  1. I don't think you need your birth certificate if you are filing for your spouse to come to US. If you are US Citizen and filing for your spouse then you need documents to establish your relationship with spouse. If you have US Passport copy and Naturalization copy that shows you are US citizen and will need marriage documents to prove relationship with spouse. If it is not urgent for your spouse to come to US, I suggest filling for normal I-130 instead of the Fiance K-1 or K-3) visa.

  2. Hello Everyone,

    What is the next step for the people who have their spouse's K-3 visa approved and their spouse in the United States.

    My wife and I just return from India and I'm not sure what are my next steps to follow.

    Do I have to go apply for SSN # or does it come in the mail in 3 weeks like I was told by the embassy?

    Can I start the AOS process and where do I send that information?

    Is there something else that I need to be doing or a link to get more information?

    The embassy will just forward the I-129 packet to the foreign embassy and the foreign embassy does all the paper work. The I-130 packet stays at the NVC and they do all the paper work there.

    In my case, I found out yesterday that the I-129 packet has been forwarded to the embassy in Mumbi.

    Now, my wife just waits for the paperwork from Mumbai embassy.

  4. Hi,

    I've been calling NVC for the past four days to to get my case # for the I-129F & I 130.

    They received the I-129F at the NVC on 5/19 and they have forward it to the foreign embassy on 5/21.

    As of today they haven't recieved the I-130 at the NVC. NVC told me to wait until 90 days.

    I have called the USCIS and visited the local office in my city but, they weren't able to give me more information than saying the I-130 has been approved. They weren't able to tell me if the I-130 has been forwarded to the NVC or not. I'm just worried that my I-130 is just going to sit somewhere and not get forwarded to the NVC.

    Since, my I-130 has been approved for my wife I would like to go with the I-130 route instead of the K-3 route. At same time I don't want to cancel my I-129F and not know when the I-130 will make it to NVC and when my wife will get a visa interview.

    Does anyone have any advise on how to let NVC know that I would like to go forward with my I-130 but, at same time not to have K-3 cancelled incase I-130 doesn't make it there in a reasonable time.

    Since your I-130 and I-129F both have been forwarded to the NVC, what route are you planning on taking. Do you know what you have to do if you want to go with the I-130 route?

    Received hard copy of I-129F & I-130 approval yesterday.

    I'm reading the I-130 approval letters and its states

    "The above petition has been approved. The petition indicates that the peson for whom you are petitioning is in the United States and will apply for adjustment of status. He or she should contact the local USCIS office to obtain Form I-485, Application for Permanet Residence. A copy of this notice should be submitted with the appliation."

    "If the person for whom you are petitioning decides to apply for a visa outside the United States based on this petition, the petitioner should file Form I-824, Application fo Action on an Approved Application or Petition, whith this office to request that we send the petition to the Department of State National Visa Center (NVC)."

    "The NVC processes all approved immigrant visa petitions that require consular action. The NVC also determines which consular post is the appropriate consulate to complete visa processing. It will then forward the approved petition tot that consulate."

    Did you get letter similar to this, correct?

    #1) In which case it is saying my wife is in the United States or I need to apply I-485 after she gets in the United States.

    #2) It it also saying if I want to apply for I-130 at this time, I should contact NVC and let them know and I should file I-824 to forward the file to embassy in foreign country.

    Is this what you understand to be?

    My I-129F & I-130 were approved and sent on May 9, 2008 but, still haven't received the NOA 2 hard copy as of today.

    Ralu&Doru,

    My questions was how did you find out that your file was received by the NVC and it had left the embassy. And how did you get the case# from NVC.

    Did you get an e-mail or did you call the NVC?

    Regarding the going K3 or CR-1.

    Don't you have to go the K3 route? I thought the CR-1 file just sits at NVC until you file for the adjustment of status after your spouse gets in the U.S.

    At least thats what I thought.

  7. I'm not sure what happens when both application are approved at same time but, I'm going to start gatthering all my other documents in the meantime.

    I'll also start doing some research this week and find out what exactly needs to be done.

    I want to say our next step is to wait for our spouse to receive documents from the embassy.

    I got e-mail from CRIS with having both of my applications being approved.

    On May 9, 2008, we mailed you a notice that we have approved this I130 IMMIGRANT PETITION FOR RELATIVE, FIANCE(E), OR ORPHAN. Please follow any instructions on the notice. If you move before you receive the notice, call customer service.

    Application Type: I129F, PETITION FOR FIANCE(E)

    Current Status: Approval notice sent.

    On May 9, 2008, we mailed you a notice that we have approved this I129F PETITION FOR FIANCE(E). Please follow any instructions on the notice. If you move before you receive the notice, call customer service.

    My timeline was similar to Ralu & Doru, and it looks like we also got our approval notice around same time frame.

    Hopefully, all other February filers will start receiving same news as Ralu&Doru and I.

    The next step begins for us and GOOD LUCK to rest of you in getting your NOA 2.

  9. Wat's up with the USCIS website. The processing dates haven't been updated yet. It still shows February 15 as its posted date. They need to put the updated processing dates for the month of March. This processing dates are good indication of how fast the files are moving. Hopefully they update the dates so, I can stop checking thier website every hour for the update.

    Even though I had sent my I-130 and I-129F together, I decided to send out my I-129F package separately after I received the NOA 1 for I-130.

    3/3/08 - Received I-797 letter in the mail for I-130

    3/4/08 - Sent I-129F package through UPS

    3/6/08 - Delivered at CSC

    3/10/08 - Received I-797 letter in the mail for I-129F

    When I read the letter what was shocking about it was that the Notice Date on the letter was same as the date it was delivered.

    Now wait until 3/17/08 to see the updated processing dates for CSC & VSC.

    Ignore my previous post and see if the following make sense.

    Do you think it is a good idea to add a column for the I-129 people with a column of I-130 sent date and Service Center? It might be also good to add column for service center for I-130 people.

    Because the I-129 sent date is not same as the NOA I date. My notice date on the letter is 2/27/08 and I didn't received the letter until 3/3/08 and I won't be able to send the I-129F packet until 3/4/08.

    Even though I sent the I-130 and I-129F together, I plan on sending a new packet with all of the same documents specifically for I-129F to my designated service center.

    Name I-130 Sent Date NOA 1 - Notice Date I- 129F Sent Date Service Center
