  1. Hi Everyone,

I'm in a desperate situation. I just sent out my I-130 and was feeling goooood. Then my wife tells me the address we put for mailing has just changed and can not longer receive mails. OMFG!! How in the world... only in China...

More info: DCF filer, I paid in Shanghai and sent to Beijing by EMS. By the time I get back to the post office tomorrow, it'll probably be gone already...

Why is this process so cruel?!?!

  2. Please, someone help me! Or if there is some place that this has already been answered or something, direct me there. I'll read it and find out. I have looked and haven't found anything to answer these questions and I really need to get this fill out and sent off.

I'll rewrite my questions with numbers, in case it's just too confusing to read. Here they are...

1-If I made a mistake in the typing or handwriting (on this form or on the G325A), can I correct it in handwriting and initial or something or do I need to redo the whole form in typing and then print it back out?

2-#22 (I thought I understood this but after reading the printed version, I'm not so sure)...

    It says,

'Complete the information below if your relative is in the US and will apply for adjustment of status.'

I put n/a. But then in the same area (still under #22) it reads,

'If your relative is not eligible for adjustment of status, he or she will apply for a visa abroad at the American consular post in:'

Do I fill that out or is that still only pertaining to him if he is in the US right now?

3-Can I staple the pages together in the forms I send out?

    Thank you! :)

I have the same question about number 22, i see you never got your answer on this post, sorry to see that, what did you end up writing for number 22?

    thanks you

  3. i've also been faced with this issue.

im currently living with my wife, but we're finding it difficult to prove it because her landlord doesnt have me on the lease, but i do have my residence permit registered to this address and my wifes lease will match this address. is this proof enough that we live together?

for now i think we will file and include a joint bank statement and an affidavit from my brother.

my question is what goes into creating an affidavit?

"Affidavits sworn to or affirmed by third parties having personal knowledge of the bona fides of the marital relationship (Each affidavit must contain the full name and address, date and place of birth of the person making the affidavit, his or her relationship to the petitioner of beneficiary, if any, and complete information and details explaining how the person acquired his or her knowledge of your marriage)"

what exactly is the "complete information and details" part?

...explaining how the person acquired his or her knowledge of your marriage.

Such as... "I'm the groom's best friend. We went on double dates. I attended the wedding in city at hotel and saw the bride and groom were eager to get on with the honeymoon. Later that night we heard the headboard banging in the room next door. Since then, we've been to their home for supper on the following dates...

Since you do actually live together, your residence registry showing the same address as hers is probably good enough but you'll need to get that translated at the Gong Zheng Chu.

All and all, this is really not much of an issue for DCF filers. You live together. I'd skip the affidavit from the friend.

question about the translation for her lease. i got it translated and it has a red stamp saying "certified translation" but theres not statement saying its a valid or guaranteeing the translator is fluent in both languages. my question is do i have to get this further notarized like we did for all the other official documents or is this enough to proove we live together for now?

  5. Hola, That's correct! You don't have to attach any of that when you send the I130.

    Good luck,

    Hello to all....

First of all I hope everyone has had a WONDERFUL weekend....

I need to know if I have to translate the receipts I attach to my I-130. For example wedding band receipts, honeymoom receipts.... etc.

    Thanks in advance

    Kelvin

    i have two questions:

    1. when we got married, they gave us two marriage certificates. my question is when we translate/notarize, do we have to do both? because when we brought it to the notary they told us they knew what to do and made photocopies of both certificates, but we only received translations for 1 of them. did they really know what thye were doing?

    2. do we need to provide proof of bona fide marriage when doing the initial i-130 filing? or is that later? is the marriage certificate enough as of this step? (attached is the instructions that came with the i130 form, its pretty clear, but i find a couple of people have not provided initial proof) the reason i ask this is because we havent had our proof translated, but we'd like to file for the i130 as soon as possible, i dont want to feel like im rushing things, but i also dont want to wait an extra week if i dont really need to.
