  1. I sent off the AOS packet for my wife on 01/20/2010. Her interview date had been scheduled to be on 04/16/2010. Everything was going smoothly until just recently. Here is a little background...

    I have been unemployed for the past 3 months. I just found work and had to move to a different state. I made the move a couple of weeks ago. I did the change of address by calling USCIS and mailing the AR-11 (the interview date had been scheduled before address change). After arriving to the new job I was contacted by an employer that I had spoken with sometime back and they asked me if I would like a job back in the same area I originated from. I didn't even have to think twice before deciding I would go back and take this job. For now I have not made the move back but will be doing so next week. I will have to do a change address again and haven't thought it would be a problem until I received a NOA from USCIS today stating my wife has had her interview schedule date cancelled due to unforeseen circumstances. My thoughts on the situation are as follows...

    1. USCIS cancelled the interview due to the first address change and will most likely reschedule to the local office in the area of the first address change or

    2. Has been cancelled due to reasons that neither myself nor the USCIS customer service rep I called can answer. (There may be some explanation notice later????) or

    3. No Clue???????????????????????

    Anyone have any ideas on what this could mean???????

  2. hi everyone,

    we just got our nao2 yesterday... wondering about scenarios for scheduling the interview.

    obviously too early to get any info from the embassy in mongolia, but scouting on their site i looked at interview procedures and found a calendar of available interview dates for non-imigrant visas. looks like they're available starting next week!

    now, if that's accurate - do the embassies have to do any work on the visas prior to the interview (such as background checks, or verification of info on the app, etc) that would require processing time on their part - or do they look at it for the first time when she comes to the interview, armed with all the additional documentation she needs to bring (including the medical)?

    just curious what other's experiences have been - wondering if we have all of our paperwork ready to go (and we nearly do) - would you guess it may be possible to schedule an interview date fairly soon after they receive the application?

    The embassy in Ulaanbaatar was very easy to work with. I could call them anytime and they were helpful with answering any questions. If you have your noa2 then I am assuming your fiance has visited SOS medica for her medical, has all the proper papers and evidence ready to go? Once your case has left NVC the consulate should receive it shortly. I was able to make arrangements with the embassy there so that they would give my wife a call when her case arrived. It was then that I was able to schedule an appointment with them over the phone for an interview a couple of days later. Remember to get the visa fees paid at the bank and if she didn't get a police certificate get that also. Hope that helps!

    My wife just received her K3 visa in Mongolia back in April, 08. She had to get police clearance from the local police in Ulaanbaatar. We actually went to the embassy and they instructed us to do this.

  4. Yes, only if you get interviewed for AOS would you possibly get originals back, however many adjusting from K-Visa do not get interviewed, just approved by CSC.

    To get originals back you need to file: G-884 http://www.uscis.gov/portal/site/uscis/men...00045f3d6a1RCRD

    Thank you for the reply. Don't we need to have the originals back to submit with AOS paperwork or at least copies of those originals?

  5. I have a question for anybody that has come through a point of entry with a K3/K4 visa. My wife and stepson recently entered through SFO on K3/K4 visas. We handed the immigration officer the brown packet that the embassy gave to us when they received their visas. After the process I asked the officer if he was going to give us our original documents back that were in the envelope. He told us we could get them back from our local field office and I took his word. This was obviously the wrong answer as I have since found out. The field office has now told us that we would have to file a form to get original docs back. I would like to know if anyone has had the same problem. We are currently needing to file adjustment of status but need our original docs back. Any feedback would be appreciated. Thanks!

  6. My wife and 13 year old step-son were interviewed today at the US embassy in Ulaanbaatar, Mongolia and were approved. They were scheduled to interview at 1:30. My wife was fingerprinted immediately upon arrival and then had to wait about 5 minutes before being called to the interview window. The questions were all the typical ones you can find on VJ in the K3 guide section. The CO then asked for some pictures, looked at a few and had some questions about them. The interview took about 10 minutes. My step-son was then asked to the window and was asked a couple of basic questions. They called my wife to the window once again for one final finger print. She returned from the window with a big smile and I knew our dream had finally come true. We'll pick up their passports/visas from the embassy next Tuesday.

  7. I am a bit confused about the next steps with my case. Both the I130 and I129 petitions were approved for my wife and stepson on March 17, 2008. I have been told by my lawyer now that since the I130 was approved at the same time as the I129 the K3 is not an option. He said the bottom line is, my wife and stepson will need to process for an immigrant visa. The State Department will not issue a K-3 visa if they also have an approved I-130 petition. Is all of this true?

    He also told me that the process with the NVC takes several months at a minimum. Once the NVC is finished, they transmit the file to the consulate that will be processing the immigrant visas. Then there is another – usually long – delay before the immigrant visa interview. He is telling most of his clients waiting for immigrant visas to plan on a delay of 9-12 months between approval of the I130 and the immigrant visa interview. At some consulates, the delay is considerably longer these days.

    If all of this is true then why approval of the I129?
