    Sorry it's taken me this long to respond. I haven't been around in awhile. 15 days is normal with CSC. Actually though, you get 18 days if its mailed. And there always a Motion to Reopen - in the event you're late. But you have to pay a new filing fee. In my waiver requests, I always quote the law, pointing out that it's not required for the same beneficiary. I include it with the I-129f. I've never goten an RFE ande every one has been approved.

    I am the benefiacry of two different pettitioner.The first one is filed july last year and its approved this Feb08.In my case we are already broke up and i found this extraordinary guy who want to file k-1visa again this year(we already met in person) because he will be deploy this coming december to iraq.I know it will affect the second petition knowing that the 1st petition is totaly abandoned.What is the best thing we do?

I received the packet 4 just right now..and i cant stop crying,this is the day that im scare about..My medical will be on march 28 and visa interview is on april 4...please help me...now the 1st petition will totaly affect the second one who will be file on september..I dont know where will im going to start this mess...please help me,i dont have any idea..i am totaly block... :crying::help:

    How ironic life can be... There are people here who will do anything just to have their medical and interview appointments and yet here you are, scared and confused now that you have it. How I wish that appointments are transferable, you know what I mean?

    Everything is all in your hands now. Since the case is at US Embassy Manila, the best thing you can do is call them and tell them about your predicaments. Tell the truth. They might even give you credits for being honest. Tell them whatever happened to your relationship with your ex-fiance. Tell them that after receiving the NOA1, things went wrong and you never heard from him and about the case. Tell them that you are not going to pursue the interview and that you want it to be considered as cancelled. And then after that, tell them about your relationship right now with your current fiance. Tell them about his plan of petitioning you and ask them of any complications that may arise in the future. I'm sure (God willing), you will find all the answers to your questions. If I'm not mistaken, if the visa applicant didn't show up on the interview appointment, the application is considered abandoned. But you wouldn't want to just do that as your name and case will be in their records. That is why calling them is your best option as of yet.

    So you have a very short time to know each other well when your ex fiance apllied for K-1 visa (That's scary). I think you have to keep in touch with your ex before you new boyfriend will file another one. There's no problem with it for as long as your ex will cancel it at the USCIS. This is the first thing you should do but then I think your second K1 Application will be more complicated.

    If you will read above your post, it will tell you that her ex-fiance didn't cancel the application.

    yes..he filed k-1 visa..we arrangeD everything with the helpED of my cousin whos in california now.....i signED some paperworks and fill it all my information...i got CENOMAR,129-f form,biographic info in my G325form which is submitted in california...AND i know he filed k-1 as i remember, last july26..and after a cOUPLES OF WEEK he received NOA1..And after that..nothing hear from him... :help:

    Sorry if I had to ask... I have seen cases here where they were told by their ex-fiance that they filed K1 but the ex-beneficiary couldn't remember signing any forms nor submitting I-129F's requirements. Well, in that case, he did file for you. If he didn't cancel the petition, your case should have been in Manila Consulate by now (looking at your given dates of filing) and they should inform you about it. If only your case is at consulate stage, you have the option to cancel and not pursue it.

    To all: is it possible that the case can be abandoned if the petitioner received an RFE and didn't respond to it?

  5. You set such high standards Pushbrk!...I know i can rely on you to offer me constructive coaching on the rights and wrongs of posting! I think I would like to emulate your exemplary principles in regard to definition of whats allowed and what is not...May I seek out as many of your future posts as i can to learn from your excellence ?

    My mom was 17 and my dad was 18 when they married. It was a very, very short courtship. 42 years later, you could still see that they love each other very much.

    I've been to many relationships. Short and long term. If you think you can really get to "know" someone simply by knowing him/her for say five years, then I think you're sadly mistaken.

    In your opinion, what's the "standard" or acceptable lenght of time you have to know someone before you think you "really know" someone enought to marry?

    Pushbrk's point is that judgements have no place on this thread.

    The point I'm making is... Don't judge.

    I dont know why that is so hard to understand and why you seem to think its ok.

    i agree to you...my topic is not here to judge of anyone...each of your advice will help me alot about my visa processing... and whatever they said about my age or courtship...who care!!!i really appreciate the one who help me here...

  6. Yes this maybe visa journey but given the OP is 19years old ( which is quite young).

    I agree with with Ladynoles to some degree....you cannot truly know someone til you live with them, but i suspect you have a better chance of sucess if you invest more time during courtship period...."marry in haste repent at leisure"

    Thats not to say ALL short courtship relationships fail....some are very sucessfull happy marriages ( and good luck to them).......but i think when someone as young as 19 goes into one it is vastly different to when someone older is choosing a short courtship.

    Those who are married after a short courtship period and are happy,secure and content in their lives certainly shouldn't feel the need to take umbrage or be personally offended with anyone who has a different point of view.. the response to give would be something like ....

    " I hear what you say, you may be right in some cases however for me the short courtship was all the time i needed to know that this was the person for me to spend the rest of my life together"

    thanks alot.....im asking for what will i do on my case...not involve the age..niether the courthip period or etc...the main topic is WHAT WILL I DO TO MY 1ST PETITION..SO IT WILL NOT AFFECT MY 2ND 1..yes....it bother me..because it will appear on their database....this will be my 2nd time to be the beneficiary of 2 different petitioner... :wacko:

    And I am not here to judge but how can you want to marry a man or men lol that you dont even know?

    love isnt a game..less a mariage...

    Anyway if you are sure the petition been sent and is on completion..then the only thing is to cancel it which only your fiance can do.

    If theres none sent already theres no problem you nw fiance can apply for you.

    They met online November then personally in February. Sometimes that's all it takes to know someone enough to want to marry em.

    wow...my topic became hot...THANKS FOR ADVICE..I REALLY APPRECIATE IT..YES..WE CANNOT JUDGE EACH AND EVERYONE OF US...WHEN IT COMES TO LOVE..even UR YOUNG OR OLD..OR in a SHORT OR LONG COURTSHIP..it doesnt matter...when u want to marry a man..its BECAUSE U LOVED HIM ANd U KNOW HIM enough...to be ur husband...

  8. Your post is a lil bit confusing my dear. So...U mean your 1st FIANCE filed a k1 visa for you last year of july?then while on the process of the case you guys broke up?then last year of November you met a guy and he wants to file a K1 visa for u?

    You have to call USCIS and write to them and let them know what happened and you want to withdraw the application.im not sure if u can do it or your ex-fiance coz he was the one who filed it.

    Definitely it will affect your case if your new man will file now.Ask a lawyer for this one just to be make sure and to avoid any complications and unwanted issues to arise in the future.

    THE IMBRA is not an issue for you.Its only applicable for the petitioner not to the beneficiary of k1 visa.

    I dont hear anything to my ex-fiancee...So how can i fix everything??..My recent boyfriend now know about this but i want to fix it before he file this coming september..I try to contact my ex-fiancee to help me in this situation..but nothing...he changed his #.. :crying:

    Is there any way to fix it.???.It was a totally abondoned petitioned..He just ignore it :help:

    Me and my ex-fiancee met last march 2007 but were 2months in the relationship at that time..And then he filed k-1 visa last july 2007.We always had a misunderstanding AND when time goes by..on that situation,we decided to broke up because we knew that were out of love to each other..And then last November i met a very kind man..Matured enough to understand me.We met on 1st week of february and came back to his country after a couples of day.

    And he wants to file for k-1 visa this coming September. Does the 1st petitioned will affect this second one to us?He received NOA1 last august and nothing hear from him..just the last word"im just going to ignore it!

    I really dont have any idea in this situation..

    Help me to understand. Two different men petitioned for a visa for you. One earlier, who has yet to inform anyone that he will not go through with it, and now this new person has also filed a petition on your behalf? So you are wondering if there will be complications with the current petition since the old one, by another petitioner, is still in process?

    yes..two different man..one is earlier..and the 2nd one was planning to file k-1 visa in my bhalf this coming september..

    im wondering if the 1st petitioned will affect this coming second petition..my ex-fiancee received NOA1..he told me that last year b4 we broke up..and after that,nothing i hear from him..i dont even receive any letter after all that stuff..im wondering too whats goin on on that 1st petitioned because my ex-fiancee dont give me the case #,so i can checked it..but he dont give me our case# b4 we end the relationship...
