    Yes sorry for the confusion. I am using the term JS correctly.
     

    We have different physical addresses but we have the same mailing address.


    we had the same address written in previous forms because we were still moving. (Such as EAD which has been approved and the original AOS papers)

    Correct. That assumes you are using the term JS correctly and your FIL and MIL do NOT live with you and your spouse. If they do live with you, that changes everything.

    Read your FIL and MIL what I explained concerning proving separate income by using income statements. Considering that you don't have taxes where you may come from, they may understand what I explained better and you may be making this more complicated than it need be.

    The AOS I864 documents for your financial sponsors that you filed prior is "wrong"/filled out incorrectly/will not be accepted. That's why you got an RFE in the first place.

    They are an I864 PACKAGE because you have more than one sponsor.  Start your I864 package over from scratch. 

     

    All new I864's and *I864a (*if you have to use an I864a because you cannot prove separate income for the JS and their spouse. If you CAN prove separate income never use the JS's spouse as a co-sponsor because the less sponsors the better due to less complications/ paperwork/ chance of confusion is always better. PS it's very easy to prove separate income for employed ppl with their income statements regardless if they filed joint taxes. The I864 instructions explain that. Ensure you've read them. #1 A married JS should always use income only never assets*) AND all new supporting financial documents with CURRENT info.

     

    The current tax year IS 2023 as of April 15th and you are responding to the RFE after April 15th. 2022 is not the current tax year. So while you used 2022 taxes before because it was the current tax year, your adjudicator may or may not choose to allow it now. It's up to you but I'd always follow the route with the less chance of getting it wrong considering we know what is current right now. 

    You aren't going to confuse them if you produce a CORRECT and COMPLETE Financial Support package for all of your sponsors especially when you outline your new submission with the changes on your COVERLETTER. 

    Spell out exactly what is different and that you are starting over with a whole new package to avoid confusion.

    I864 for my husband - petitioning sponsor

    I864 for my FIL - the only joint sponsor (correct? even if his wife will file an i864a?)

    I864a for my MIL - household member

     

    Yes we are using income only, but it would be hard to prove the separate income and its just easier for us at the moment to use both parents.

    Sorry for the many questions, we dont even have taxes where i come from lol so this is all very new!

    I had a quick but time sensitive question!

     

    my husband is my petitioner and sponsor and we got married on a K1

    But hes currently doing another masters so his father is going to be our joint sponsor, but because he files taxes jointly with his wife she is going to fill a I-864a too. In that case, is my Father in law the only joint sponsor or 1 of 2 joint sponsors?

    It has no connection to the status update website which is what you are asking about. 

    AND G1145 is for applications not RFEs.

    Your shipment tracking is all you get that is a guarantee.

    I had one more question sorry to bother you, I was filing everything with the I-864 with the most tax year being 2022. can I still do so or should i now include 2023 since taxes were due for that year already? I just dont want to confuse them with new numbers

    My I485 still says case received and I've had my GC for going on 5 years. 

    You should submit a COMPLETE answer to the RFE by mail as if you've never responded yet. Ensure you know what your RFE is asking.

    The current wait is that for AP so everything right here:

    Doesn't matter. You can expect 12.5 plus months for 80% of all cases and more for the remaining 20%. Anything less is a gift.

    Which is normal. They don't fingerprint for I131.

    Combo cards are rare. 

     

    Processing times are for each form at each SC or LFO.

    You can enquire online for EACH form when it tells you that you are eligble for THAT form type.

    I will mail them then, thank you. Will I get a notice that says they received my response again after mailing it? Because my status changed to say so when I uploaded the RFE response on the site.

    I should also add W2s and Tax forms AND form 1099, correct? 

     

    Yes the I-485 processing time for Chicago Field office is 17.5 months, a long time from now! Hopefully things can be smoother from here onward. Its been such a long frustrating journey.

    Yeah tell me about it. Spousal was not an option for us back then and the processing times were quite long too. Oh well. Hope it ends soon :)

    If you submitted an I864a for your Joint Sponsor instead of an I864, you're likely waiting for another RFE (or NOID) which could be an indication of the extended wait. 

     

    What is the processing times for AP at your SC (which is the NBC for AP) according to the USCIS processing times website as listed on all receipt notices? That's your estimated wait. 

    We could help you figure that out but you stopped filling out your VJ timeline before your K1 was even approved. 

    Please return to it and fill it out as that info helps us to answer you and is also used to calculate approval statistics for VJ members. 

     

    When you received your RFE and when others were approved is irrelevant. You can only go by the website's estimate as that's only when you are allowed to enquire.

    What does it say when you input your case details into the website?

     

    Foreign passports can be applied for while in the US.

    Death of a parent, sibling or child is the most common reason for expedite and a chance at approval. 

    Firstly, I appreciate your reply very much. Thank you for taking the time to reply!

     

    I was totally unaware of that, I can't believe what a dumb mistake that is. I am now thinking of submitting a cover letter with the I-864 of my joint sponsor (which they initially had), onto unsolicited evidence. Do you recommend another way? My RFE has given me till May 23 to reply but I can't reply to it anymore on the myuscis site.

     

    The wait for AP is around 12.5 months, but there have been several people that filed at the same time as I did that recieved combo cards or at least had a biometrics appointment for AP. I got a biometrics appointment for the EAD and AOS apps only.

     

    I'm definitely not allowed to enquire anytime soon because the waiting time for the I-485 at chicago is around 20 months, but again, alot of people applying in dec/jan and even feb have already been approved. But it makes sense now that you mention my mistake. 

     

    I was honestly hoping to travel and see my family for important events this month but it looks like that's impossible now. Yes I will update my timeline. Thank you!

  9. Hi everyone!

     

    I just had 2 quick questions. 

     

    I filed for AOS after getting married on the K1 visa. I got my work permit shortly after but absolutely nothing in regards to the travel permit. 

     

    We got an RFE because we submitted the I-864 for our joint sponsor (parents in law) without submitting one for my husband who is my sponsor because I thought we didn't need to do that. So we got an RFE and resubmitted an I-864 for my husband and I-864A for his dad & mom (they file everything together and the income on the tax records is their total income, both of which meet the requirements individually). But we haven't heard anything since and we sent our response in early March. From the limited knowledge I have, cases are approved quickly after RFEs but we have been waiting 2 months now. Is this normal? What is the average time on this?

     

    I also wanted to travel back home to renew my passport. Is this a valid reason to ask for an expedited travel permit?

    as far as i know they got the number on the spreadsheet by scanning cases manually, which could lead to some errors. 

    if by end of september there were 55k cases according to USCIS and 7-8k were processed so far, someone with an NOA1 of Oct1 2022 should have around 47k cases ahead of them. 

    So either we're missing something or the 38k number is inaccurate.

    The issue is they're still busy in Oct (15-15.5months) and a lil in sept (16 months). 

     

    We're not 100% clear it'll be faster but we're analysising the data, it's not difficult to take backlog and divide by number they remove from backlog everyday to get an estimate on how long it'll take from now assuming pace doesn't increase/decrease. Atm I'm sitting somewhere at 12-13months for NOA2 but based on their newsletters we expect it to keep increasing pace. We just can't be sure or how fast it'll increase which is why we always say we need to wait and see. No one is adament it'll be a lot faster, just that's what the data CURRENTLY points to. If it changes, then we'd discuss that too. Best we can do is share current and everyone is free to make their assumptions 🤷‍♀️

     

    My field is literally data analysis so I'm not making it up but I also can't really be sure of anything months in future when uscis changes rapidly from week to week. The fact they are increasing and they have a VERY optimistic goal of 6 months by October makes me think they plan to keep increasing pace. I don't think they'll reach their goals but we know they're aiming for a dramatic decrease in wait times which means big changes. Remember this time last year it was like 250/week it's now 250/day :)

    I just wanted to add that not only have they started with November, people with NOA1s at the end of November and even early December have heard back. So we're definitely getting shorter wait times but also its such a large range of varying wait times between people (from 16 - 13 months) so the USCIS will only report the shorter wait times when they become a bit more uniform, imo. 

    I hope that's a bit of positivity your way :)

    yeah i care about number of cases processed/week too, and I'd rather the backlog be RFEs than untouched cases. I'm guessing we now have approx between 30-35K cases ahead of us now

    thats amazing news! I think RFEs count cuz its still a case that has been opened and processed in some way. Thank you for the update!

    High risk countries do have a higher burden of proof but I don't think I've seen one where there wasn't an obvious cause. You can also appeal a denial I believe.

     

    I guess discussing what you have vaguely planned??? Tbh bf and I mostly have planned what we want. Whether it'll be achievable on this visa... Who know

    Right yes, my bf and I have an idea of where we want it and when and a general outline & family members already got the B1 visa to attend the wedding, but we don't have photographers or makeup artists booked or anything. Pretty reasonable to ask for wedding plans besides that, fair enough.

    Also seen a lot of denials cause people haven't met or didn't meet the financial req.

    Have there been denials that were kinda ridiculous or were they all legit/major things that applications missed? 

    Also wedding planning before having a visa or even applying sounds silly lol how does that even work .. besides just knowing date/location

    Your number is going up because it's based on visajourney users timelines averaged over last 30days or something so that's what they're *currently* processing at. For times to go down they need to process over 800 a week, every week. It will also take awhile for an increase in processing to have an effect on our estimates. It's not instant.  Also if they're only removing 10-100 out of the backlog every week that's honestly not a lot and won't have a drastic affect on time estimates. It's good news because it means times won't keep going up in the future and will eventually come down but it's not going to happen tomorrow. Their increase in processing is mostly seen by fact the USCIS processing hasn't increased and is unlikely to. It used to go up at least 0.5months every month.

    I think we have a similar timeline, hopefully by the summer the processing times decrease substantially or at the very least have stopped increasing. Not sure if withdrawals are increasing but hopefully that also makes a dent in the backlog.
