  1. Ok so here is our story:

    my wife came as an aupair without the two year obligation. We got married here in the U.S. and submitted the adjustment package in January 22 of 2008. Three weeks later we received all of the I-767 NOAs for I-130, I-485, I-131, and I-765. In May 2008 we went to get her biometrics done and a month later she got her work permit and letter of advance parole that allows her to travel outside the states. Now 5 months have passed and we haven't received any notice or letter for an interview. In the USCIS website, the I-485 hasn't been touched since April of this year. I don't understand why some people who submitted their adjustment package have received approvals for the green card or are schedule for an interview?

    Here are the dates that I see on the USCIS website for my cases:

    04/24/2008 I485 Current Status: Response to request for evidence received, and case processing has resumed.

    02/21/2008 I130 Current Status: Case received and pending.

    05/02/2008 I765 Current Status: Approval notice sent.

    02/13/2008 I131 Current Status: Case received and pending.

    The evidence they requested for the I485 was tax returns because I forgot to send my 2006 tax return and only included one, 2005. I don't know how I missed it but I did. However, I sent the tax return for 2006 and 2007 which is more evidence than what they required. In any case, I don't think that is the problem. My current case is located in NATIONAL BENEFITS CENTER and I don't see any process times for the I-485 or I-130.

    Is anyone experiencing the same problems? Thank you in advance.

  2. Hi everyone! I submitted my package in jan of 2008. So far, my wife has her advance parole travel document, work permit, she's done her biometrics and we are still pending for the I-495. We want to leave the US and visit our family in Colombia, however my wife keeps hearing about other people leaving the US and when they try to come back with their "immigration documents", immigration will not let them in. Has anyone heard of anything like that?

    I just got off the phone with two different immigration reps and both told me that as long as she has the advance parole travel document, work permit, driver license, and receipts of other pending documents, she will have no trouble getting through immigration.

    I don't want to jeopardize anything. I want my wife to come back to the country, but we do want to visit our families in Colombia. Plus we have all the right documents, I don't think that we would have any problems, but then again I'm not immigration. Has anyone traveled outside the US with an advance parole document? has anyone ever had any problems getting through immigration? Thanks so much in advance

  3. I waited anxiously today and still no NOA and my checks haven't been cashed and of course I have more than enough funds in my checking account. I'm filing from Virignia and still no NOA. This is really making me worried.

    Does USCIS check the package first and then decides whether to continue the "process" and then cash the checks, or do they just look at the package and if something is not right then they won't cash the checks and return the package? How do they process the packages?

    What worries me is that many people have received their NOA faster and I haven't. Could it be that because my wife is here on a J-1 Visa? I don't think that should be a problem, I called immigration and they said it was fine. I'm just worried thats all.

  4. USCIS in chicago, IL received my I-485 & I-130 packages on January 22 2008. I haven't received any letters from them with a receipt number nor my checks have been cashed by USCIS. How long does it take for them to get the package on the system and send me a ticket number so I can track it online?

    I'm just worried that I haven't gotten anything. I read some posts here in this forum and some people received their ticket number in 3 or 4 days.

    Can someone give me some info on that? thanks!!!

  5. My husband was here on a J-1 visa as well; they are given out for training purposes. He did not have the 2 year home country thing on there, either. I had an attorney do our paperwork but I can tell you it's a pretty straight forward case. We got married, he got his EAD and a sweet new job in his field (software developer).

    The key is her coming to America and NOT having the intent of staying. That's the thing with the J-1. They will ask about that in the interview. That's the only trouble/pitfall with the J-1

    Thank you so much, I'm a bit relief now. I've also called immigration services many times and talked to different representatives and told me the same thing. So i'm going to go ahead and file the paperwork today!!! :)

  6. Hey there! I've been reading a lot about how J-1 Visa holders can't get married while they are on the states unless you have a special waiver otherwise they could be deported if they violate their visa terms. I have completed all the forms but have not yet filed them. I'm a bit concerned about the fact that she is on a J-1 Visa and might be violating the visa rules. I know that CulturalCare does not allow AuPairs to marry but do allow them to find a "student visa sponsor" or "look for a husband" after they are finished with their period of time as an AuPair. My wife is not subject to two year stay, so that's not much my concerned. I haven't contacted an immigration attorney because they charge a lot and most of the paperwork is self explanatory. Also I dont want to file all the paper work and money and get rejected because she might have violated her status J-1.

    Can someone give me some info on this situation as far as if I need any waivers or other documents that would allow me to file my I-485 package and not get rejected because of her J-1 visa?

    - I-131 Application for Travel Document

    - Letter for Advance Parole

    - I-765 Application for Employment Authorization

    - G-325A and 2 passport style photo (Beneficiary)

    - I-864 Affidavit of Support

    - Copy of tax transcript for tax years: 2006, 2005 & 2004.

    - 6 passport style photos

    - Doctor’s examination forms

    - Copy of marriage certificate

    - Copy of original birth certificate with translated copy from Spanish to English

    - Copy of Passport

    - Copy of J-1 Exchange Visitor Visa

    - Copy of I-94

    - Copy of Social Security card

    - Copy of Certificate of Eligibility for Exchange Visitor(J-1) Status

    -Payment in the amount of $355.00 for I-130 form

    - I-130 Petition for Alien Relative

    - Copy of Naturalization Certificate/US Passport/Military ID/Driver’s License (Petitioner)

    - Copy of marriage certificate

    - Copy of both Medical and Dental insurances
