  1. Hi everyone, I'm a U.S. citizen residing in Puerto Rico and I'm the financial sponsor for my wife’s Adjustment of Status case (K-1 visa). Since I live in Puerto Rico and all of my income is sourced locally, I am exempt from filing federal tax returns under Section 933 of the Internal Revenue Code. Instead, I file annual Puerto Rico tax returns (Form 482) along with a W-2. I answered “No” to question 15 on Form I-864, but I did not check box 17, because my reason is not due to low income, but due to territorial exemption. I included an explanation and submitted my Puerto Rico tax returns as evidence. Will this be accepted? Has anyone had a similar case? I want to avoid an RFE. Thanks in advance for your help!
  2. Hi everyone, I’m a U.S. citizen sponsoring my wife through adjustment of status (she entered with a K-1 visa and we’re now married). I live and work in Puerto Rico, and all of my income comes from PR sources. Under Section 933 of the Internal Revenue Code, I understand that I’m not required to file a federal IRS tax return, only a local tax return with Hacienda. I marked “No” in Part 6, Item 15 of Form I-864, checked box 17, and included an explanation. I also submitted my Puerto Rico W-2 and Form 482 (PR income tax return). Has anyone here done this and had it accepted by USCIS or NVC? Just want to make sure I filled it out the right way. Any feedback is appreciated!
  3. Hello everyone, I’m reaching out to hear from others who might have experienced something similar in their K-1 visa journey. My fiancé and I have been waiting for several months, and we’re not sure what else to do but wait. Our case is being processed in Lima, Peru. In July, we received an email from our immigration attorney with instructions to create an account to schedule the interview appointment. Since then, we’ve completed the DS-160 and followed the instructions to register on the scheduling platform. However, every time we check, the system says that our case is not ready to schedule an appointment. I called the embassy recently, and they confirmed that there are no available appointment dates yet. The only advice they gave was to keep waiting, which seems to be the only solution at this point. I would love to hear from anyone who has gone through this process in Lima or any other location. How long did it take for you to get an appointment? Were there any additional steps you took that helped? Any insights or advice would be greatly appreciated as we navigate this uncertain waiting period.   4. Hi , I’m seeking advice regarding my K-1 visa case being processed at the U.S. Embassy in Lima, Peru. Back in July, we received an email through our immigration attorney with instructions to move forward, including completing the DS-160 form and creating an account to schedule the interview appointment. We promptly followed all the steps, including submitting the form and creating the account. However, the system still shows that our case isn’t ready to schedule an appointment. I recently called the embassy, and they advised us to continue waiting for an email with further instructions, but we’ve received no updates since then. It’s frustrating because we’ve been stuck in this stage for months, and it seems like waiting is the only option. I’d really like to hear from others who’ve gone through a similar experience.
