  1. Hi,

    My Parents (age late 80's) came to the USA on an immigrant Visa 7 years ago. They couldn't adjust to the life here, and went back a year later and have not returned for 6 years. I am assuming that although their Green Card isn't expired, their status is no longer valid.

    My mother passed away recently back home, and now I want to bring my Father here so I can take care of him. Since he doesn't have anyone to look after him, or help him through Consular processing in India, I am thinking of surrendering his Green Card for a Visitor Visa and then applying for Adjustment of Status here.

    Is this a valid option? What are the chances of the Adjustment of Status going through (since he would have turned in his GC)?

    I am new to this portal and have found so much information from your discussions! Thank you. I just received the approval for my I130 and I129F which were both approved on May 8. Although I do feel I have a fairly good idea from your conversations, what should be my next steps as I wait to hear from NVC? I am starting to get the police report, birth certificates etc. ready. Do these need to be sent to NVC (the NVC website asks for the originals) or are these originals brought to the visa interview?

    With the K3, do I send anything to NVC or do they just directly send all the materials to the consulate in India, and then my wife brings all the evidence and forms to the consulate?

    You don't really need to do much.. If your I-129f got approved.. then it will make its way to the Embassy pretty quickly. As soon as embassy receives it, they will mail the benefiary a Packet 3 - (I would not wait to receive this, contact the Embassy and ask if they mailed it out, if they have, then print it online and send it back to them).

    Once they receive the Packet 3, they will send out a Packet 4 which contains the Interview Date. At this point, she needs to get the Passport Clearance Certificate, etc.

    So if you are going the K-3 route, then all the originals need to be provided to the beneficiary, as well as an Affidavit of Support package.

    The I-130 will just sit at the NVC until they send out AOS Fee Bill... which you probably don't want to pay because you're already going the K-3 route. It would just be a waste of money unless you really want to continue the CR-1 route.

    I just received the AOS Fee Bill in the mail for my CR-1 case. I am one of those who have had both their cases forwarded to NVC... My K-3 Petition is already at the Embassy and we have our Interview date assigned.

    What do i do with this request for the CR-1 visa? Do i need to pay them even though i am going the K-3 route? Also do i need to notify the NVC that i've decided on the K-3 and tell them to abandon the CR-1?

    its a long first week of April for me :crying:

    Still No update about our case... no Touch... no mail... nothing :angry:

    i called the customer service 2 times the first one was not so nice, the second was a good chat... :blush::blush:

    but still not enough to calm my mind... she just told me wait until the 30days past the process time :crying::crying::crying:

    although she was was very nice to me... when she told me to just call again.. :crying::crying::crying: when the 30days had past and make a service request... I even ask if by any chance they lost our paper... :crying::crying: she kindly reply to me like a recording... :crying:

    well... its what they usually say right..??? like a script... blah... blah... blah... all this info are on the website...

    but what i want to know... what i want to tell me... is that are we next in line... because so many filers who filed the same time or even later than me... were all have been approved... :crying:

    so... what can you say about this??? is there anyway I can possibly know were are we in the process?? :crying:

    Since both my Petitions are at the NVC and they have both been assigned Case Numbers, I was thinking of pursuing both cases. My K3 papers were sent to the Mumbai Embassy today.. and I expect to get requests soon for the NVC processing of the I-130.

    If I do choose to pursue both, and my Wife arrives in the US before NVC is done with I-130 (which is likely going to happen since it takes about 3 months at NVC), can we ask NVC to hold the I-130 here and can she interview here for an Immigrant Visa?

    I want to do the K-3 cuz its about 3 months faster, but I also don't want to pay AOS fee. I was hoping she can get here on K-3 and interview here for the IR-1 and get her green card... is this even possible?

    Do i need to tell the NVC to "begin processing K-3"? I was assuming that they will start processing them both separately... without me having to tell them to do one or the other.

    If that is the case, then I will likely get requests for I-130 related documents... do i just ignore these? or keep replying to both processes in parallel?

  7. I was just approved a week ago. I confirmed today that NVC has both my cases.

    I was able to find out the NVC Case# by punching in the CIS receipt number for the IR-1 application --- the K-3 case number was not available on their automated system. So i talked to a Rep. and she gave me my NVC Case# for the K-3 as well. So i have 2 NVC case numbers assigned for both of my applications...

    i thought USCIS would forward only the I-129f application... wierd....

    Did you have to mail an authorization form of any kind or go in person to your senator's office? Someone asked me about this for their case.

    I wrote an email to the senator through their website... then in 2-3 days i received a letter from their office requesting some privacy release form that i need to submit. This form was sent with the letter, so i filled it out, and sent it back. That's pretty much all they required. They inquired about my case 2-3 days after receiving my privacy release form.

  9. My wife was trying to get the Police Clearance Certificate or Passport Clearance whatever it is at the Passport Office in Ahmedabad. They refused to let her speak with an officer because they said you can't get one without an Appointment Letter...

    Anyone what what appointment letter she needs? I printed the Packet 3 from Mumbai Consulate's website and told her to take that, but that did not work... I guess the appointment letter contains some file number...

    Please let me know if you know how to get this done at Ahmedabad.

  10. Congratulations! However, I doubt that your senator had much to do with it. I have a good friend that works in the US congress and he told me that unless your case is seriously beyond the published USCIS processing dates(not the old 180 day estimate), then there is very little they can do other than ask for the same misinformation you and I can get by calling on the RFE line. Your NOA1 for the I-130 was within their published processing times and it seems like that is what they are using to prioritize. It was simply your turn to get processed.

    For example, my NOA1 for both the I-130 and I-129F were in late August, yet I got processed at the same time that others with a late August I-130 NOA1. It looks like they ignored the date for the I-129F or I would have been processed two months earlier.

    So, unless your I-130 NOA1 is earlier than the date published for your service center, you will likely get no benefit from calling your senator or house member.

    I think in my case, just having my senator inquire about my case resulted in an approval. I know i was pretty much aligned with what they are processing, but i had no touches until my senator's office started contacting them. So even if going through a senator means only a couple weeks earlier approval, i think its worth it.

  11. I just got a call from my Senator's office saying that both of my petitions had been approved!! :dance::dance:

    I wrote to her office 2 weeks ago... apparently USCIS told her that mine shoudl have been approved a while ago. So if you have a timeline similar to mine.. write to your Senator!!!!

  12. I finally got a touch! My last touch was October 22nd, 2007... and i got another one today 3/18/2008...

    I just hope this means more touches and an Approval :dance:

    I-130 NOA1: October 1st, 2007

    I-129f Filed: October 10th, 2007

    I-129f NOA1: October 16th, 2007

    I-130 Touch: October 22, 2007

    I-129f Touch: October 22, 2007

    I-130 Touch: March 18th, 2008

  13. I filed I-130 in August 2007. Then waited for NOA1 and filed I-129f for K-3 Visa. I am still awaiting NOA2 for both applications.

    My question is... If my I-130 gets approved before my K-3 gets approved, will that be forwarded to NVC automatically, and will they begin processing that one? OR.. do i have to wait until the K-3 gets approved (which may take longer) and am I required to continue on with K-3 since i've filed it?

    I would like to go with whichever one gets approved first because I am tired of waiting for USCIS approvals.... is there a process to make this happen?

    Please reply if you know the answer.

    My cousin recently brought his wife over to the States through an IR-1 Visa. His wife went through the Mumbai Consulate for Visa. I am now in a similar situation.. and had a few questions. When his application went to the NVC, he didn't have to submit DS-230 or Police Clearance Certificate to the NVC, rather they wanted that to be submitted at VFS in Mumbai.

    So now I am confused.. Do i need to submit that here? If so, then do they need to duplicate everything and submit to VFS as well? I've read posts saying that Mumbai Consulate is now Appointment Post.. when did this happen? Does anyone have any links where i can see that they have changed procedures?

    Thank you for your response. What's weird about this whole thing is that the Mumbai Embassy's website says nothing about these changes. I know the Department of State's website already reflects this.. but i was surprised the Embassy's website didn't get updated. It still says that Packet 4 will be mailed for Immigrant Visa.. and if that's the case.. Packet 4 requires all the forms now required by NVC.

    Please keep us updated on what you had to go through.. your timeline indicates that NVC requested those documents.. what packet did your spouse receive in India? Also what is James Shortcut 2.0.. i've heard of James Shortcut.. is it the same thing?
