  1. Hi guys,

    Had a funny twist happen with this petition, we received and RFE on Dec 23, 2008. I am pregnant and we had decided it would be best if we just give up on the whole K1 and have my fiance move here because I am having the baby in Canada.

    Funny thing is, on February 4th my fiance received a letter from USCIS, stating that the petition has been approved. The weird thing is we didn't even bother sending more information to prove our relationship when we received the RFE. How did they go from RFE to approval????? :blink: especically with no additional proof.

    My fiance is coming here until the baby is born, and we might just end up doing the Canada paperwork for him to stay here.

    What happens next with the K1? What will my fiance receive next? I haven't received anything from them.

    I don't know if i want to stay here or persue the K1 - the waiting and money is going to take its toll, espeically with a baby coming..

  2. What if we stayed in Canada, and got married, would I have to start new paperwork all over again if we wanted to go to the USA?

    Yes - you would need to apply for a K3 or CR1 visa instead.

    We are not sure now what we want to do, It would be great if he could come here and we could get married, and just stay in Canada...I would continue working and he could watch the baby, I don't know how long it would take for him to get a SIN number, or where to even begin here, everything is so complicated

    You could apply for his Canadian permanent residency while he is there (in Canada). It's not really complicated, you just fill in the forms, get all your documents together and send them in.

    Unlike U.S. immigration, when you leave Canada he will not lose his Canadian PR when he leaves Canada - as long as he is living with the Canadian citizen (you :))

    Not as complicated and long as the K1 visa processes?? I am hoping he would get a SIN card to work asap....We'll see...

    He is also a skilled trade worker, he wants to bring his tools over when he comes along with a few other belongings....I am wondering if they will let him over the border with those? He can not work without his tools...but he obviously can not work until he gets his SIN card....

  3. When one is on maternity leave, ur not having to look for work,lol But thats just my 2 cents, and not to be taken as a hard fact,lol Ensure u have strong ties to canada when u cross to prove you are coming back

    ok...on the flip side,

    He is coming here when the baby is born, as you can see from my signature, we applied for the K1 visa.

  4. Oooh Keg steak would be yummy right now ... if I am thinking of the right thing. I've been to a Keg restaurant in Montreal, is that what you mean?

    I had ..... chicken soup again. Still sick, doc says it is bronchitis. It is kicking my azz, can't stop running a fever, coughing and oddly enough throwing up too :( Hope the soup stays put.

  5. We sent our petition to the CSC on August 30th, they received it on September 2nd and I received the NOA1 in the mail on September 8th. Hope you get yours soon! Jeff

    We sent our I29F on August 28, and received hard copy NOA September 3, 2008...i wish things would just go smoothly the rest of the way!! **cross fingers**

  6. Even with insurance in the US, it'll still cost more to have the baby here than it would in Canada. Plus, while you're on Canadian maternity leave, you can move to the US on your K1 and still collect EI benefits.

    No, the baby would not need a visa, they would need to register his/her birth abroad at the US consulate, and it would have US citizenship.

    No..well i call him my hubby now..but we are only engaged :)

    Thank you for all the helpful info...we have decided it would be best for me to have the baby here, and he will come up for the birth. But I have another question...if he is here fo the birth, how will he let his US consolute now about the babies birth, so that they baby has a US passport?or will it be a US citizen..this confuses me also.

    Just looking to get some feedback on this...

    If I was to have our baby in the USA on the K1 visa, does my husbands insurance pay, or does Canada pay for the medica bills?

    The reason I ask is because, my fiance says it could take a while to for the benefits for me once we are married. Therefore I am wondering what I should do, stay here in Canada or go to him

    uggh its all so complicate

    When i did it back in 2005, it was easy! I was a cr-1 so it was very straight forward, because there was never a question if i was work eligible (i am,lol) It is a fairly simple process, bu tlike any other govt office, not always the fastest!

    My due date is around May 4, 2008. I am hoping all th paper work will be done, and I will have My K1 in hand before I am too far long to fly to my fiance.

    If I do get the visa in time, should I just apply here for my maternity benefits, or wait until I go to myfiance then contact them letting them know I have moved?? I read thatyou can start the benefits 17 weeks before the babies due date. So I am hoping I can just start the mat. leave here.

  10. Think it's 696.00 every two weeks. That's after they've taken the 25% off. Have no idea what visa you're applying for maritimer. Please fill in your timeline, and pick a visa!

    Don't know if you're aware, but you can only collect EI if you're a K-1.

    My Fiance and I are goin for the K1, I am pregnant, so I am glad to hear I wll receive my matenity benefts when I am in California!!, I think we get up to 52 weeks, an 55% of our gross earings up to a max of 413/week here in ON....thanks for all the great info VJ'ers!! :)

    While it's WAY less than what I was making, I didn't think it was too shabby either! :thumbs: This is the highest amount allowed.

  11. Looks like you can, you just need to inform them:

    Maternity, parental and sickness benefits when you are out of the country

    You are able to collect maternity and parental benefits while you are outside Canada. However, you must advise your Service Canada Centre if you go out of Canada.

    Wondering if anyone can give me some info on this.

    I recently found out that i am 4 weeks pregnant, and we are just sent the I29F for the K1 Visa.

    I am going to have our baby here in Canada as I probably won't be down in the USA by then.

    I have been at my job for over 7 years, will i be able to continue my maternity leave when i am in the USA or will they revoke it because I will be living out of Canada???

    The encouragement means a lot to me...reading your post just brought a tear to my eye...cuz i have been feeling down about the distance the past few days, and thinking of the long process we are about to go through.

  14. You will definately have to go to the Montreal embassy. I'm from Toronto, currently living in California with my Beautiful Wife! I already went through the proess and had to go trough Montreal for my interview. There are some cheap hotels, specially one right across the street from the embassy. I'll see if i can remember the name of it.

    We didn't start the paperwork as of yet...still waiting on my gruelling divorce. Anyhoo,..look around the forums here i noticed that there is only a US Embassy in Vancouver, and Montreal (that is listed here).

    Does that mean I have to drive to Montreal to the US Embassy for my interview when the time comes??

    Only Montreal and Vancouver do K interviews.

    First off, i am very happy i found this site.

    After google searching like mad, and no help, I would like you to get some of your opinions on this matter.

    My fiance in the US and I, want to start the I-129F petition. I am currently seperated in Canada from my husband, but haven't started the divorce procedings yet. We have been seperated for over a year. Just wondering if we should(have to) wait till my divorce is final before applying or can he still do the petition with me being seperated.
