    I am currently married to an US citizen. Last October we had our AOS interview. One month later we replied to an RFE and two weeks ago I finally received my greencard.

    But there is one problem now. During the last two months my wife and I had lots of trouble and we decided to divorce as fast as possible.

    But I am afraid that we will get problems by USCIS if we file for divorce in the month I received my greencard or the month later.

    So my questions are:

    Does USCIS get notice about our diorce or the filing of it?

    If yes, do they maybe consider marriage fraud?

    If I divorce now, does it have an impact on my actual greencard (expiry in jan 2011)? I would like to stay one more year in the US and then go back to Europe.

    What do you suggest?

    I know it would be easy to wait some more months but it's both our feeling to leave everything behind as fast as possible. That's why we want to finish the divorce as quickly as possible.

    I would be glad about some advice.

    we had our AOS interview end of october and got an RFE letter (evidence of bonafide marriage) at the beginning of november.

    We replied end of november but haven't heard anything since then.

    Now six weeks have passed and we don't know how long we will have to wait. Is there any timeframe within USCIS has to answer?

    When are we expected to get an answer?

    Is it possible that we will not get any answer for a couple of months?

    And is ist a good or a bad sign that it takes so long?

    I would be happy about any answer.

    my friend is married to a USC. A few weeks ago was the scheduled AOS interview. 1 week after the interview they got an RFE letter with a timeframe of 30 days to submit the required evidence. My friend and her husband of course complied with the timeframe. Due date of the RFE was November 24.

    Until now they didn't get any information of USCIS. How long should it take until they will get an answer?

    They start getting nervous because after the AOS interview it didn't take a week until the got an RFE but now already three weeks passed without hearing anything of USCIS.

    Is it a good or a bad sign that it takes so long?

    It's a bad feeling to live in uncertainty.

    Which specific kind of evidence they are not able to bring I don't know. I will ask them.

    In a denial, one can ask for an appeal case to be opened and reviewed

    What is an appeal case? Will it be processed by USCIS or by an immigration judge?

    Will it be a new case independent from the old one where you get an additional time frame to originate more evidence?

    How long does it take to process the appeal case?

    a friend of mine had her aos interview a few weeks ago. Some days after the interview the couple got a letter that the IO needed more evidence of an ongoing relationship. The letter also stated the specific evidences they are requested to bring.

    Anyway, the couple thinks they might not be able to furnish USCIS with all the evidence listed.

    To my question: If the IO denies AOS because they were not able to bring all the requested evidence, what happens next?

    Will she get the order to leave the country in a specific time period after she received the letter?

    Or will they first be called for a interview?

    Or will the status be pending?

    My friend wants to be prepared what might happen. Especially she would like to know in what time period she would have to leave.

    I hope I can get some information from you all.

    My friend she went to the United States in February by K3. Now finally an aos interview appointment was sent to them. But they are both wondering because they got two interview appointments. One in three weeks and the other two weeks after the first.

    Neither them nor me we have heard or read something about two interview appointments.

    Can someone tell me if it is normal or why they propably got two appointments?

    I have to mention that the difference in age between them is more than 30 years and she comes from Africa.

    Do you think there will be a fraud interview? They are really concerned although the relationship is true.

    I would be glad for any information.

    he married her one month ago in Africa. But because of he (or her family) wanted to bring her to America very fast, they went on a fiancee visa to the US.

    She was not interviewed in the embassy of her country of origin. But she had the impression that her husband knew many people in the embassy.

    In a few days I think she goes to the immigration office just to fill some applications. She was just told by the man that they are going to have an interview maybe in a few weeks (but obviously nothing serious).

    When I said that they don't have a proof ov bona fide marriage I thought of pictures of the wedding, letters, .......

    But of course they have a marriage certificate.

    I would like to get more information about the process.

    Is a fraud interview the same like the aos interview? Which person decides at what time that a marriage should be investigated or that a fraud interview should take place?

    And how long does it take until an immigrant has its aos interview after arrived at the United States?

    By the way, I ask here because I discuss with my friend about this. I don't know the girl and have no contact to her.

    But I will definitively not phone somewhere to say that there is a marriage fraud....

    I have some questions regarding investigations on marriage fraud, the uscis etc..

    A friend of mine told me, that one sister of him married a few weeks ago an American citizen. She's from West Africa, her husband originally also comes from the same country.

    He was given money from other relatives of the girl who also live in the US to marry her.

    After this man received the money, he went to Africa to marry her and brought her a few weeks ago to the US on a fiancee-visa.

    But:

    - The girl is more than 30 years younger than her husband

    - She doesn't know anything of him except of his name. She even doesn't exactly know when he was born.

    - The man also doesn't have proof of a bona fide marriage except of maybe a shared bank account etc.

    - Before this man already married twice a girl from Africa for money.

    In a few days they have to go to the Immigration office. But as I was told the man seems to be very relaxed. I am wondering about this. I don't know your Immigration law well because I don't live in the US, but regarding the fact that he did it already twice before, it seems not too difficult to dod marriage fraud without being captured.

    Is the USCIS staff really so overworked that they don't do any investigations anymore? In this case it would be so easy to detect the marriage fraud. Also they don't take any efforts to "learn" something about the other person in case they are asked questions.

    Can anyone tell me in how many % of the cases investigations on marriage fraud are started and how is the risk that they are asked for an interview with the fraud unit? I always tell my friend that it is not so easy to get a Green Card, but he always says that they never investigate.... Is it true??
