  1. Hello!

    We have our AOS interview on Thursday and I was just gathering and re-going over the checklist of what to bring to the interview.

    On the list, it says that we need "Your petitioner's birth certificate and your petitioner's evidence of United States Citizenship or Lawful Permanent Resident Status". I am a US citizen and I am petitioning for my husband to get permanent residency. Therefore, are they talking about my birth certificate and proof of citizenship status?

    I just wanted to make sure they didn't mean my former step dad's birth certificate and proof of citizenship because he helped co-sign the affidavit of support with us, and I didn't know if this might make the a "petitioner".

    I just got more confused because a few items down it says that we need "your spouse's birth certificate and proof of citizenship" and I didn't know why they'd list it twice. Maybe for people who aren't based on marriage?

    So I was looking at the USCIS website and at the VisaJourney website but I still have some questions about timelines and the overall process that I was hoping someone could help us with.

    So...USCIS received our AOS application on June 25th 2008. Since then, my husband has had his biometrics appointment and has received his work and travel authorization. Now I'm wondering, what next, and when?

    I know we're waiting to be contacted about setting up an interview, but I was wondering if someone could give me an idea about when that might be?

    Also, after the AOS is approved, what will my husband technically be? A permanent resident? And then I know you apply to remove conditions and eventually apply for citizenship, but when can this occur?

    My husband has applied for his adjustment of status. He has received work authorization and travel authorization. We are now waiting for the next steps in the process.

    He is looking into going back to school to get his Masters Degree. I was wondering, is this okay while the AOS is still processing? For example, would he need to get a student visa, or could he just enroll in programs?

    Just wondering if someone had experience with a similar situation, or if you knew what the requirements were.

    My husband and I just got notification that his I765 application for employment authorization was approved, yay!!! I'm so happy :)

    He's turning in an application for a job, and on it it asks what type of work visa he has. I was wondering, what should he put? I was thinking maybe "I765 Employment Authorization filed with Adjustment of Status Application"...but I didn't know. That seems kind of long :) I was wondering what people had put in the past? Maybe just "I765 Employment Authorization"?

    My husband is waiting on his work authorization, but in the meantime, he's been trying to search for job possibilities and start the application process. He hasn't had much luck so far, and because everyone is always so helpful and wonderful on here, I thought I'd see if anyone had any suggestions or advice.

    He's been trying things like craigslist and just going to employers websites but I was wondering if people had other advice for finding good jobs.

    He has a Bachelor of Arts in Sociology and lots of experience with sports, specifically soccer. He's interested in doing something sports related, possibly something with sports marketing, and also has an interest in working with the environment.

    Anyone have any wonderful ideas??

    I posted something last night about the request for initial evidence letter that I received. Thank you so much for all the responses and help. I just wanted to clarify before I send it back...

    the letter that we got says:

    "The joint sponsor on form I-864, Affidavit of Support, must be a US citizen, US national, or Lawful Permanent Resident in the US.

    In order to process your application further, submit evidence of the joint sponsor's status."

    after reading everyone's responses I think I just need to send a copy of our joint sponsor's (my former step-dad) passport, the biographical page. Is that right? I think I'm going to try to send a copy of his birth certificate and my passport and birth certificate also just to be safe.

    does that sound like everything I should send?

  7. yeah i had that exact same RFE, total BS as it didnt say anywhere to include proof of the joint sponsors' citizenship. Just send them a copy of thier birth certificate, if they dont have a passport, asap then they will be back working on the case before you know it

    Actually, they DO say in the instructions for the I-864 (page 6) about the proof:

    Proof of U.S. citizen, national, or permanent resident status is required for joint and substitute sponsors
    and for relatives of employment-based immigrants who file this form. Petitioning relatives who have already filed proof of their citizenship or immigration status with Forms I-130, Form I-129F, I-600 and I-600A do not need to submit proof of their status with this form.

    Proof of U.S. citizen or national status includes a copy of your birth certificate, certificate of naturalization, certificate of citizenship, consular report of birth abroad to citizen parents, or a copy of the biographic data page of your U.S. passport.

    Proof of permanent resident status includes a photocopy ofboth sides of the "green card," Form I-551, Alien Registration Receipt Card/Permanent Resident Card; or a photocopy of an unexpired temporary I-551 stamp in either a foreign passport or a DHS Form I-94, Arrival/Departure Document.

    It reiterates this again in the checklist on page 11...

    Just for future reference if you come across someone else who asks! :)

    crazy, I can't believe I missed that...I checked through everything so many times and put so much time putting everything together.

    what is the best thing to send, a copy of the birth certificate, a copy of the biographic page of the US passport, or both?

    thanks so much for all the help and advice and support, I really appreciate it. I was just feeling really discouraged last night, but after reading everyone's responses I feel a lot better, thank you. It's really encouraging to hear from other people that are going through the same thing. Sometimes I just get down but it's nice to know there's so many other couples like us in the same situation that have had to go through the same things. Thanks for the kind words, it is so helpful.

    about the whole 2 month thing... I know that the AOS can take years, I just meant that it had been about a month since they'd received our information, and I knew it was 90 days before you were supposed to get work authorization so I thought it was 2 more months for that.

    it's just weird because I checked and rechecked the lists so many times and tried so hard to ensure that I had everything, but even looking back at the instructions for the I-864 I don't see anything about including proof of citizenship. where do they tell you to do that?

    anyways...thank you so much for your help. It's just hard because my husband really wants to be able to work in a job he likes and enjoys, and he's just getting pretty discouraged feeling like he can't do anything and it's just really hard for me to see.

    but everyone's right, the most important thing is being together and I am so grateful for that.

  9. I don't know what to do, I'm so sad, so frustrated. We try so hard, we just want to be able to be together and be happy and start our lives and I feel like every step we take something happens, something goes wrong.

    I thought they were processing our adjustment of status and work authorization, and that we only had 2 months max to wait and we just got a letter saying they needed proof that our joint sponsor is a US citizen and that they haven't even started processing it.

    I just want to cry.

    I tried looking at the instructions and I don't even know what they want. do they want a copy of a social security card of our joint sponsor? I don't know what to do. should I call the number and ask them? I don't even know how to get to a person that can help me

    On the form I-765 App. for Employment Authorization, on questions 16, it say to go to part 2 of the instructions to find the correct eligibility category. We looked through them but weren't exactly sure. Which category and abbreviation would we be? My husband entered on a K-1 visa and we are now married and filing for an AOS and filing the employment auth. with the AOS.

    In the guide for documents to include, it says the employment authorization and any additional forms/fees as specified "here" and then there's a hyperlink. I clicked on it, but it didn't take me to an answer that I saw. I remember reading that the fee for the AED was included in the overall fee for the AOS. Is that true? And do we need to file any additional forms with it?

    My fiance had his medical examination in England less than one year ago. From what I've read, because of this, he doesn't need to have a new exam, and he only needs to do part 1, Part 2 and have a designated civil surgeon complete the vaccination section and Part 5, the Civil Surgeon's Certification.

    We are trying to make an appointment with a civil surgeon, but are wondering what exactly to ask them for. They did not seem to know what kind of appointment to make, and were wanting to make an appointment for a full medical examination.

    Also, from the physician in England, he has a "Vaccination Documentation Worksheet". After the required vaccinations, the physician either wrote "K1 visa applicant" in the "completed series" section and "VH" for Varicella, and for 6 of the vaccinations, checked the "not age appropriate" box. Is this sufficient documentation to give the civil surgeon to transfer over? There aren't any dates of when he received the vaccinations.

  13. My husband went to college in America, and while he was here, when he was 20, was cited with a minor in consumption.

    When we were filling out the I-485, it asks have you "been arrested, cited, charged, indicted, fined or imprisoned for breaking or violating any law or ordinance, excluding traffic violations?"

    He was fined, so we checked yes, but then when we were looking at the documentation to include from the general filing instructions, we couldn't find anything that applied, because it only asked for evidence from arrests, detainments, or convictions.

    He doesn't have any documentation of the incident, doesn't know who fined him or how to get this information.

    Does anyone have any advice? Thanks!
