Hi everyone,
my wife is about to file i-130 for her father, we have all the forms and doc ready. However, she has a concern regarding her father's current residency issue. Her father was born in China and he is still a Chinese citizen, but he moved to Hungary back in 1996 and lived there since then with a permanent resident card (they call it blue card). Therefore, will he be scheduled for a interview in China or Hungary? What about contact information?

So she can not even file AOS for her mother any more? If there is no Deportation Hearing scheduled, then she can do AOS even her mother overstayed, right?

Wait a minute, is your mom here in the states? If so, You should file I-130 and I-485 concurrently, her overstay will be pardoned since this case is for a immediate relative of US citizen. However, she can not leave the US until she has Green Card in hand, otherwise the 3 yrs or 10 yrs ban will be triggered.

Yep, I forget to mention on the above post. Both of our birth certificates are from Chinese Notary Public Agency.

For those letters that my friend made statements, do we need to notarize them? or just simply sign them?

Hi all, my mother entered into the US 8 years ago with a B1 visitor visa, then she overstayed after the her I-94 card expired. I'm a US citizen now, so I am going to apply AOS for her.
Here is everything I have to file, please help me check:
I-130 form file by myself, check of $355, with my Naturalization certificate, my birth certificate stating the relationship with my mother, and my mother's birth certificate.
I-485 form filed by my mother, check of $1010, with copy of her birth certificate, copy of her passport, I-94, Visitor Visa and entry stamp, my naturalization certificate, my birth certificate, form G325A and 2 photos, I-693 sealed by a civil surgeon.
I-765 form filed by my mother, with copy of her passport, I-94, and her visitor visa and entry stamp.
I-864 form signed by myself, copy of my naturalization certificate, a letter explained I was a student and didn't file tax for the past 3 years.
I-864 form filed and signed by my American citizen friend as a joint sponsor, a letter stating that he understand the laws and is willing to help me on my mom's case, copy of his US birth certificate and US passport, IRS tax transcript of 2007 and 2006, a letter explained he was a student during 2005 and no tax filed, his current employment letter, and some of his recent pay stubs.
Did I miss anything?

Hi everyone,
This is for a friend of mine, she just became a US citizen, and her mother came to US about 8 years ago on a B1/B2 visitor visa, then she started overstaying here since 2002.
I understand that her mother will be excuse for her overstay if her US citizen daughter files AOS for her, and there should not be too much problem for her to obtain a EAD based on her AOS pending.
My question is how about the I-131 (AP)? will she be eligible for an AP? Since she overstayed here more than 1 year, will she be punished by 10 years banned to enter US again?

Here is update from today: I call the NVC number, the rep. told me on the phone that as long as I can provide evidence that I am currently full-time employed and have enough income to meet the 125% poverty line of my proper household members, I should be fine. asset is optional, but I guess it will never hurt me for provide extra evidence to prove that I am able to sponsor my mother's immigration case.

I do have employment letter and copy of pay stubs ready for my current job, the only problem that worries me is that since this job started by the beginning of this year, so I don't have any Tax documents yet...

I did get the bank letter stating that When the account was opened and how much is the balance, and also I did have the deed of the property and the proof of the current net value of it.
Just worry about the current employment and don't have proper tax document of it yet...

Hi everyone,
I am in the process of filing AOS I-864 forms and supporting document for my mother's IR-5 case with NVC.
The problem I have now is that I just graduated from College last year, and my previous job from 2005 to 2007 was a part-time one, so the income was NOT enough and I did file tax on those years. However, I do have enough asset (bank account and Real estate).
Now, I got a new job this January earn enough income to sponsor my mom, but I dont have any tax document for it yet, all I have now is employment letter and pay stubs to prove it.
Is this going to be ok? Should I write a letter to explain this situation?

Yes, you need to send her Birth certificate, no pictures are needed at this point of process, I didn't include my mother's marriage certificate, it's not needed.

I just did file the petition for my mother, your check list is fine, but NO need of the G-325 or G-325A for parents' petition.

Hello, is there anyone that can help me on this question? I would like to find out what type of processing center is the Guangzhou consulate in China.
What is the main different between those two? I kinda knew it's something regarding the Form DS-230 (Part I or Part I & II), how about supporting documents? Any differences on those?

My wife just called the USCIS, the officer told her they are currently processing application back in Jan. 2006????

Please check my post, my father took the test back in June 06, still waiting for oath. I guess USCIS just not doing anything, sitting on their lazy @ss and drink a cup of coffee everyday...

I just called the USCIS, the officer told me he put in a service request, and give me a ref# WTCxxx. He also told me if I don't hear anything back from them within 30 to 45 days. I should call back with the ref#. Are they just playing the same old waiting game or really doing something for me this time? Anyone has similar experiences? Please help me on this...

He is Chinese. I have heard some other similar stories related to the FBI background checking... I really don't know what the heck are they doing? They take 2 years to check some good people, but never can catch any bad guys.... It's so messed up...

My father took and passed the citizenship test about 2 years ago, and he is now still waiting for the notice for the oral ceremony. He has asked the local Congressman sending letters twice already, every time the USCIS answered with the same result: It's still within the "normal" process time frame, they are still working on it? Working on what?? I really don't understand now.
Can someone please help me on it? What should he do now? Any method to speed up the process?

So when we filled out the I-130, we just used her father's current address, which is the one in Hungary. Her father already had his birth certificate and marriage certificate done. When NOA2 comes, He needs to start getting Police report from both Chinese and Hungarian police authorities.
