  1. so my husband and i went monday to Frankfort to file our I130 petition. i was excited and nervous and we had all we needed by the checklist given to me by Frankfort . we waited about one hour and were called. we had a older gentlemen who i might add was not so friendly. He looked things over and told me he could not accept it because my husbands photo he had a few hairs cut off the top of the pic.. and then he said they needed a special copy of his daughters birth paper . we had the german version and the english translated but he said that wasnt enough:( so he sent us downstairs and had us file the DS230 part one . we went down the lady took it put some info. in the computer and gave us some information on what we need for the interview later ect. and the I864 ect. i was so sad and disappointed because we drove there to file thinking it would be faster to file in person and then were sent home to do what we have too and then mail it in or drive it back. so we didnt even get to pay there or anything. then we drove the 3 and half hours home and both of us were down.

    so we are now doing new photos for him and getting a special paper for his daughters birth paper. The man wasnt so nice either, he made us feel dumb and was alittle bitchy. and there is a 6 month rule in frankfort too however although i am not at the 6 month mark if he didnt need anything extra he would have taken it. he did tell us to come back when we had it straightend out.

    so my questions are .. does anyone know why they would have taken DS230 part 1 for my spo9use and stepdaughter without them taking our I130?? and later when we submit the I130 or try too lol, what will happen with the DS230 part 1 ? will they have that in the computer or something ?

    I honestly have no idea as to why they would take the DS-230 part 1... Usually they are supposed to accept the I-130 and G-325A biographical information forms from you and your hubby. After that is received, then you can receive (usually the same day) the DS-230 and the I-864 Affidavit of Support. I would call the Frankfurt Consulate and ask them. If not, personally return back to Frankfurt when you have the information they requested. Try to remember the guy's name you worked with last time in Frankfurt and see what can be done. That entire process is strangely out of order.

    Do you mean the 6 month mark for being able to file your petition as a resident in Germany? They are very strict with this policy. You must have lived in Germany for 6 months and have a residency permit. My spouse and I initially tried to file there, but I obviously did not meet the requirements for residency.

    I hope you can find a resolution to your case... either way, you are much luckier to be filing in Frankfurt rather than a service center in the USA.

    yes i mean the 6 month mark. there is never any clarity with that! lol i think i have read numerous people asking and cant seem to find that information on the website. they dont say that on there! i do have a resident permit , i have been in germany since feb. 11 on the computer system at the burgerburo however the consulate doesnt seem to care about that date. they go by the date in your resident permit. and naturally mine was delayed because the woman working on ours was sick for 3 weeks. so mine is dated march 25th. so that is the date they go by. and i am flying home to america on sept. 28th! so i am going to have to fast file before i fly. When i was there trying to file the man said he didnt think i could file at that time but yet would have taken the papers if i had all happy for him. when he told us what we still needed to get he then said ok now go downstairs and file your ds230 part one . so we did. and that lady typed info into the computer and then handed us our medical papers for where to go and the I864 and went over all with us and then we left. lol. and she gave us a case number too on the paper. but we are going to head back and see if we can speak to the same man soon.

    hahah oops lol i posted a topic called nightmare under the DCF board. we went last monday to file our I130 . i was so down after leaving. if you have time maybe you could go read it and answer a question i had. no one has answered but maybe they just dont know the answer lol . thanks

  4. wahoo i finally have everything i need to file the petition for my spouse and stepdaughter. i was going to mail in the petition but have since decided to drive it to frankfort. i have made my infopass appt. for monday at 10:15. I was interested to hear from anyone who has filed the petition in person to share there experiences as far as what i should expect ect. i will be filing in frankfort germany.

  5. i was curious , on the frankfort embassy website it says when mailing in your petition they dont accept personal checks, they do however accept money orders and international bank checks. does anyone know if german banks have this feature? lol i dont have a credit card and either does my german spouse. i was wondering what would be the best place to go to have the money into a check form that they will accept.. any ideas? thanks

Just a comment about the 6 month residency requirement for DCF when I was preparing to file my I-130 I didn't see anything on the Sydney Consulate's website about a residency requirement however when we contacted them to make our appointment they forwarded us two documents - one of which is titled I-130 Petitioner Residency Requirements and states-

    Under the revised procedures for filing petitions outside of the U.S., embassies and consulates may resume accepting I-130 petitions from American citizen petitioners who have maintained continuous residency in the consular district a minimum of the preceding six months. Petitioners must be able to show that they have permission to reside in the consular district and that they have been doing so for at least six months before filing the petition.

    Best to confirm with the Frankfurt consulate I think. Good luck!

    i sent them an email asking about the 6 month rule.. and the first time i wrote that they sent me a link to there instructions for the I130 petition and all it said was you must have a resident permit which really didnt anwser my question lol. so i just wrote again we will see what they say this time. ugh lol

  7. Well, my fiancé and I weren't originally planning on going this route, but things aren't working out with his student visa. I've read/heard from other VJ'rs that Frankfurt doesn't require 6 months residency in Germany to do DCF there, just a resident permit. Has anyone done this more recently and can verify this? The last post I saw verifying this is from August 07. I know that getting a resident card in Germany is pretty simple as a spouse and have checked into that already.

    A couple more general questions regarding DCF:

    Assuming we file in person, do I need to be present in Germany after the original filing? Or could I fly back to the USA?

    My fiancé has no criminal record, does he still need to get a police certificate?

    When do we file an AOS - the guide for DCF isn't clear to me, but the K3 stuff says it's at the spousal interview. Is that the case? I have to get a joint sponsor, so it'd be good to know I have a little time to get that.

    I could really use some good news today. Bad bad day hearing this student visa isn't working. The prospect of even more months apart just sucks so much.

    Hey.... I did DCF in Frankfurt (me German, wife American) and i decided not to ask about the 6 months rule and my wife would not have fulfilled that requirement, but their website didn't say anything, so ...

    Everything went well for me, but that was about a year ago. The following post: http://www.visajourney.com/forums/index.ph...t&p=1182840 says that the 6 month rule now applies. (posted after I made it through) so... that is all the info I have... you can either just risk it, try to get an official answer from somebody in Frankfurt or go a different route... those are the options :)

    i am getting ready to mail my I130 on friday for DCF for my german husband. I have lived here since february.. i have seen nothing that states on the embassy that you must be here 6 months. i hear that but i have seen nothing on the website stating that and i think they would have too. all it says in big black bold letters is you must have a resident permit. so i will let you know if they end up sending it back to me.. i havent been here quite 6 months. almost! so i will let you know.

  8. does anyone know if you can just take the first page of the divorce and copy it or do you have to copy the whole entire thing .. i have a divorce paper that is like 20 pages long lol. i dont know if immigration just needs to see the filing stamp and the front page that says our names and divorce decree? or must i do the entire 20 pages of the divorce?

  9. Owning a home is a huge help. The main sponsor (you) or the joint sponsor (your dad) can show assets to prove ability to support the immigrant. The different is that you would only have to show three times the necessary income and your dad would have to show five times the necessary income. The joint sponsor can be any USC domiciled in the US - so your dad can be the joint sponsor.

    If it is just you and your husband, and the equity in your home is more than $52,500 USD, then you do not actually need a joint sponsor. You need to show proof of the equity with a recent home evaluation (as in, would need to set up a new one now) and either proof that you own the home outright or proof that the difference between the value of the home and the remaining mortgage is sufficient. If the equity in your home isn't as much as $52,500 or is really cutting it close, I would have your dad fill out the I-864 as the joint sponsor.

    As joint sponsor, your dad needs to show enough assets to support himself, his wife if he has one, any dependents, and the immigrant. If he is unmarried and has no dependents, then he would need to show assets of $87,500 USD. Assets need to be able to be made into cash within one year. Savings, checking accounts, and equity in a home are all good ones.

    ok so.. my father has assets estimated at half a million dollars. but he has no income as he is retired. so he could just use his assets without having an income right? and for me my house is estimated worth of 80 thousand if i sold it. however i owe the bank 50 thousand still. so they would have to use the 30 thousand because that is what i have after i sold it correct? and i have a stepchild i will also be getting a visa for.. so the total of dependents would be Me, hubby, stepdaughter and i have two children too. so a total of 5 people.

  10. i was wondering if anyone had experience with DCF personally filing at the embassy VS. mailing it in to the embassy? I will be filing DCF in Frankfort germany. I dont know if it would be wiser to bring the I130 in person and file it or if it is ok to send it to the embassy registered mail? i would like to save any time of course of bringing this whole ordeal faster.. but i dont know if mailing it or going there is so different for time? frankfort is about 300 miles from me here but its worth it if it takes alot of time off the visa wait.

    i am the usc and my husband is german. I am currently living here with him in Germany and we are sending in our I130 on tuesday .. We are doing DCF.

    i was looking over the I864 and am getting nervous.. I currently do not work. I have been living in germany for 7 months and havent worked here. I did file taxes last year and had an income but not enough to meet the requirements for this form. and now obviously i am not working until i get back to the states . I do have 3 years of taxes to show but two of the years was with my ex husband with his income so i think i cant use that???

    and my dad is retired but has alot of property assets.. he is willing to use his assets to help me but can he? after reading this all with co sponsers . i heard the only assets you can use is the petitioners assets and only family members who reside with you .. so i cant use my dad then right with his assets?? i own a home .. maybe that will help? i am scared i wont be able to show enough for this poverty level thing. can someone clear this all up for me?

  12. i am getting ready to submit my I130 for my husband to frankfort embassy. I want to make sure i have all the papers correct! was wondering if someone could help me?

    I am also petitoning for my stepdaughter. she is 6 years old. I was told i must submit for her a seperate I130. soooo i did that and i will be submitting both together since they are for my husband and his daughter. what i am wondering is do i have to fill out a G325a for me to put in with my daughters petition? it says i dont need to fill out one for a child but i was curious as to if i must still do the G325a for myself but not her and send it in with hers? sorry its so confusing of a question but as we all know this whole immigration is a bundle of nerves lol.

Yes, US Citizen step parent can file I-130 as long as marriage that created the step parent relationship happened before the step-son's 18th birth day, and as long as the visa is issued before 21th birth day and as long as the step-son is unmarried at the time the visa is issued this will work.

    Are you saying that no consent form of other parent is required to be filed or shown to US authorities?

    i am saying what the embassy told me when i wrote. I think its different for situations whether the parents have joint custody or sole ect. and in each country it seems they have different laws. i will give you another example. my husband has flown to america to visit me in the past 4 times with his daughter and not once did he need anything to get a passport or anything from the biological mother of this child. and when he landed in philly they never questioned where this childs mother was or anything... he has sole and complete custody.. why should they need anything from the mother.. she has nothing left.

I know someone else said they changed the law last year and now all places require you live in the country for at least 6 months but when i go to the frankfort embassy it states nothing there. just says you must show a living permit.

    i emailed frankfort and got a reply but the reply was a link to there website! which i had already looked and saw nothing stating you must live in this country 6 months before you file. so i am unclear.. anyone know????

    then do you need the other parent's consent? (I am not sure how you would do it without that but...)

    Feel a lot has to do with what country that child is from and their regulations. For my wife's 13 year old daughter to come here, just for her to leave her parent country we needed a fingerprinted signed document with an apostille attached to it from the girl's biological father. He didn't want to sign it until we freed him from child support payments, then was happy to sign it. We had the document translated into English for the USCIS by a certified translator that was required. This single document was quite expensive, but we are talking about the welfare of a human life here.

    She is over 18 now and free to do whatever she pleases with her life, not only here, but also in her home country. Ha, she wants to stay here.

    Can only say our USCIS wants proof that a minor child is free to come here, whether that child can even leave her parent country, is up to that country.

    i am in that situation now. my stepdaughter is 6 years old and we have been worried the natural mother will have to sign because we know she wont.. My husband is german and has sole custody. the bio. mother in this case is a druggie and alcoholic and has limited supervised visitation. i emailed frankfort and asked if we would need her sign and they told me that as long as he has sole custody we wouldnt need a sign from the natural mother. but we must show a court paper stating he has sole custody.
