    first of all, thanks for all your help! VJ is a great resource for me when I need help!

    after 3 long years, my wife became U.S citizen after passed the u.s citizenship test. She sponsored her mother. now her mother arrived U.S two days ago. my question is, what is the next step for her to get Social Security Card or Green Card? all she got is a stamp in her passport from LA airport when she arrived.

  2. Dear all VJ friends,

    finally, my wife got a notice for her oath ceremony on Oct. 22. I'm happy for her. she will officially become U.S citizen. It's a very long journey for us.

    on behalf of my wife, me and my little doggy. we like to give all the thanks to all VJ members, who helped us from the beginning...

    to all those, whose cases still pending, processing, you gotta keep working and fighting for your love ones until she/he become U.S citizen (like my wife). the process is a pain in the a.s.s , but don't give up, alrite!

    for income tax returns, I double check it again, we filed income tax returns as "Separately" in 2006, 2007, but we filed it as "Married Joint together" in 2008 because we had a salon business and it gives us larger deduction.

    if my wife get approval for her citizenship, then it is cool, no problem. however, if a denial. I got more than enough money to hire good attorneys to take it to the court. (yep, I choose it a hard way) on my law suit, it will against the interview lady (not USCIS). this is not just for me, but for all other people, who came after me to have a such very hard and weird interview with her.

    the intense of my lawsuit will get her az.z fired for wasting everybody's time & money and replacing her with someone else more professionally and more understanding. I understand that she just doing her job and get paid for interview people, but this is really crazy and not acceptable. on my lawsuit also include all the money & expenses for business & every body working at our salon for any business-closing days.

    I know I got all evidence that prove my wife and I are a real couple, we work together, live together, home ultility bills and apartment Lease Contract show our address and our name, business is in her name but ultilities bills are in my names..we don't have our names together in bank account because I had bad credit (the bank refuse to open any account for me). Car insurance is also in our names. I even challenge the crazy lady to come to our salon check if we're working toghether and ask our clients if we're a couple or not....or even come to our apartment to check if we live together or not. ...what a mentally crazy lady.

    nope, not yet, we're still poor, i don't wanna my children running around naked without diapers because their mommy and daddy couldn't afford to buy diapers for them...maybe next year. :)

    did your wife wait 5 years before applying for citizenship? That's my impression from your post.

    In this case you should not have to prove that you still have a valid marriage.

    in my case, should I wait for a letter or should I go ahead and file a complaint or "Report USCIS Employee Misconduct" about this lady?

    because when you take test for U.S. citizenship, either you pass or fail or retake the test....how come they asked for more evidence. ..even though we brought all evidene into her office, but she still not satisfy?

    wait or report ? which one is better for me? if she is going to send a denial letter 4 weeks later, it would be too late to file a report, right? I never see any case like this before...I'm very mad now.

  6. hey guys., if my wife get denial letter for U.S citizenship, then I will file a law suit against the interview lady for telling false information or "Misconduct while on duty"

    because she told me that "why did I open an ultility account in Chicago this year?". I answered her that I been living in Texas for 5 years and didn't come back to Chicago. where did you get that information? can I have a copy of that?...she said "NO, I don't have it".

    she lied to me. which is telling false information!

    can I sue her for that? :oops:

    she asked me why did you file your income tax separately, but not together? It means she is totally doesn't understand tax law at all. I told her when you and your spouse filing income return as "Separately", it means you're responsible for your own tax and your spouse responsible for his/her own tax, but it doesn't mean you two live apart. I told her whichever way "together, or separately" give you more benefit, and the tax laws allow you to do it

    good to see you'all again.

    ok, here is the situation: my wife and I have moved from chicago to San Antonio (TExas) for 5 years now.

    It's so weird

    My wife went to take U.S citizenship test in San Antonio, TEXAS, and she passed the test, but they need more evidence to prove that we're living together. ...strange right?

    4 weeks later, they sent us a letter and asked us to come together for interview.

    today, we went in and brought all proofs that we're living together including: utilities bills, apartment lease contract with both our names, car insurance, driver license, income tax returns, etc.

    all utilities bills, insurance...all of them show the current and previous address we live together.

    She took my wife into her office alone while I waited outside in the waiting room. after 20 minutes, she called me in and let my wife out.

    she started asking so many questions if that match everything she has asked my wife... where did you live, why did you file your income tax returns as "Separately", how many brothers you have and what their names?what's your dad's name, mom's name.....and many more stupid questions..finally, the interview lady told us, she is confused, she is not convinced that we are a real married couple and living together.

    she told me to wait for the letter for final decision.

    that's it...I feel like being interrogated by police officer

    I asked her how long we wait for the letter. "I don't know", she replied in cold blood. that's it, we went home

    any advice? your help is greatly appreciate!

    thank you very much for your help and clearing out all the confusion that my friend and I had.I told my friend exactly as you two told me, that he doesn't need income to sponsor his child because the child is treated as U.s citizen. and he is very happy :)

  10. I think in many places this is a process that can be accomplished in weeks. It is somewhat dependant on your ability to provide the required documents and how easily accessible they are to you.

    thanks very much. I told my friend that it takes only few weeks to be able to get his child travel to u.s if all the documents are fully supported. he is very excited about it :)

    Hey Tim,

    Since your friend was a US citizen when his son was born then his son can acquire US citizenship by reporting his birth to a US embassy or consulate. This is the easiest way to get the child admitted to the US. Once the birth is recorded, the US citizen son can get a US passport and travel to the US. Simple and easy.

    The Child Citizenship Act of 2000 generally applies to people who adopt foreign children. The child is admitted as a LPR who then apply for US citizenship. This requires a I-130 then an AOS. Why go through this when your friend's son is clearly entitled to US citizenship as the child of a US citizen.

    hey guys, I have another question, since my friend has vey low income (based on his income tax return), so, does he need to have income to sponsor his child? if yes, how much income should he have?

    p.s he can have his co-sign for income.

    yes, my friend was u.s citizen 10 years ago. anh his child now is only less than a year old.

    here are steps my friend will do, right guys?

    REPORTING THE BIRTH

    (1) an official record of the child’s foreign birth

    (2) evidence of the parent’ U.S. citizenship (current U.S.passport, and Certificate of Naturalization)

    (3) evidence of the parents’ marriage (don't need this because they're not married)

    (4) affidavits of parent(s)’ residence and physical presence in the United States.(income tax return, banking statement, bills show address & charges..)

    5) receipt of sending money overther to support his child

    6) medical records showing him and his child have blood compatibility

    7) All evidentiary documents should be certified as true copies of the originals

    and translated into english

    finally, him and his child will take all these documents (above), then go to u.s consular office and report the birth and apply for "Consular Report of Birth Abroad form FS-240"

    question is, what about his child passport? should his child be applied for passport at the consular, too?

    am I right all those steps above? please help us out if we missed any thing

    my male friend, he is U.S citizen. He is married and has a wife in U.S, but he also has a girfriend oversea :)

    Him and his girlfriend has a son together. Now he's trying to bring his son to U.S, his girlfriend is 100% supporting him. That's enough for his story.

    here is question:

    he know he's filing form I-130 for his oversea unmarried child. Form I-130 doesn't say anything about required income for sponsoring his child.

    does anyone knows about the income?

    I have a question for my good friend,

    my friend is U.S citizen and he's sponsoring his wife and son from over sea to U.S. through K-3, but he does not have income tax.

    He has a co-sponsor (which is his mom) for filing out form I-864.

    here is my question: what is the household size for him according to poverty guildeline? is it 3 or 4?

    Mom, him, his wife and his son.

  14. I believe he will need her permission to bring the child to the USA.

    If he is listed on child's birth cert, the child's birt can be registered at the nearest US consulate, and a US passport will be issued to the child allowing entry to the USA as a US Citizen.

    I need your help on this...greatly appreciate your help!

    My friend is U.S citizen. He has a girlfriend oversea and they have a 6-month old child together. Now, my friend wants to bring only his child to U.S and leaving his girlfriend over there :)

    He want to bring his child to U.S as soon as he can. Now, what steps should he do now?

    I hope you guys can help us on this issue!
