  1. We have same issue with my brother F2A priority date 2019. We got letter from embassy in Philippines saying we are ready to process his visa so we go ahead and do all the interview preparations they told us to do. Only to find out on the day of interview appointment that he missed the cut off date and he is in included in retrogression.I did not get a letter from embassy or NVC about this changes so they sent my brother home not being interviewed and was told to re-schedule and come back and always watch online the visa bulletin changes and wait for the priority date to be current before making visa interview appointment at the embassy.Right now month Aug they are processing priority date year 2017 below so our priority date 2019, went 3 yrs back from July 2023 since our priority date became current and we missed it, so that means very slow and waiting game again until our priority date will be current.😔😔😔

  2. That is good you contacted immigration law office for this matter. Yes, there is CSPA ( child protection act law) for those children that age out and F2A visa will remain the same regardless even the child turned over 21 yrs old. Some are approved for expedite but only for valid reasons like emergency or medical reasons. So we cannot do anything to speed up the process.We just need to pray,hope and wait patiently.   3. @ Chipz,welcome back. Good to hear from you again. You can get a lawyer it is your choice. If you want to file for citizenship, you will have to change your status and submit all documents to NVC like your US passport and US citizenship naturalization, the visa case will change as well. Not sure how long it will take or if it will go faster this time due to covid backlogs. US citizen petitioners will not have cap limit each year with their visa compare to LPR petitioners. LPR petitioners all visa has cap limit each year, you can bring your wife and under 21 kids but if you become US citizen you can bring your wife but you need to file again separate filing petition each child, cannot bring derivative family or kids along the petition for your wife.

     

    We are still waiting for interview until now and still get email every 60days-nothing changed! We are worried my brother will turn 21 yrs old next year😔.You can try email NVC and Manila US embassy for expedite maybe they will accept it. Hope this helps and good luck!

  4. Mary Bernard, thank you for your quick response and input.Good to know we are on the same situation.I am helping my mom since she is the petitioner as GC holder. Are you GC holder or USC holder? How old is your F2A in this case? I heard the processing depends on status of the petitioner.


    That is good news you were able to request expedite the case and was approved right away. What is the next step you will get if you are approved for expedite? Are you all set now for interview? We have same priority  date of year. Our priority date is Jan 2019 and been DQ after that year too,so yeah same 2 years no processing since covid up to now. We have been waiting for so long and been contact with NVC all we get from email is to wait, but my brother will be 21 yrs old next year, we filed petition when he was 16yrs old before covid- he will be age out soon next year.

    My mom petition my 3 siblings unmarried ( 1 minor and 2 over 21 ) since yr 2019 before covid, she is green card holder. All of them were approved and all case are in NVC. However, until now we do not have visa yet. My minor brother is so far documentarily complete at NVC and still waiting for interview which is taking so long time, due to covid backlogs the processing is like a snail, we are worried as he is aging out 21 yrs old next year. My other 2 brothers that are over 21 yrs old are still waiting from NVC to tell us to submit all documents needed but so far no further action required yet, as NVC says they are waiting to become visa available.. we knew over 21yrs old will take long years processing compare to my minor siblings.. we always contact NVC but we are still waiting here no clue when is the interview coming, we hope really soon! Hope this information will help you!

  6. Are you petitioning under 21 unmarried or over 21 unmarried? You and my

    mom have the same situation. My mom petitioned my under 21 yrs old brother. Our PD is 2019. I did not let my mom change her status yet from LPR to become US citizen. From what I heard, LPR is faster in visa processing compare to US citizen status.

    As far as petition goes we are under F2A visa category, we are DQ ( documentarily qualified) but waiting is taking forever. No clue when it is going to happen NVC says due to covid delays and backlogs we have to wait…we get email every 60days from NVC.

     petition my under 21 yrs old brother since 2019 before covid started. Our case is in NVC since 2021. We only get email from NVC every 60 days for an update if we have to wait or will get an interview date.. that’s all we get from NVC. We are DQ ( documentarily  qualified) and still waiting for an interview which is taking so long. My mom filed petition when my brother was 16yrs old. Next year 2024 he will be 21 yrs old. We are worried what if the visa or interview date did not arrive before his 21st bday? Will he still be under F2A under CSPA act? Or the visa will change to F2B which will take longer for visa processing? I am so worried as the backlogs still happening and waiting time is uncertain. Hope to hear answers who have experienced or still having same situation we are facing. Thank you in advance!
