  1. Are you saying that they want information about your former spouse but you were never married?

    We got RFE'd for more info about my former spouse. So I may be able to help you with that. But give us more info: K1, K3, CR1?

    If possible scan the blue sheet and upload here to VJ so we know exactly what it says.

  2. We received blue paper on May 26. It was surprised that since one of document needed to resubmit is information about my former spouse that I never got married before and still in single status. My question is how to answer their question. Should I write explanation to them? My VJers, if you have sample of letter, please give me one. I am totally depressed and run without direction now. Thanks for all supports

  3. Hi,

    I filed a k1 fiance I-129a document in October of 2008. My fiancee got her interview in April 13 2009 and passed. She is heading over to the US on May 10, 2009. On her visa paperwork it says that her sponsor paperwork expires on May 8, 2009. Her visa does not expire until September. I am wondering, is the expiration of her sponsor documents going to be a problem?

  4. Hello, I have just joined this site... obviously and have been scouring the forums and guides. This is all very quite overwhelming for the both of us right now. I have flown to Hanoi, VN and currently living with my fiance. We have been in contact since January 4th,2009 and I flew here to stay with her on March 10th. Since, we have taken a trip together to Thailand and HCMC. We decided that we should start the K1 process ASAP so that she can come to America and visit with my family, etc...

    Anyways, my three main questions are:

    1.) Can I begin to file paperwork while I am living in Vietnam? At least the first package? I really would like to stay here with her during the process. My mother at home can supply paperwork for me and I don't mind mailing UPS/DHL back to america.

    2.) I currently am living off of my saved money (no job) and will be working in Vietnam within a month; (getting a teaching license to teach foreigners.)

    Does this affect the way I fill out my paperwork as far as financial sponsorship? I make more than enough to cover %125 rule, even over last 3 years.

    3.) Are there any Hanoians out there experiencing this or peeps in Saigon that would be willing to meet up and just talk this experience, hang out, make new friend?

    1. You can begin to collect papers, evidences (look at the guides from forum), ... and file ASAP (make sure completeness, detail since this one will be USCIS judgement). Since you just left US, you cannot file DCF (directly from ammbassy).

    2. For K-1, you must file I-134 later which requires financial supports (no cosponsor accepted). You may consider to get marriage and file CR-1. For that, your mother can cosponsor for you in I-864.

    3. There are 2 people from the north, as many as I know, and they all left VN. You can ask them for experience.

  5. I went to DHL site to track our package, and I think lucky-Kookie too. Of course the only way I have to know these are ours is by destination (Bangkok, Manila)

    Yes, I saw that too, about it being delivered. The only thing I'm not sure about is whether those are really our cases.

    If you scroll back, you'll see that Todd mentioned that I looked for the wrong shipping reference "EXP 12 MAR 2009A" - should look for 13 MAR instead, and it will go out in today (Monday Mar 16) DHL pickup. I'm not sure about that, since in past posts on VJ about DHL, I've seen the instructions to enter the PREVIOUS day reference to the day we were told it was released. That's what I did.

    Anyway, either it's there at the embassy, or it will be very shortly.

    I wasn't planning to call the embassy. I was just going to wait till my fiancee tells me that she gets Packet3 from them.

    I've already sent her everything - I134, tax returns, etc. And she' s already done the medical, police, single status long ago (back in Jan when we got our NOA2).

    So I hope we can turn around the Packet3 very quickly, and get our interview scheduled.

    Ron, I hope you are right about the dates. That would mean my case got to HCM last Monday instead of today and I am 1 week further into this than I thought. That would be a change in this process!!!!!

    And you can really get an interview in 4-6 weeks in Thailand? I am praying that we get an interview date in May! Mail delays may play a part of the wait, I think... :angry:

    I was released from NVC on Feb 26, 2009 and hope to have interview date in May also. Hope that we can meet and share a cheerful coffee in HCM

  6. I am a US Citizen born & raised and have on multiple occasions desired to get my Vietnamese Citizenship...so this is great news for me! :)

    Don't worry, you are automatically Vietnamese even you are US born if you have rich money and properties in US. After that, you are caught with unknown or stupid reasons, US government cannot help you even you are US citizen because you are automatically Vietnamese under VN laws.

  7. continue to wowswift: then go to tab "contact", see "message achive" and "voice message & call history", you can pour out all records. However, records are only save at the computer which you access, not other, therefore, go to C: drive the search "Yahoo!" then you can see message file, save that for later use.

  8. You can get your Visa when you arrive at SGN (Tan Son Nhat airport) if you are in hurry. When coming back to VN in last late april, my sister in law just buy ticket in 1 day (since her dad died) and got the same plane with me. She got her Visa about 15 min at airport.

  9. Today, Phuong asked me what she will be sent in the mail. What does she need to do? Sign papers and send them back? Fill things out? She wants specifics of what she will receive and I don't know what to tell her. Can you guys give me the scoop? Thanks so much, I hate to see her worry like this.

    katej0203 was faster than rest of us to give you all needed things. Go to that website and you can do it yourself. Better to delay for collecting evidences than later you get RFE. Good luck for your journey.

  10. USCICS won't accept any things unless they asking for. You should repare a copy: when USCIS asking for you submit. If USCIS approves without asking, you still need to submit it to HCM consulate in VN when they send out paper to compete. The last thing is bring your original paper to the interview.

    According to the instructions in the I-129f, you have to request a waiver if you have file two or more petition in the past or had a previous K1visa approved in the last two years before filing this petition. To request a wavier you have to submit a written request with your I-129f and document to show why the wavier should be granted.

    There isn't a form to fill out but you should treat this as you would your proof of having meet in person and proof of your ongoing relationship. Your request should clearly and completely say why the other I-129fs or previous K1 visa didn't work out and why this one will. Then have evidence to back that up. For example, if your earlier I-129f was submitted for a different fiancee, what happened in that relationship and why, was the I-129f cancelled or denied, etc. You would include emails, letters, court documents if applicable, USCIS and Consulate documents, etc to explain what happened.

  12. If you are serious about this, you need to cancel the other application. I think you will need to file for a waver when you file your second I-129f. Also the HCMC Consulate is very picky. You need to have as complete as possible picture explaining your canceled petition and why you feel this women is the right one. Then you need to show enough evidence that this new relationship is the real one. Going to visit her is a good idea even before you cancel the other petition. You have to build a strong case for your relationship that meets the guidlines the Consulate has. You have to have a relationship that a reasonable person would believe is real based only the evidence you supply in your I-129f and at the interview. The key to a sucessful visa is in your I-129f petition not at the interview. At the interview the Consulate checks your story with your fiancee. If everything is believeable in your I-129f and what she says at the interview, you get the visa, if not then you get a blue slip, green slip or outright denial.

    If you do everything right, you'll get it on the first try.

  13. Hello every one.

    My fiancee had her interview at the HCMC Consulate on Thursday the 24th . We thought our documents were really well prepared. We 've been through every thing several times, made sure we had everything in order. We also have ME is our lawyer for the case from start. We had plenty of evidence and it was well documented, my fiance listened and practiced sample questions prepared by ME, but after the interview, she came out with a blue slip. Here is list of what US consulate in Ho Chi Minh asking for:

    1-petitioner: Please provide the full name , current address, and date and place of birth of your ex-spouse. Provide evidence of his/her current address. Also pelase indicate when your ex spouse immigrated to the united states. Did he/ she imingrated with you? Did some one sponsor him/her? If so, whats their name? Did she come to the US by boat? If so please indicatewhen he/she left Viet Nam. Through what camp he/she immingrated

    2- Applicant: Please provide the full name, current address, and date and place of birth of your ex-spouse. Please provide evidience of his/ her current address

    3- Petitioner: Please provide us with a proof of the airlines tickets you use to visit Viet nam. If the ticket were purchased with a credit card, please provide a copy of statements showing who purchased your airline tickets to visit Viet nam ( copy of statements are available from credit card company ) . Each staement need to clearly indicate the name to which the credit card is issued , the purchased date and cost of purchase. If ticket were purchased with cash , please provide the bank statements of the withdraw include copies of the three months priors to and immediately following the purchase. Submits for all trips to Viet namthat you visited your fiance spouse. We do not want the receipt you were given by the travel agency. Submit a letter of explanation if you were unable to provide this documentation.

    4- Applicant: Submit a list of all of your relatives in US . For each invidual , please list they full name, other name used, date of birth , current address, address for the past 5 years, relationship to you, date of immigration to the US , measn of immigrations to the US, and any contact/ relation ship they have had with the petitioner or anyone the petitioner is related to. Also submit each of invidual’s residency or citizenship status.

    5- Petitioner: In a sworn statement, please provide a list of your previous address for the past 10 years. Please list all persons who have resided with you. Please explain if any one you have resided with is related to beneficiary;

    I had everything done and notary all documents, I will Fedex to Viet nam by Monday, I will update my case later, hopefully Mr ME can help us push the case go thru . I have all my question up here so who ever have coming interview day know what you should expect to have and prepare with your interview, try to think that if missing one of these documents will be a big trouble thing for your case. I dont know if any one else has the same situation? can we share?
