  1. I'm filing a waiver based on divorce as did many others. As a matter of fact, Oban just got approved on a waiver without interview. His evidence was extensive. Personally, if you cannot reconcile your marriage, file the divorce as soon as you can. As soon as you have your divorce finalised, you can file for ROC without waiting until your 90-day window. Best of luck to you.

    so if i wait for the 90 days b4 the expiration of the GC better or just file it now?

  2. so finally i got my welcome letter for i485 and i m now waiting for the green card to come on the mail.

    it was really hard i got my second interview and i was thinking it will be easy and for a few mins but it was so long.

    first, my interview was at 8am .i went there with my wife and my attorney and he called my wife only and spent with her an hour !! and than he spent another hour with me and he asked about everything and finally he approved my case.

    anyway thank god and thank u all guys for ur help i really appreciated

    That really stinks sasa - I would have felt the same way after waiting just to be short a few weeks. Of course the up side is you get to get past this part of the process. Good luck!

    i got some new news .i don t know if it s bad or good.

    as i mention b4 .i was married in nov 2006 and i applied for i 485 jan 2007 and fingerprint feb 2007 than my interview was in july 2007 and i was approved but fbi name check than they ask me to renew my fingerprint on augest 2008 .and now they r asking me for second interview in the end of october 2008 which is b4 my second anniversy by couple of weeks !!!!

    so that mean that my name check is cleared but if i took my approval on october i will have the conditional card which is for 2 years not the 10 years!

    and all of that for couple of weeks ........i m happy coz i m almost done and in the same time feel depressed coz after 2 years waiting i will still get the conditional one!

    i really don t know what to do .and i don t want to go immigration again after 21 months and wait again.

  5. I dont know how to explain this very well but hopefully someone will understand what im talking about. My husband and I have almost been married for

    two years and waiting for his permnant residence. We had completed an interview maybe a year ago and than he had to update his finger prints and he

    said he wanted the second interview after our anniversary so he wouldnt have to reapply for I think he said ten years. Of course they've set up the

    interview 2 weeks before our 2 year anniversary. So I asked the attorney if we should ask them to change the date but she said it would be risky

    because they might postpone it for another year. Does anyone have a similar experience or advice. Thank you

  6. Two ways to go. One contact a good attorney (gonna charge between $2000-4000). If you are poor like me :( go do some research. Search for pacer on google, create an account with them download some cases, study how it is done. Go down to the federal court closest to you, get a pro se package, start compiling documents and file in the court. It takes alot of time and a wholeeeeeeeee lot of effort to do this by yourself. Remember, your intention is not to fight with anyone, you just want the court to order uscis to work on your case.

    wow,i think it will need lots of work:) but i think thats better than to pay from 2k to 4k:)

    i will begin searching .

    i m thinking about sue the uscis how can i sue them ?and what is the conditions???

    Why don't you get a congressman involved first. I'm thinking that attempting to sue them is not going to get you the outcome that you wish for.

    i already did and nothing changed !!

    i want to know the details of writing mandamus how i do it?

  8. i m married to us citizin.we been married since nov 2006 and i applied for i485 at jan 2007 and interview was in july 2007 and i was approved but name check background.in june 2006 i got RFE and i sent them the papers .at augest 15th 2008 they ask me to renew my biometrics and it s done .and now we r in the 9/19 and nothing even no touch since the biometric .do anybody know what s next ?and when?

    Most likely an approval notice followed by a green card in the mail.

    wow.i hope the approval will be in november 2008 so that i get the 10 year card

  10. I'm not getting into the big story but just want to say that finally my husband must be out of FBI name check. We are schedule for his 2nd interview on October 8, 2008. We had an interview on the AOS on September 5, 2007 but it was not approved pending investigation. They contacted us by letter this week and set the date. This is it! Going with attorney this time also! So they are finally processing those in name check for 2-4 years. Yeah!

    coz i think i m the same situation and i just did my 2nd biometric and i think they will ask me for new interview?

    We just got a letter yesterday that he will have to fingerprint again since his last set of fingerprints he did last year expired. He goes on 9/2.

    so u got both letters together?

    Applied for aos June 2006, biometrics July 2006 interview sep 2006... No approval because of pending namecheck

    Feb 2008 new INS rule re back log of namecheck more than 180,,,,

    Request for re fingerprints march 2008

    Case is now being moved to Santa ana for interview.... Yes again

    .....

    I have only seen 2-3 cases like mine

    I'll have to bring with me again everthing I brought lasttime

    2 ppl said it took them 5 minutes in and out

    my wife is us citizin too. and i applied for AOS in jan 2007 and my biometric was on feb 2007 and interview was july 2007 .approved but name check......

    In june 2008 i got RFE and i sent them the RFE in a week and now i got today biometric again . i don t know whats next??

    and i went in an infopass from 5 month and they told me my name was cleared from fbi..........and in june 2008 i got RFE !!! and i sent the paper and nothing update in my case .............should it be also lawsuite the uscis???

  14. i applied for i-485 and i-130 in jan 2007 and my interview was in july 2007 .and i was approved butwaiting for fbi name check.i waited till now june 2008 and than i received RFE from the uscis about needing some documents to prove that our marriage wasn t based in immigration benfits???

    so they just remmebered that after year and half!!!

    is that good for me or not and does it mean i m almost about to get my card???

    is any body got the same situation .share experience plz

  15. Many many people have sued via Writ of Mandamus for the greencard stage. USICS effectively shut out that "loophole" with the new regulations December 2006. Up until a few months ago - most cases were simply thrown out due to the newly written regs - however now, with the most recent change in greencard processing the chances of having your case heard is next to none. They will simply cite the new mandate and send you on your way.

    Essentially you have 2 changes working against a successful lawsuit case. All in all - you are pretty lucky to have a solution as is my husband. You just have to be patient. Alternatively - try to sue via WOM if it makes you feel better.

    i m really thinking about writting a mandamus.but is it having rules or conditions to do? also ,how much it can cost me?and how long it takes?

    It depends. If you file pro se (no lawyer) I do not think it costs anything, however with legal counsel (and with everything stacked against you you do NEED one) I have been quoted everything from $2,000 to $6,500.

    Why would you do this? You have a mandate that states you will get your greencard regardless if your namecheck isnt completed. You are not standing to wait years on end like other people.
