  1. Actually about the only thing the US does is look that you meet the minimum requirements. They then leave it to the consulate to interview for a petition. It seems that some places have carefully trained their people to ask questions until the first bad answer then deny the visa. Nigeria seems to be in this mind set most of the time. I am sure they see it as protecting American borders but it ends up being a true stress test for all of us

    I guess she must have screwed up on some of the questions. At the same time it breaks up relationship with the way they have the system setup. I am just fed up with it.

  2. Lagos is a very hard headed consulate. It seems as if their theme is DENY DENY DENY. There are many stories of people presenting twice the evidence as couples from other countries and still being denied. And Lagos will also just take a hard nosed attitude of the visa being sent back. They will say it is already being sent back even when it is still there. Contact a good attorney . Marc Ellis would be my choice. He is a board member under Ellis Island. Even if he isn't your long term pick he will be able to tell you the laws and the possible next steps.

    Thank You everyone. I will try to get a lawyer soon. She was approve in U.S.A. But got denied in Her own country (Nigeria) That is a shame to Lagos Nigeria consulate.

    Thanks for your effort. I emailed the U.S.A embassy in lagos nigeria and this is what they replied me.

    How do I go about this issue?

    According to our records, this case will be returned with a recommendation that the petition be revoked. This case will be returned to DHS/USCIS 90 to 120 days from the date of the applicant's interview. We would advise that you contact DHS/USCIS with any additional inquiries as the case is considered closed in Lagos.

  4. When was this? What did the denial reason say?

    She went to the interview September 14, 2009. The visa have to be k3 because we married. The reason was that the pictures doesn't have both parties parents in it. she told the Offical the reason why the parents weren't there. The reason is in the original post. The offical then requested some type of pictures that shows that we were friends from childhood according to what she told the offical. but she couldn't provide that because we never thought that we would end up together.

    I hope i can get some help in this forum. My wife just went to the interview in Lagos Nigeria for her visa, she was denied visa, because she doesn't have old pictures of us together or our parent present in the wedding pictures. The parents were not present at the wedding because one was going through surgery and the other was out of state.

    I left Lagos in 1996 and we've kept in touch ever since. I went back home in 2007 and we got married at the registry office in Lagos. It was only my brother, my wife's sister and some guess that was present at the wedding. I just hope they don't think this is a fraud. I presented every documents needed she was approved in America immigration office how come they denied her visa in lagos? I am so upset about the whole situation. this is ridiculous. I hope i can get some help here.

    She answered every questions correctly I was told. Except when the offical asked her why the parents were not present at the wedding. We did the wedding in a rush because i only had few days to my departure from lagos. The offical did not schedule her for another interview, he just wrote visa denied due to not enough evidence.

    What is the next thing to do so she can get the visa? before they send the whole documents back to the USCIS. Or How can i go about helping her?

    I am a US Citizen trying to bring my mother to USA. My parent had a traditional marriage that doesn't come with marriage certificate. traditional marriage is basically bringing in some wine some snacks and some other stuff that are required for the marriage ceremony. Now, they've been separated for over 16yrs, they didn't file for divorce they both just went there own ways. My dad is in the U.S and my mother is in Nigeria. In my birth certificate she doesn't have his last name. How hard would it be to bring her to USA as my mother? or what other document would be needed beside my birth certificate and hers to prove that she's my mother. she was in U.S in the 70s on f2 visa as far as i know, my dad came here on f1 visa as a student and she came to join him years later. But now she's been back in Nigeria since 1983 and he is here in the U.S.

  7. And you have not since contacted them for an update? You should.

    Although usually, these visas do take longer than spousal or fiancee visas -- I think (not sure) you have to wait for a visa number to become available, and that takes a long time. Though I could be mistaken.

    Unfortunately, your brother is considered Fourth Preference and it looks like numbers are currently available for applications with priority dates of August 22, 1997 or before.

  8. Hello everyone,

    I am just curious and a little frustrated that my brother is not in the U.S.A with me yet. I am wondering how long would it take for form I 130 Immigrant petition for relative to be approved or denied? it's been 6yrs that i filed for my brother in August 2002. I was 22yrs old at the time, my brother was 19yrs old. I received a notice in March 23, 2006 that the application or petition has being transferred to the INS office at California Service Center Laguna Niguel. I reside in Michigan but the INS pointed that "We transeferred this case because the record indicated that office has jurisdiction over the case. That office will notify me of subsequent action taken on this case."

    Any clue what's going on? I will appreciate it.

    Why did she have a SSN? Was she here on a work visa?

    her ex-husband brought her over to U.S.A when he was going to school in U.S.A with F1 visa. So, they went through the whole process of getting social security card and whatever else they needed at the time.

    IF her ex-husband was on F-1 visa, she was then on F-2 (dependent visa). It's used for purpose of studying and nothing else. Your mom should apply for regular B2 visa to visit you. SSN has no bearing on issuance of B2 visa.

    but I don't what type of visa she had when she was here with him. I knew that she stayed in the country for about 9 years and she also worked several jobs while she was in the U.S.A.

  12. :help: Hello everyone,

    I need some help on how to bring my mother over for visitation without going through the visitation application process.

    she was in the U.S.A in the 1980, she came with her ex-husband. Her social security number is still current in U.S.A but she left back to her foreign country in 1989. Now, I would like her to come and visit but because I know she's still have her social security card from U.S.A I don't think that she have to go through the whole visitation process again. I need some help on what to do everyone.
