  1. Thanks for the answer. It wont be a problem to provide co-sponsor letter of employment, and im self employed so that doesnt apply to me apparently.

    And yes I really am living abroad or I wouldnt even consider putting it on the forms. I know i can prove we met with passport stamps but it doesnt neccessary prove ongoing relationship, so i figured showing them that we live together is the absolute best form of ongoing relationship. We both signed a contract here and can show the forms if neccessary.

    Anyway I recomend you that you include your self-employed letter if in the interview they'll ask for, because you must show that you, as petitioner, are going to support the intending imigrant aside you're using a co-sponsor who helps you to meet the income requirements. If I'm wrong someone for correct me... It's only my suggestion and you decide the best choice for make everything right and have a succesful outcome...

    How can i make a self employed letter? I will surely do so if its possible and can affect the outcome. Do you have an example of what it should look like?     But if you going to send the I-129F petition you don't need to send the I-134 for now. The I-134 is when you have the date of the interview so do the employment letters!

  4. We live in krakow so will be filing under the krakow embassy.

    Maybe its better that I dont go to the interview then? Would they deny her visa because I dont have a visa in poland? The only reason I dont have it is because they wont give it to me since im not a student or worker (self employed on internet), and the only reason I am here is because I want to be with her before she gets the visa. Now im worried that problems might happen from this...

    What should I do?

    You are *way* over-thinking this, friend. They don't give a darn about your legal status in Poland. All they care about is your fiance, and your ability to ensure she doesn't become a public charge once in the U.S. The consulate has no interest in, nor ability to, enforce Polish law.

    You're right. Im a little paranoid about this whole deal because we are talking about the girl i love being able to come to my home country or not. But Im probably way over thinking it like you said, and you guys provided all the help i needed. We are gonna submit the forms today and im going to hope for the best using my polish address on the g325a.

    Ill start my time line as soon as it goes out. Thanks everyone. I really appreciate the help and encouraging words.

    They are going to send any forms for RFE or approval to your US address.

    Also, as I imagine you are going to the interview with your fiance, be prepared to answer why you've stayed in Poland without obtaining a visa. I'm quite certain the Warsaw embassy will ask this. Not trying to be a smartass, just giving you advice.

    Given the recent back & forth situation with the USA & Poland on the VWP, there is some hostility in Warsaw on the topic, and it may be brought up. Not that it will affect the K1 outcome, just saying be prepared for a question in that nature.

    As fwaguy indicated, it is most likely not a problem. It is *possible* but unlikely they would issue an RFE because of the discrepancy. If it makes you feel better, attach an explanation indicating why there is a difference.

    RFE is not a denial. Don't stress.

    As much as i wish i couldnt worry about it, i need to make sure it wont cause an RFE or problems by listing a foreign address on the g325a, and a US address on the i129f. Does anyone have experience to how this would turn out.

  9. What im thinking i can do is this... Fill out the I129f using my us address and her address here.

    Then on the g325a we BOTH use the polish address here.

    And then including a typed sheet that explains they should send all info for me to my US address because I have someone who will forward it to me here in poland.

    Will they accept this and process like normal or will they cause red flags?

    What should I do?

    What would happen if i used my US address on the i129f, but on the g325a i put down Poland as my most recent address (to help prove ongiong relationship when interview comes)?

    Would this they think is an address confict, or would they just read it as me living in poland temporarily and send all mail to the us address.

    Secondly, I am self employed via internet with income around $10k per year, which is what my fiance can tell during the interview. My tax return will also show self employed, and i have arranged to have my mother as co-sponsor and she makes 40k$ per year. Do you think they will still question my qualification as her financial sponsor?

  11. Oh, and by consulate , you meant the people at the interview right? Will they want to know about my status here.

    No, the Consulate doesn't care either but they will like the fact you spent so much time together.

    The problems, would stem from not showing a US address for USCIS to send notices of action or RFE and any issues impacting your qualification as financial sponsor because of any lack of work/income during your stay.

    I would suggest using a permanent address in the US as your current address. Also, send you petition to somebody in the States and have them mail it to USCIS for you. You'll need to maintain a US mailing address, even if a friend or family member's address and maintain drivers license and bank accounts at minimum.

    Do research sponsor qualifications.

    The verb in your sentence was ''get". USCIS won't mail an RFE to an address in Poland. Any RFE will be mailed to your US address shown on the petition. Hopefully, you used the G325a instead of the G325.

    Perhaps you'll want to clarify your question.

    If you're asking whether USCIS will want to verify your legal status in Poland, the answer is no.

  15. The Tokyo Embassy site is a bit unclear on the topic of "Evidence of Support". Does anyone know if the I-134 fully satisfies the requirement. Also, there are many other requirements other than annual income and a letter from my boss, do I need to satisfy ALL those requirements (i.e. Expression of willingness to deposit a bond, if necessary, with the USCIS to guarantee that the applicant will not become a public charge in the United States") Thank you for your help.

    The I-134 by itself usually is insufficient unless it is supported by other evidence. As far as the type of evidence to supply, you do not need to supply ALL, you supply all that you feel is necessary to prove your situation.

    What about this situation. I fall below the minimum poverty level by several thousand, and have a co sponsor who makes around 40,000.

    Would they have a problem if me and my co-sponsor submitted ONLY our tax returns for the most recent year with the I-134?

    Or will they probably deny us if we only include our most recent years tax return.
