  1. Hi all, I am so ecstatic to finally get my I-797 in the mail today. It says the above petitioned has been approved. It also said that The petition indicated that the person for whom you are petitioning is in the US and will apply for the adjustment of status. That's when the problem kicked in because my mom is in the Philippines. The next paragraph says if the person decides to apply visa outside the US, I need to file form I-824 so I was in the impression that I should do that instead although it seems like something is wrong cause I-824 is basically a request for NVC to determine which consul my petition will be sent. I checked the copy of my I-130 and I filled it out correctly so I contacted uscis, took me 30 mins to get to an operator, I reported the issue and I was told that they will look onto it and it will take 45 days. Is that normal, why should I suffer for their mistake? I was also asked to call the NVC since the visa is already approved, she doesn't really know if they will be able to help me. Anyways my question is, sine this petition is already approved, is there anything I can do in advance while waiting for them to send me a corrected notice and us that notice even gonna matter? I am just so lost right now, instead of celebrating i'm freaking out! Is there anyone of u had the same problem and what action have u done. Thank u so much for listening, any advice is aapteciated!

  2. My dad didnt get his original green card, it was sent back to USCIS and was destroyed so he applied for a new one. After a week of us sending our application for a replacement we already got his biometrics appointment. It took him a while to finish his fingerprinting because his hand is really sweatty but the technician told her that it is okay and there are a lot of people with the same issues. After two weeks, we received an ASC appointment to have his fingerprint retaken. The problem now is he is moving to another state in a week after this appointment and is going to do a change of address the day he gets there. He got a nonrefundable flight so we cant cancel (or else we have to pay almost the same amount of the ticket for changing the flight) and move it an extra week for us to be sure if they need him back for a 3rd re print. My question is if this 2nd finger prints are going to be rejected again, does he need to go back to the original place where he got fingerprinted the first time or will they automatically change his fingerprinting location to where he is at at the present time. Any information will help and im thanking everyone who'd be reading this in advance.

  6. 2 is wrong, you file independent petitons for them, your brother will have a very long wait.

    Usually it would be much quicker for one of your Parent to file for your Brother.

    hi boiler, my dad only has a permanent resident visa now and i know that he can already file a petition for my brother however i heard that that takes time as well? what are your thoughts on derivative beneficiary, it looks like that is the one the girl i spoken to in uscis is talking about (answer 2)? my dad and i are also trying to figure out if he can just use this to make my brother follow. heres the link i just read, let me know what your thougths are on this please, thanks.

  7. The only way you will not have to pay is if the Greencard was returned to USCIS from the old address... if it was never returned then you will have to pay for the new card.... this happened to me... mine was lost in the mail...

    Hi Kez, yup it returned according to the uscis person my dad spoke with in the service center and they wont admit it but it is actually their fault,my dads social security actually got the right address and from what i understand they got those information to the homeland security as well. hopefully they wont reject it and ask for the payment and all that stuff. by the way kez, when you did yours did you just use efile and do you still have to make an appointment to the local service center to pay and do biometrics, thanks.

  8. my sister where my dad is supposed to reside in when he gets his visa approved sold her house and bought a new one, at that time she did the change of address for my dad. my dad got here a couple of months after my sister did the change of address and he waited for 8 months which was adviced for him to do in his welcome entry letter for his green card but didnt get it. He then made an appointment to a service center to follow up and then he was told that it was sent to the old address and he was asked to do an application for I-190 for replacement of the green card and asked him to pay the fees and to do that he needs to make another appointment. I researched on this because i think its unreasonable since they are the ones who made the mistake, since their system wasnt able to update my dads new address. i found out that you dont have to pay if the card was never received and was returned back to uscis according to the instructions for I-190. I clarrified this to the agent i spoke with in the uscis hotline and was told that my dad doesnt need to pay and he does not have to actually go phisically to the service center office to apply or do anything else, that i only have to send the application to the lockbox in los angels and also send a copy the the uscis who processed the visa which is in laguna niguel because he was petition by my grandfather in guam. Since i got two different answers i wanted to know which is correct coz my dads visa is expiring and we want to get over this problem. In the meantime, ive sent the application to the both departments, i dont know if they are going to return it back and ask for a payment but i want to see now what your experience is so i can send it again with the check if needed, thanks.

  9. i decided to join coz i called uscis a couple of times but i got different answers to those i talked to. its very frustating coz it takes me at least 20 to 30 minutes on hold to not getting the answer that i wanted, i know you have been in the same situations before. okay here are my questions and i have also included the answers given to me:

    1. do i have to file for a seperate I-130 for my mom and my brother who is a minor (17 yrs old)?

    answer 1: yes, you have to file I-130 for both of them and pay seperate fees.

    answer 2: i think she could bring the son with her but you have to indicate that your brother will be accompanying her in the affidavit of support but you could check it in your US embassy or consulate in the Philippines if they will allow this.

    if answer 2 is correct, then how do they do this, does my mom have to bring my brother in her interview? is there any other requirements for him to do like medical exam? and also what are the qualifications of the accompanying dependents of the principal immigrants? is illegible depended means not married and under the age of 21 or can my mom also bring with her my sister who is over 21 and is married, will she still be okay to join my mom? if there is a link specifically for this issue can you pls send it to me to, i have been searching this topic to uscis webpage but to no success.

    if answer 1 is correct though, do you think if i will petition the two of them at the same time that they will get approved at the same time, they say parents are easy to get approved and sibling that are under 21 and are not married or should i just let my dad petition my brother when he gets his green card, will it be easier if it is an underage son, please give me your thoughts in this. thanks.
