  1. Hey VJ Members,

    I am asking for your help again....

    1) I am working on the AOS and was uncertain as to whether it needed to be filed within 90 days of his POE date OR withion 90 days of us getting married.

    2) If it is not filed within the time, of whatever the answer is above, does he become an illegal alien?

    3) It took 2 months for my husband to receive his social security card. Now his temporary EAD is about to expire. This is leading to employers not even considering him. Can we file the EAD renewal prior to the AOS being submitted?

  2. Hey VJ members,

    I am hoping some one can give us some advice on what to do. My fiance (husband now) arrived in the US on July 23rd. We went to apply for his SS card on July 25th. When we checked the phone system on the status two weeks ago, they said that they had no record of his application. We marched down to the local SS office (where he applied the next day). The showed that he application was in the system but said they are still "awaiting INS clearance". When the SS representative showed us the info on his screen, next to verification it said "SUSPECT"! :unsure: Should I be worried??? It has now been about 7 weeks since he applied....

    Can anyone offer any corrective action suggestions? :wacko:

    Also, we are about to apply for the AOS:

    1) Does he defintely need a SSN in order for it to be processed in a timely fashion?

    2) If his EAD expires before the SSN arrives, can we even file a I-765 as a renewal?

    Just wanted to let you know my fiance picked up his visa TODAY! The Ghana consulate gave it to him today as promised. YEAH! :dance:

    I told him about Bassi & Zainab being approved as well. He thinks he might have seen them as well (I told him Zainab accompanied her fiance to the interview).... He was too shy to make an inquiry and was focused on having that Visa in hand...

    Thanks to all on the VJ site who helped! Especially Zee, Erica, and Zainab! Sorry if I forgot people! :(

    INTERVIEW DETAILS:

    -Fiance arrived on time. He waited in a long line outside and did not know he could go straight in....

    -Once inside, he waitign about 1-hour and was called to a windo. he was asked for his documents. The woman was cordial. She went through the documents and took out the things she wanted. I think the amount of paperwork must have been overwhelming. My fiance recalls getting back several emails, phone records, and the copy of the original 129F petition.

    -My fiance was given a slip to make payment $100 USD (he obviously paid in Cedis) and brought the receipt back to the original window.

    -He waited about 40 minutes and was called to anouther window where he was fingerprinted. The machine was not acting correctly and the lady asked him if he had scratched finger tips. He stated no, but the lady insisted they were and told him to sit down. At this point, he was kind of nervous...

    -10 minutes later, he was called to another window. Given an oath and the interview commenced..

    QUESTIONS ASKED:

    -Who is Jackie?

    -What does she do for a living, where does she work, what other job placements or occupations has she had?

    -Where did you meet?

    What was she doing in Ghana? (at this point she wanted clarifications as to whether I was born in the US and raised in Ghana or born in the US and raised in the US... Uncertain as to why it mattered).

    -The Consular Interviewer (CO) than reviewed the phone records. (I used a calling card primarily thorugh Callingcards.com. I printed out the accoutn status which gives the access #. Kamal and I created a pattern where he would "flash" me and I would call him back with the calling card. So it showed when he called me and me calling him back a minute later).

    -The CO went through the submitted pictures. She asked where & when they were taken and who was in them.

    -CO said we had overwhelming evidence, approved the visa and told my fiance to come back THIS FRIDAY FOR HIS VISA!

    -He was told to have a seat in the waiting area again. 15 minutes later he was directed back to the fingerprinting window and re-fingerprinted.

    IMPRESSIONS:

    Everyone was indifferent with the exception of the person doing the fingerprinting. She was slightly snippy. Kamal said the CO was pleasant but serious. She was not intimidating and he felt comfortable.

    I AM SO EXCITED. MY BABY CALLED ME AT 8AM (NYC TIME). I AM SURE I WOKE UP THE WHOLE NEIGHBORHOOD!

    I apologize for the delay in posting this. My fiance and I have been trying to get all our items together for his interview...TOMORROW! Now that I have a moment to take a breather, I am posting how he did his medicals in Ghana and his experience. Let me take the time to say that I received much guidance from Zee, Erica, and Zainab!

    What he brought:

    1) Embassy letter indicating appointment date and case #

    2) 3 passport photos

    3) his Passport

    Where her went:

    First he went to Trinity House. Someone had mentioned a person by the name of Mr. Ray, who was very knowledgeable about the visa process. He mentioned his name and Mr Ray came out and initiated the intake process. He took my fiance's vital, documents, and ID. he gave home some forms o complete.

    Next he had his eye test.

    Next he was examined by an MD who asked several medical questions and did a physical exam.

    Next they did a chest x-ray

    Next they requested a urine and stool sample. (I was told this takes the longest. No too many people can do a # 2 on demand. My baby was no exception!). I was surprised to hear this part was not supervised. In the States they strip you of all you have on you and tell you not to flush the toilet to make sure you are not using someone else's samples. Maybe it was a fluke that day at Trinity.....

    The total cost was about 500,000 Cedis and he was there from about 8am to 12noon...

    Next he went to Med Labs. They took blood samples there. My fiance says that whe he arrived, the office stated there would be a lunch break from 1pm to 2pm. My fiance says everyone left except for him an another guy. He decided to wait. He said 10 minutes later someone came out and called him inside to draw his blood.

    The total cost was about 500,000 Cedis and he was there for about 45 minutes.

    Next he went to Akai House for his vacinnations. They gave home 5 vaccination shots. Some are series so he had to return for the 2nd dose in 30 days time.

    The total cost was about 2 million cedis and he was there for about 1 & 1/2 to 2 hours.

    SIDE NOTE:

    My fiance went to the Police Headquarters to apply for his Police Certifiecate since he was off for the day and gathering the needed items. He was told his certificate would be ready in one weeks's time. He is well known at the Head quarters since several family members are detyectives, so I am not sure if the processing was expedited for him...

  7. Maybe it's my sensative time of the month, but I literally have tears in my eyes! Go get him and bring him to home #2! Don't be surprised if there is a marching band, cheerleaders, and paparazzi waiting for you at the airport! LOL! :dance: Congrats! SO HAPPY FOR YOU!

    Try not let this ruin your weekend.. instead think of the time when he'll be off that plane and with you for good without any more separations!!! I know it must be frustrating but at least he will eventually get the visa and that you guys were approved for sure :thumbs: we'll be thinking of ya (F)

    Thanks and I will try not to let it ruin the weekend. I just talked to him and he said that his passport is ready but they could not get his fingerprints into the system. What system? Is there anyone out there who has completed this stage of the process and can detail what happens when you go to pick up your visa. Maybe it will help me understand the process better.

    Sorry to hear about the delay, Erika. You are ahead of me in this process, but I am positive everything will turn out fine. I would be interested to hear about this whole fingerprint issues as well! Be strong, girl (As you have been this whole process)!

    You all have always been so helpful... Can anyone give me guidance on the following questions?

    1) I-134 instructions says: "the sponsor must submit in duplicate evidenace of income and resources". Does this mean your bank letter should be two originals as well as income taxes, W2's, etc? I sent my fiance one copy of everything. They kept nothing except for the I-134. They did look through the other stuff I sent but did not keep it. I sent the I-134, 6 months of paystubs, a letter from my employer, 3 years tax info and a year's worth of bank statements.

    2) Do you fill in your annual income as denoted on your W2 or employer letter (if different)? I earn additional income from per diem work at my job... I used the figure that was on the letter from my employer. I also have a 2nd job (more for fun than income). I did not include that income on my I-134.

    3) If you don't have a savings account, should you put the average daily balance in the checking account as denoted in the bank letter? Or put what you could present if you were conservative with your monthly income? If you meet the requirements on income alone I would not worry about this. When my fiance went for the interview they asked for the I-134. After the CO looked at it he asked for my 2007 tax returns and W2s. I think that if you want, you can include your bank statements like I did and that will be sufficient.

    4)For the personal property question.... I read in a guide that you should calculate the value of any valuables in your home (including car, property, etc). Do they ask for evidence of the value? I am sure my receipts have been thrown out on many items.... Not needed if you meet the requirements on income alone. If you do not meet the requirements on income then you can make up the difference using assets.

    1. I and many others just submitted one copy of supporting evidence with no problem. I also submitted no bank letter, because my income was sufficient without using assets.

    2. Use the more current and accurate figure.

    3. If your income alone is sufficient, you may simply leave blank all questions regarding assets.

    4. See number 3.

    The best practice is to submit three years of tax transcripts and a few recent pay stubs.

  11. AWWWWWWWW! Erica! You have been so helpful to me! Again, I am soooo happy for you and Sammie. I have been blessed to find this sight and all the people who have been so willing to share their up's and down's.
