  1. We just had our AOS interview in Minnesota. The interview was short and we got approved!

    The officer didn't ask to see any documentation at all. I was really surprised. All the time we spent collecting the evidence and nothing was needed. However, it is better to be prepared than not. Was it Friday afternoon effect? He first interviewed me asking how we met, where we got married, and where we lived. Then he called my husband and asked him exact same questions. Then he went over the forms with him asking questions about communist and terrorist organizations. Then the officer said that we were approved and the card should be coming in the mail in 3 weeks.

  2. I don't know how complex your taxes are, but you might want to try something like H&R block, they should be completely familiar with non-resident returns and should cost less than $600!

    I used to volunteer to help international students with their US tax returns. Some of them brought their previous year returns from H&R with lots of mistakes. I think H&R is good but not for non-residents.

  3. My confusion is as follows: Is a person NOT required to pay Provincial (Ontario) Tax when one has emigrated?

    The reason this question came up, is even though I know that I have to prorate my Ont Tax Credits to my leaving date, when I do U-file there seems to be no evidence that Ont Tax is calculated (on the summary page) probably due to the fact that I do not live in Ont as at Dec. 31. How does one reconcile Ont taxes to be paid when it seems the software does not calculate this without a province of residence. My dilemna.

    why the taxes are so confusing. I talked to accounting firm in Canada that specializes in international taxes and they charge the minimum $600 for a return. That bites....

  4. Does anyone know good software that can correctly prepare Canadian tax return for deemed non-resident who will be filing US tax return as resident?

    I'm going crazy tonight. I already tried mytaxexpress.com and no go there. No selection for non-resident.

    Then I tried ufile.com and they can only do full year non-resident.

    Now I'm looking at QuickTax and it does have the option for deemed non-resident but it doesn't seem to do it right. Maybe I'm entering something incorrectly?

    I'm OK with filling out paper return myself but I'not sure how to claim tuition credit (whether it is even allowed).

  5. If I do my Canadian Tax Return and file there and claim my school tuition I shouldn't do it in the us right?

    as a us non-resident for tax purposes in 2007 you can't claim tuition benefits in US. You should claim them in Canada but with no income in Canada there is probably no benefit except for maybe next year. You can also possibly transfer your education benefit to your parents or grandparents.

  6. do you have to go to the border to fill out the car import paper work if you are already in the US or can you do it somewhere else? It will be a 6 hour drive for us which I'd like to avoid. Thanks.

  7. I was a student last year in the us...I didn't work in Canada or the US....Do I need to file taxes as I had no income? I thought I didn't but now I want to double check.

    Also Since were in the AOS process I have basically no id in my married name yet...is there any place in Canada I need to contact about the name change? I have closed my bank account , and I never got my actual license there.

    you have to file Form 8843 in US as a student with no income.

  8. He came with the intent to work. As I undersand the rule of the TN he would have needed a job offer to obtain it. If he followed through and took the job he was getting the TN visa for, then that is all the proof you need: his TN visa and a letter from his employee. He didn't came to marry you; he came to work and he has proof of it. So don't worry.

    My brother in law came with a TN to the US, he worked here for year with a TN, got married to my husband's sister. He waited a while, but in the end he applied for a GC. He is now an american citizen and as far as I know never had a problem.

    thanks for your reassurance. I feel better now. Did anyone on this board also adjust from TN but perhaps wihtout waiting a long time?

  9. A couple other things that I just remembered - he didn't sell any of his furniture but stored it at his parent's house. Not sure if it is possible to prove it. But it is sitting in their basement and garage and they are not using it. He also didn't disconnect his cell phone when he moved to US. Would that info help?

    He came on a TN visa, so to my understanding it is not going to raise red flags like coming on a tourism visa or the visa waiver program. He obviously came for a job and not to get married. I'm not all that familiar with that visa, but don't you need to have a job offer to get it/ If you do I would think that's enough proof that he didn't come with the goal to be married.

    TN is a temp work visa with no intention to immigrate so it is kind of like tourist visa.

  10. thanks for the info. He doesn't have a house or lease back in Canada. We listed his parent's address as his last address. He does have a bank account with some money closed for a year that he still can't withdraw plus he is a graduate student at the university in Canada. do you think this will be sufficient? Maybe his parents can write something that he rents a room in the house? Will it help?
