several months later we received a letter stating that the fingerprints are illegible for the 2nd time and that we need to send additional documentation before July 11. We need to get a "Certification of good conduct".The letter says: "provide a letter issued by the local law enforcement agency (County sherrifs office or local police department) indicating the applicant had "no criminal record". The record should include all the aliases the applicant may have used in the past. A separate letter is required for each law enfocrcement district abroad(if applicable) and in the United States in which the applicant has resided during the previous 5 years.

    Exactly what do we need to do abroad? Does she need any letter from Peru? She already went to all the trouble to get judicial and criminal and Police certificates when she was applying for the K1 Visa. She still has photocopies of these.

    Why would she need those again?

  9. Well first of all, when there is no option to speak to a represenative, and you have to

    hit option 3 for change of address to actually speak to a human, then there is a problem.

    If they had told me in the letter why I had to go back to Wichita, then I wouldnt have

    to call them and take up their precious time. Got it? Good.

    Secondly, I have no intention of changing the time. Do I really want to waste several

    more months dealing with these people? I dont think so.

    I don't think that the people that work at USCIS are idiots. Everyone I have ever dealt with has been extremely friendly and helpful.

    Remember that when you call the 1-800 number you are not dealing with employees that have any access to your case nor authorization to do anything about it.

    The are all just doing the job they were employed to do. If they had someone available for everyone that wanted to call then there wouldn't be anyone left to process your cases.

    So back to your question, if you notice on the bottom of your biometrics letter there is a change appointment check box and an address to mail the notice back to them in the event that you want the appointment changed. "Request for Rescheduling" - you can't miss it, it takes up almost half the page.

    What is infopass??? Hopefully the Wichita office allows walk-ins. I finally got to talk to a representative by hitting option 3 for changing my address even through I am not changing my address. Does this make any sense at all? These people working for USCIS are truly incompetent. I asked them why they dont have an option to speak to a representative and they didnt have a good explanation. They told me that they have received complaints about this but nothing has been done. I work for DOC - National Weather Service. I feel fortunate to work for one of the more competent government agencies. Of course there are a lot of true idiot beaurocrats working in NWS management as well.

    cause problems since I heard she wasnt even supposed to have one yet?

    What documents are required at biometrics? The NOA mentions passport, drivers

    license, national ID, or state issued photo ID. Maybe she can use her national ID from

    Peru and that would be all she needs? She also has a learners permit.

    Hi!

    What's up with your timeline for AOS? David and I filed in early August for AOS/AP/EAD, had biometrics 9/4/08. Our case was transfered to CA 9/11/08, I think.

    We received AP today. We're still waiting for EAD! The file was touched more recently for AOS than for EAD, which makes no logical sense...

  15. We applied for AOS and work authorization and just received NOA for both along

    with biometrics. How long do we need to wait for work auth and green card?

    Also, I assume that visa is all we need for the biometrics? She has social

    security card also--actually we were told she wasnt supposed to have one

    yet. But they didnt say anything when we went to the soc sec office.

    Will the K1 visa that expired in September be all she needs to get her

    biometrics?

  16. My wife arrived here on K1 visa in April and we still havent applied for AOS. 5 trips to

    peru and a wedding completely drained me. I think you have 2 years to get AOS.

    Im not even sure there is a deadline. But we want to apply soon so we can work.

    hi. i havent been posting for quite some time. i actually havent been able to do much a few days after arriving in the us. i met accident and i now have two fractures and a dislocation. i need surgery so im still in a temporary splint because i cannot have my operation until my husband's insurance at work kicks in two weeks. otherwise, we'd have to pay 13K for the surgery alone. anyway, we still have the exorbitant hospital bill to take care off - the ER, ambulance ride, doctor's fee, etc. which isn't covered by insurance. this really bites. im typing real slow with my left hand right now since my right arm is immobilized. and im right handed! heheh. i will be having a permanent implant and 2 metal plates. now i can call myself a bionic woman. heheh. what i'm really amazed at is how efficient the system is in here. a few minutes after the accident, police cruisers, a fire truck and an ambulance were already at the scene.

    my question is, can we postpone applying for AOS? the hospital bill is weighing us down since it wont be covered by the insurance. how long can we put it off? should we contact USCIS and tell them about the accident?

  17. Well, I dont see anything that says "NOA1" or "NOA2". The approval letter we got from the national visa

    center--is this the NOA1? I also got a notice of action I-797C. But nowhere do I see any "noa1" or noa2"

    I realize that the A-number is the alien registration number. I see an 8 digit number on her visa

    that starts with 9. Is this it?

    I assume the A-number is the same as the number on the bottom of a K-1 visa?

    Starts with "A" (also on your NOA2 - sometimes on the NOA1) - Alien Registration Number. :thumbs:

    0 for my spouse. Apparently this is a generic form for any person and not just for sponsoring

    a spouse.

    What are you trying to accomplish with the form (for AOS?) ? I'm not sure you're on the right direction here. :thumbs:

  20. From the responses it sounds like I dont really have to apply for a green card for her right away. The I-94 expired in July and the K1 expires in late September. Ill just wait until I get the funds. And no, Im not low income. But a wedding and several trips to another country are not cheap.

    We got K1 in March and married in May. It is August and we havent filed for AOS yet. Bottom line is

    that I am just not financially able to file right now. Is there a deadline for getting AOS? If I wait until

    Sept/Oct before filing is that ok?

    I thought you have to apply before your K1 expires...... if you dont have enough income you can ask somebody to sponsor your case. check the I-864 instructions.

    At the same time K1s no need file before K1 expires!

    Once in the US, a K1 visa's expiration date is meaningless. If a K1 visa actually expires, it means there was no entry at all. K1 visas are dead on US arrival. The 90 days of legal status is derived from the I-94. That's the expiration date to be concerned with.

    For a K3 visa the I-94 expires in two years and the visa lives on for use in multiple US entries.
