    If this theory is true, that they just say "no" to save time, that was be misleading the waiver title itself. Incompetent and technically fraud for taking a citizens money without doing the work, but wasting thousands of dollars of its citizens and in many cases I'm sure, hundreds of hours wasted of the person going through hardship and one can argue that it made their hardship even worse.

    I don't agree with this nor do I believe this is true. Every situation is different and the bar actually makes the hardship waiver case stronger with most attorney's that I spoke to - but again, everyone's case is different as to why they are out of status. The argument no longer becomes 2 years, but 10 years instead.

    I agree with you - however, there are moments in life where you don't plan to fall in love or an attorney does wrong doing and complicates a situation... or any other situation. This also goes to show that these two laws are conflicting.

    If they are married to a USC on a legitimate basis, the waiver will make all the difference - with or without status. If I understood it correctly, the bar is forgiven when it comes to adjustment of status when married to a USC - if they aren't, then the I-612 waiver becomes useless. Please correct me if I'm wrong!

    I'm assuming your NOS has sponsor views, but since it was denied, they didn't request sponsor views again for your hardship waiver? is that correct?

    Hi Everyone, My wife is going through a J-1 waiver soon, but once it is completed and waived, what would we need to file (which forms?). We already have our I-130 approved (adjustment of status originally denied since attorney didn't realize we needed a waiver first). I am a US Citizen, she originally enter legally, but overstayed since. Many thanks.

    Our attorney was incompetent and told us to file a no objection and overstayed due to it. Now subject to a 10 year bar because of it - adding to the hardship. It's a messy situation.

    That's what we're hoping for! Originally was chosen for the program due to entrepreneurship of owning a company - went back for 16 months, but covid closed the business - defeating the purpose since the very foundation of the selection was the business. In reality, one must also take into consideration as to what you can actually learn in 5 weeks and "spread" the knowledge for 2 years, vs the same criteria of a program that is 1-4 years and you still need to go back for the same period as someone with a 5 week program (but has also completed 70% of the 2 HRR). Thank you!

    Thank you! I agree and we will be speaking to another attorney as well. Regarding US government funding, a hardship waiver - as long as there is clear evidence of exceptional and/or extreme hardship on the USC spouse - since now it technically has nothing to do with the j-1 applicant, but a USC him or herself. What are your thoughts? On a side note, I've spoken to a few people that got denied a j-1 no objection gov funding, but approved hardship waiver after.

    The government funding came from ECA and the implementing partner was through a non-profit organization that handled the program. Any ideas?

    Yes, correct. One attorney told us he had a case years ago where the individual paid back or donated the funds - since it was the only thing holding him back. I think, there are some US government programs (I have to find it), that allow you to pay back the funds, plus interest - some government programs don't state anything and that is why I'm curious.

    For people that applied under the exceptional hardship waiver - how long were your statements and pages of evidence? Also, did you get approved or denied?

    Yes, it would be great to keep each other posted! I am gathering documents now and will file in the next few weeks. What department of the ECA funded you? (ECA/x/x)

    Have not yet filed, gathering all documents currently. I will likely put the No Objection from the home country in as evidence as well.

    I agree! Our attorney led us wrong and became a waste of time, now the hardship route.
