    First rejection -- Consulate has doubt that my relationship was fake. Didn't provide enough evidence. After 1 yr, we have provided enough evidence... No more doubt. It is about 10 yrs diff. She is in her early 20's, I am in my early 30's. Is this a big diff? I am a U.S. citizen since Dec 1998. I have an IT job in the last 10 years after college.

  2. Please answer me how many interviews does the Consulate Officer need before they can issue my fiancee a visa?

    I petitioned my fiancee from Vietnam in March 2007, got the first interview in Oct 2007.

    Got rejected with a blue slip, with the help from lawyer M.E. got another interview in Oct 2008. That is waiting about 1 year to get the second interview. All the paper works and documents were expired, my fiancee has to redo it. After the second interview, they returned the previous items showing the support of the relationships such as pictures and other stuffs that they don't need. They only keep the documents. Now that my fiancee handed all the necessary documents i.e. health, flu shot, DS156 etc, whatever listed in the blue slip in the second interview. Now, they didn't give her any more trouble, no more blue slip or anything like that. They are not rejected any more. They told my fiancee to go home and wait for another interview.

    What is there to interview again? Omg, consulate officer has so much time on their hand. I wonder how many interviews does she have to go through? My cas has been almost 2 years already... Fiancee in vn doesn't do anything, such a waste of time and life...

    Can someone tell me what is the wait time between the second and third interview? Will they ask for more evidence during the third interview? Why did they return the supporting evidence? I am so disappointed how the consulate works in Vietnam. I don't know what else to do other then wait, wait and more wait ... Omg, life is too short to wait. Please god, consulate officer in Vn help me out !!!! We have been suffering enough this path of life.

    Every problem there should be a solution to it. It just takes a long time. I got used to the single life, so waiting for another number of yrs won't hurt me. Whenever the right time for her to come, then she comes otherwise just wait. If congressman can't do much, lawyer is next. If lawyer can't do sh!t, spouse visa is next. If spouse visa can't do sh!t, then I retire in vn with wife :)

    Please read question #18. I know what I said from the beginning wasn't what I intended in the application. As I look back to that question, I should explain more in details that I didn't have any relationship until 2006. That is the fact. The problem for me now is that there is no way I can convince the CO now.

    My case is scenario #1 but who is there to listen to me? It is hard unless I need a lawyer like many of you guys recommended. I never hire a lawyer and won't know what will be the outcome?

    Yes, I gave them phone calls, yahoo message chats, pictures of the engagements. Those they think were not good enough. I have no other things to give. Of course, airline tickets and passport date stamped to prove the visits. Never enough to the consulate officer. They are challenging me if I am really in a committed relationship. I know I have done all of these petition by myself so there are mistakes. Now, I just have to deal with it. I will get my Senator involve if that doesn't help, lawyer is my next step. I guess I am not in a rush to get my fiancee over here. I got used to live a single life in the past 15 yrs since college life :)

    By the way, there was a sad news from my old college campus yesterday. A gun-man shot 6 students and himself. Omg, god bless Northern IL University students !! My condulences to all of 'em.

    I am trying to get my Senator involve to see if anything they can do first. If not, lawyers are there for ppl like me. I know they want tons of evidence I can never submit enough to the CO. Actually, Vietnam is a corrupted country and many ppl are faking the relationship that affect me as a real one. If I were to petition a fiancee from Frence or other European countries, I don't think I have to go thru. this trouble. Another stupid reason is that I should NOT engage with anyone from far away Vietnam even though I am a Vietnamese. Oh well, I am totally stuck with this mess that I created.

    What is the appx cost to consult a lawyer with my current case? Anyone can give me an estimate? I don't mind to put out couple of grands but I want it to be successful, not a failure.

  7. Honestly I'm starting to think that you're a lost cause.

    The only way that you personally are going to "convince the consulate officer to re-consider [your] case" is to provide the evidence they are asking for. But you can't provide that evidence because your meeting in 2004 never happened.

    So your question really boils down to "is there any way I can convince the consulate to believe my lie?"

    Call that attorney. You need someone else to do the thinking for you. You clearly are not up to the task.

    Meeting her for the first time in 2004 wasn't mean that I was falling in love with her. I broke up with my gf here then I went back in 2006 to fall in love and petitioned her in March 2007. I didn't explain this in detail of question #18.

    My answer: Yes.

    Describe the cuircumstandes under which you met.

    I simply put:

    Ms. Smith is a close friend of my niece. I was introduced to her during my visit to Vietnam 2 yrs ago.

    What I meant is that I was introduced to her 2 yrs ago (2004) but I still have a girl-friend here in the u.s. at the time. I didn't really falling in love or have any commited relationship with her until the second trip in Dec 2006. Starting December 2006 is the time that I was falling in love and petitioned her in March of 2007. That is why I only have evidence of supporting the on-going relationship since December 2006. When consulate officer asked for evidence since 2004. I was stumble and have none whatsoever. Is there a way that I can still convince the consulate officer to re-consider my case? If I need to fly back to Vietnam again to meet with the consulate officer. I am willing to do so. Please advice. Thank you much!

    Here is the rejected letter says:

    The Consulate general isunable to issue a visa to you b/c you have been found ineligible under the following sections of the u.s.s immigration and nationality act, as amended:

    Section 2219g) of the act pprohibits the issuance of a visa to anyone who has failed to present the documents required in connection w/ the visa application or who has failed to sumit sufficient credible evidence to support teh clamied pettiionable relatiosnship. The lollowing remarks apply in your case.

    Consular officers apply a 'reasonable person standard' when evaluationg the bona fides of cleamined spousal and fiance relationships. The nthe present case Petioner and Beneficairy claim they were introduced in Jan. 2004. The met and became engaed in December 2006, during Petioner's first and only trip. There is no evidence on record Petioner has returned to visit Beneficiary. No evidece of communication prior to the engagement, covering a two-yr period, was submitted. Evidence of comm. after the engagement consists of a few chat transcripts from 2007. Photographs submitted do not indicate they spent more than one or two days in each other's presence. These facts as ascertaineed by consular officers would convince a reasonbale person that the claimed relationship is a shame entered into solely for immigration purposes and to evade immigration laws. Therefore, pursuant to 9 FAM 41.81 N6.5, the reviewing officer has decided that the petition should be returned to the USCIS for review and possible recocation upon his concurrence witht eh reviewing offier's decision. When the USCIS receives the returned petition, they will contact the petiioner, who will have an oppoortunity to rebut consular findgs concerning this case. If USCIS revokes the petition, the beneficiary will become inieligible for a visa under section 12(a) etc... of the act.

    I told my fiancee that we were introduced and met in 2004 but we weren't falling in love until 2006 that is why we didn't have any communication covering 2 yrs period. That is what she stated during the interview. They didn't believe her. Officer said: Photographs submitted do not indicate they spent more then one or two days in each other's presence. How they hell they know about this? I went on a trip with her and took lots of pictures and submitted to them, they can tell it is not 1 or 2 days together. Now, this is a false accusation from the u.s. consulate officer. Can I sue him?

    I know my case is a misunderstood the requirements. If my Senator couldn't help me, the next plan I will do is going back to Vietnam to marry her and petition her as K3 all over again. Is this the right thing to do? I may have to wait for another yr or two, whatever long it takes for her to come here. I am so tired of pursuing the case.... Lawyers are expensive and no guarenteed that they can help with my current situation. I don't plan to look for a lawyer.

    You are absolutely right... I shouldn't need to lie.

    "You didn't have to know your fiance for 2 years prior to filing, many people get that mixed up." --- I got this mixed up.

    I met her in Dec 2006 and filed a petition in March of 2007, that was perfectly the right timing. I thought I have to meet the person in 2 yrs that is mainly the reason why I lied. I know that I am a badddd liar.

    This thing is very highly sensitive but as a first time petitioner, I am so clueless and didn't understand the procedures. I didn't read much on this board before going doing the steps. Now, it is a baddd mistake. What is the correction to this prob? Will I need to refile and forget the old one?

    I am new on this board. Here is my K1 denied petition issue. Please give me any advice if you can. I was introduced to my fiancee in Vietnam in 2006 but I lied in my petition that I met her in 2004. I have no supporting evidence of the relationship between 2004 to 2006. I have evidence from 2006 until now. So, basically they rejected my application and saying that we lack of evidence since 2004. They want to return my petition back to the u.s. for appealing. They didn't tell me when will they return? I have no clue what to do next?

    Any advice here? I did the petition all by myself. I didn't go thru. lawyer or service agent. Now, it is too much trouble and headache for me. Helppp. I wrote a letter to my Senator, do you think they can help out my case?
