Hello everyone,
Quick background: My wife entered the US on August 2008 with a K1 Visa on my petition - We got married the same month - She became a Permanent Resident on March 2009 - Now she wants to apply for the Citizenship and we just want to make sure she picks the right option on Part 1 of the form.
She's been a permanent resident for 5 years and 1 month.
She's been married to me (US Citizen) for 5 years and 8 months.
Which is the best option to choose between the two on Part 1 of the form for her situation based on the information I provided?
Part 1. Information About Your Eligibility
1. __ Have been a Permanent Resident of the United States for at least 5 years.
2. __ Have been a Permanent Resident of the United States for at least 3 years. In addition, you have been married to and living with the same U.S. citizen spouse for at least 3 years, and your spouse has been a U.S. citizen for the last 3 years at the time of filing your Form N-400.
We're not sure how to pick the best answer because both seems to describe her eligibility. She's been a green card holder for over 5 years AND she also became a green card holder based on marriage to me 5 years ago? Does option 2 only applies to early filers(3 years)?
Thank you guys for your help!

Oh wow, thanks JRluvsLhyn!
You just confirmed what my mother-in-law told me that she was able to get a Birth Cert by doing a late registration. Now I have to convince MY Mother to do the same! - - - My only problem now is that it will hold up the IV process because I have to wait for it to become available from NSO. I can't submit the civil docs without my mother's Birth Cert to support the DS-260 form.
I hope it doesn't take 2 months. lol
Thanks again!

cEzYcHiC, I just filled out a new I-864 and I-864A forms with the corrections. I did not include any supporting docs. I read somewhere in one of the forums that I don't need to and also the letter says send only the requested corrections.

Hello!
quick background: IR-5 petitioning my mother from the Philippines, paid AOS and IV fee, submitted I-864 and supporting docs - now completing IV application form and gathering civil docs.
My question/issue right now is my mother was born in 1942 and NSO was not able to provide any Birth Certificate for her. She explained to me: Because of the year that she was born, civil docs were mostly lost or destroyed at that period...
Instead NSO gave her a "certificate" that proves that she doesn't have any Birth Certificate. I'm not sure what its called but she was able to get a PH Passport using this "NSO certificate".
now besides Baptismal Certificate (which another document that my mother cannot find or get anywhere) What other possible secondary civil doc can she use?

Thank you Zee Zee!
So enter both our income which is whats on our 1040, got it. And yes I noticed the I-864 Instructions that comes with the form is confusing. Looks like they updated the Form I-864 itself but not the Instructions because some parts and items on that step-by-step were missing or have a different number on the form.
Thanks again!

Hello guys, I hope everyone's having a great day.
I need help understanding the checklist I received from NVC about the I-864 and I-864A I submitted.
Background: I am a US Citizen, filed petition for my mother (Philippines), paid both AOS fee and IV fee, sent I-864 and I-864A (spouse is the co-sponsor). But yesterday I received this letter in the email:
"Checklist for I-864A (filed by.................. )NVC has reviewed the financial evidence submitted. However, additional information is required to complete the financial evidence review. Please provide all requested documents and refer to page two for mailing instructions.General Instructions [x] You will need to complete and submit the new form completely filled out (all pages required), which includes the changes noted below. Submitting single pages of the form with the correction is not acceptable. In order to make corrections you will need to download a new form at www.ImmigrantVisas.state.gov.Part 1 Information on the Household Member [x] ..................'s income indicated on line 11 of the I-864A does not correspond to that shown on the most recent tax return and W-2(s)."and the other letter:
"Form I-864, Affidavit of Support, & Financial Evidence Checklist)
Please review the instructions below then refer to the final page of this checklist for mailing instructions. I-864, Affidavit of Support Checklist [x] The Affidavit of Support is an important legal contract between you and the U.S. government. During our review, we identified one or more sections that were either incomplete or contained incorrect information. Please review the additional instructions below then complete and submit anew Affidavit of Support. You can download the I-864 form and instructions at http://www.uscis.gov/i-864.In Part 1. Basis for Filing Affidavit of Support, please correct the following...In Part 2. Information on the Principal Immigrant, please correct the following...In Part 3, Information on the Immigrant(s) You are sponsoring, please correct the following...In Part 4. Information on the Sponsor, please correct the following...In Part 5. Sponsor's Household Size, please correct the following...In Part 6. Sponsor's Income and Employment, please correct the following...[x] Items 13.a.1.The income you enter must match the total (gross) income reported on your most recent Federal income tax return. If you filed Form 1040EZ, use the adjusted gross income instead. In Part 8, Sponsor's Contract, please correct the following...The Form I-864 we received was missing the following page(s). Please ensure you include all nine pages when you resubmit the form. You must submit the following financial evidence:NVC Special InstructionsThe lines in red are the ones I believe needs to be corrected.. both lines from I-864 and I-864A are the lines where we enter the total gross income for the last 3 recent tax year. I entered ONLY my individual income in all three lines from the last 3 years on I-864 and then my wife also entered ONLY her income on form I-864A. Is this where I messed up? Should we combine both our annual income and enter it for each tax year since we file Jointly on our income tax? -
Hello VJers!
I'm petitioning my mother (from Philippines) and getting ready to send the I-864 and my supporting docs. My wife and I file our taxes as joint, I'd like to add her as my (is it co-sponsor? or joint?). Which form should my wife fill out to go along with my I-864? Is it form I-864A or another I-864 form? And yes she has all her supporting docs ready. I'm just confused as to which form she should fill out.
Thank You!

Hey Everyone!!
I don't mean to hi-jack this thread, but I'd like to share our experience. I've been here in the U.S 10 years, my dad 20+ years and my brother 13 years and we've all been Naturalized but my mom never followed us here because she has no interest in living or staying here. But after years of convincing her to atleast apply for a tourist visa, she agreed to come visit us for the holidays. She applied, did the interview but was denied. They only asked her two questions, she told me. "When did your husband arrive in the U.S?" and "How come your husband did not apply for an immigrant visa on your behalf?" she answered both questions but was DENIED. Do you guys think they will never approve her for a tourist visa because they want my dad to file a petition for a relative instead?

Hey Guys!
My wife recieved her EAD card today, and yes it's valid for one year. But her I-194 expired last Dec. 13, 2008. right now we are waiting for her Green Card which i think will take atleast 3 more months..
can she start using her EAD eventhough the I-194 stamped on her passport expired?
I asked this because i know how important the I-194's validity for K-1 Visa holder.. and yes, I'm confused!

Here's the map: McNamara Terminal Map (Detroit DTW)
If you have a connecting flight I'm sure you'll find your next gate fast.Domestic flights for Northwest Airlines are located inside the McNamara terminal so you don't have to go outside. Just read the signs all around you and you'll be fine. And don't be afraid to ask someone for directions. You'll be surprise to see a lot of Filipinos in the terminal either waiting for their flight or arriving.
After landing..you'll get in line for your POE Immigration, ask you some questions, process your forms and passport after that, you'll go to baggage claim. Get your stuff, follow the signs that says TO GATES...BLAH BLAH BLAH..Connecting Flights... You'll have to check-in your baggage again you'll see passengers lined up waiting for the check bag area, give them your stuff, they will open your luggage but you don't have to wait for them you just go ahead and find your next gate..maybe another security check after that you're free to roam around the terminal.
Note: this is only from what I remember the last time I was in Detroit Airport coming back from Manila. Almost a year ago..but I don't know if these process have changed or maybe some new security measures have been added. But I've been through the same process four times in the past 2 years at the same terminal and I enjoyed every single one of them..except for Security Checks where you have to take off your shoe's, belt, any object that's on you..almost like naked, but with clothes on.
good luck and have a safe trip. u have nothing to worry about
You'll be ok, except for your wait time. 10 hours is way too long..I had the same experience. I fly northwest when I go back home(manila). but coming back from manila to detroit then florida I had to stay at the hotel inside the airport just to get some sleep and not wait around the terminal for 10 hours!Another problem you'll have is the new checked bag policy. especially with northwest, if your connecting flight is more than 8 hours of wait, they will charge you for the 2nd checked bag.
"International Travel - between North America and Africa / Asia / Europe / India / Middle East)Coach Class: Each ticketed passenger is allowed two (2) pieces of checked luggage.
Exception for Coach Class International travel with a connection time of eight (8) hours or more that requires luggage to be re-checked for a flight within the US, Canada, Mexico and Caribbean: Each ticketed passenger is allowed one (1) piece of checked luggage (see below for details)*
Each piece: 50 pounds (23 kg) with linear dimensions not to exceed 62 inches (158 cm).
Exceptions for trans-Pacific travel wholly between U.S./Canada and the Philippines, China and Hong Kong, checked pieces may weigh up to 70 pounds (32 kg) each.
Checked luggage within the free 2 bag allowance that weigh more than 50 pounds and up to 70 pounds will be assessed a $50.00 heavy bag fee.
Checked luggage within the free 2 bag allowance whose linear dimensions exceed 62 inches will be assessed 2 excess baggage charges. See rate table.
(Applicable to Trans-Pacific travel between North America and Asia) Checked luggage within the free 2 bag allowance whose weight exceeds 70 pounds will be assessed 3 excess baggage charges.

You'll be fine at the immigration, just read and follow the signs around the terminal. Detroit Airport is huge but it's impossible to miss your connecting flight. They also have a tram (like a MRT type of train inside the terminal, if you don't feel like walking and it's a lot faster and easier to get to your gate. Good Luck and Have a safe trip!
This is really interesting reply to me... do you know where to find the sketch or map of Ncmanara Terminal? i think i'll be passing in thru that terminal. i just want to know into what and where direction will i be heading into...
I really appreaciate it so much...
Thank you.

i don't have a ticket or flight schedule for my fiancee yet, i'm still shopping around for a one-way great deal. well, i'm more concern about the wait time in between flights. her final destination here in the U.S. is florida and there is no direct flight here from manila so i expect 1 or 2 stops.im also concerned especially with the new policies on checked bags.. with northwest airlines, once in the U.S.(POE)if your wait time for your connecting flight is more than 8 hours, you'll have to pay for the 2nd bag because your flight will be converted as domestic flight.
if anyone out here knows any travel agents/agencies in manila that accepts credit card payments from a U.S. bank please share it with us
thanks guys and good luck and have a safe trip to all!
