  1. This is probably a stupid question, but my husband is here on the VWP for three months. Our I-130 was just approved and is at NVC. Can he adjust his status since he is here? USCIS website says this:

    "You cannot adjust status if you were admitted into the United States as a visitor under the Visa Waiver Program. (This rule does not apply to you if you are the immediate relative of a U.S. citizen (parent, spouse, or unmarried child under 21).)"

    You got your answer: "This rule does not apply to you if you are the immediate relative of a U.S. citizen (parent, spouse, or unmarried child under 21).)"

    So yes, treat your situation like a K-3 and follow those directions, you attach a copy of the I-130 approval notice and code the I-485 as "a" based on an approved relative petition.

    You will need to have a full medical done at a local Civil Surgeon, as well as vaccination supplement.

    Can you tell me if how long the I-485 takes? I have been looking on USCIS processing times but I am not sure where the I-485 would be at (which service center). Also, with the approval of I-485 can the immigrant work right away?

  3. I received a strange letter today from USCIS regarding my address. So, I thought this would be a perfect time to call using the RFE line to also enquire about I-130 that has been pending for nearly 7 months. I called and got a rep atCSC. Spoke to her about this address letter thing then she suddenly said that my I-130 is past normal processing time and that she will be pulling my file now and sending to an adjuticator. Should I believe her? She was much more helpful and knowledgable than any rep I have spoke to at USCIS. She also said that even though they haven't updated their processing times on the website, they are currently working on August 15 I-130's and I am past due. I hope she isn't just telling me what I want to hear? arrgghhh

  4. Congratulations on your approvals, but you guys are K1's so your timelines aren't comparable to K3s and IR-1/CR-1.

    I would be very happy if there were any September approvals for IR-1/CR-1/K3, but it would also make me very confused, irritated and upset. Sorry, I've just been waiting for so long to be reunited with my husband and we keep encountring obstacles. And I know my case isn't as complicated as many folks here on VJ. There are folks from May still waiting! #######!!??? I would really need an explanation because I wouldn't understand.

    I truely am happy for all the VSC folks, it seems this service center is working faster than CSC, I wonder if they are recieving less applications, or are just more efficient?

    Just curious to know, when you call USCIS do they help you in any way or give you an answer as to when your I-130 will be approved? I called Friday and they said my case hasn't even been sent to an adjuticator. I get so frustrated when I see people who filed after me get an approval.

  5. For those of you who have done the CR-1 visa, generally how long did it take from your NOA2 to your interview in London? Also, how long in between the medical exam and interview?

    I'm not sure but I would assume it would be 'easier' since it is more proof of returning to your home country for interview. If you've already been approved, why risk it with an over-stay?

    We don't have our NOA2 yet but hope to get it in a month. My husband wants to come visit April 1 because he acutally has a free plane ticket just for that date. Three weeks isn't an overstay, but three months is!
