  1. I emailed my case worker as suggested about my questions. So I asked about the fact that every website says the K-3 visa requires the I-134 but someone else was told to submit the I-864. I've asked my husband to send me both so that I can be covered either way and then today I got this response.

    Dear Ms. Vernon:

    K3 applicants are not subject to the I-864 (Affidavit of Support) requirements at the time of K3 application, but will be required to submit when the applicant adjusts status to a Legal Permanent Resident in the United States. Similarly, the I-134 Affidavit of Support is also not required.

    Can you explain this to me at all? Because now I'm SERIOUSLY confused as to what I'm supposed to submit.

    I had my K3 interview in May - I was not required to submit an affidavit of support. We had completed it (I864) with all other documentation. However, the consular officer advised that it is not required at the interview, only when I adjust status in the US.

  2. Thanks purepeace. I am glad you answered me, you have made me realize that I am rushing and on the verge of making mistakes.

    Am I the only one here that is totally confused with what to send back to the embassy at this time? I'm afraid I have no cooking clue what to do here, there is so much conflicting information from what I am told, what I read, and what the forms say. I have searched the VJ forums over and over and it seems everyone else understands this step perfectly. What am I missing, what am I doing wrong? :(

    I replied to one of your other posts - only the signed checklist must be sent to them at this stage - everything else gets submitted at the interview. Just make sure that when you submit the signed checklist that you have complied with all requirements (have all relevant documentation they require) and scheduled your medical.

    The only form to be sent back to the embassy is the signed checklist which confirms to them that you have all the relevant documentation required for the interview, as per the checklist. They will then go ahead and schedule your appointment for the interview. Also, she does not need to have gone for the medical but the medical appointment must be scheduled at the time the signed checklist is sent back (the medical must be done prior to fgoing for the interview). In addition, once the signed checklist is sent back, call them to confirm that they have received it (if you fax it through to them). Then, call on a regular basis to check for your interview date. I called them every second day and they did not have a problem with that at all. If you want to keep the original documentation (certificates of birth and marriage, etc.) take copies with you. The only original they keep is the Police clearance Certificate. I had a good experience at the embassy in May, they're very friendly and helpful.

  4. Hello Friends...

    I am so happy. I drove through to Johannesburg this afternoon to pick up my packet 3, checklist from my consulate. Everybody was so kind and helpful and my case worker is a gem. Very kind and helpful.

    One question though.......Am I right if I say I can only submit the checklist once I have the results of my medical examination?

    I am just so happy about this process comming to a close. I want this over as soon as possible.

    As soon as you have all the documents they request and have scheduled your medical, you can return packet 3. I did mine this way and got an appointment scheduled sooner. They can only schedule you for an interview once you return packet 3 so the sooner you return this to the embassy the better.

    If we give them the soldier to stand trial in Iraq, they must give us the person/s responsible for 9/11 et al where people were killed and maimed to stand trial in the US!!!!! Which of course will never happen!!!!!

    I haven't posted in a while, so much going on it's really hectic right now. My K3 interview was on Friday, I was approved, Consulate should issue by today and I will have it tomorrow. I plan to leave South Africa on Sunday, 25th............ My husband is jumping out of his skin with excitement (and I am not far behind) :-) So, the next time I post will be from my new home.

To the SO's left behind we're all here for you. I know that when Alan was deployed the love and support of my friends and family was invaluable.

    Thank you for your posting, it's a wonderful posting, and for some of us waiting for our petitons to be passed is grueling, but it could be a lot worst for us. The time we spend waiting is nothing like having a loved one deployed in a terrible place at war time, waiting for them to come home to us. For that is much worse, I remember my mother waiting for my dad to return from Vietnam , truly she never knew if he would come home, and be with his family. At least we know out time will come with USCIS and we will be with our families, our loved one will come home to us.

    Some others are not so lucky, they never come home to their families.

    Thank you to our military men and women who every minute put their life in danger for us, for our country. Their battle is much worst then ours here at home waiting for USCIS.

  8. I just wanted to let everyone know that when I called my fiancee this morning she had some wonderful news! Our interview is scheduled for May 29th!!!!!!!!! I CANT BELIEVE IT!!!!!!!!!!!!!!!!!!!! Please keep us in your thoughts, prayers, or whatever it is you do to bring luck to others:)

    Being in a LDR has made us better communicators - we take more time and make more effort to express ourselves so the other person can understand and we've learnt how to communicate with each other so that nothing gets "lost in translation"; there's an emotional intimacy and maturity that has developed in our relationship; we know each other better than we knew people we dated for years and our foundation is a lot more solid than those.

    My husband gave me the same caution about what I say and who I say it to. Sometimes we Military Spouses are so proud of them we want to tell the world....... Thank God we don't!

    Sarah-Jayne - I couldn't agree with you more on separate processing for Military Spouses........ Not on the basis of preferential treatment but securing/ensuring the safety of our boys. Here's hoping USCIS or DHS is reading this :-)

    I said I would share with my friends & family (for starters) just how wonderful, perfect, understanding, patient, loving, unselfish, considerate & forgiving GOD really is.

    He has blessed me with a family that loves me & friends that I can confide in.

    But even more than that, He has saved me from destruction I couldn't even see coming.

    He gave to me the peace of knowing Him, & He has never broken a promise.

    Truly He is the best thing that has ever happened to me.

    I posted a couple of weeks ago about the snag my fiancee and I hit with getting her German police clearance. To make a long story short, they spelled her name wrong on the document and had to send it back to Germany to be corrected. that was almost three weeks ago and we have not heard anything since. My fiancee will be contacting the Germany emabssy about this soon to hoepfully get some sort of status update.

    I wrote to the Consulate in Johannesburg to explain this situation and hopefully get them to get us the earliest possible interview date once we have everyhting together. Their response is below:

    Dear Mr. Dagle,

    As soon as your fiancée returns her checklist, we will do our very best to ensure that she get the first available appointment for an interview. However, our appointment schedule is very busy and currently we are about to start scheduling appointments for the month of June. Please keep in mind that we may only be in a position to schedule an appointment six weeks out.

    I cant believe that once she sends in her checklist that it will take 6 weeks to get her an interview!!!!! This is yet another blow to us and the time apart and the process are really starting to get to both of us! Does anyone have any advise for us or any history with dealing with things liek this? My head is spinning!!!!!!!!!

    I feel for you!!! I've read some of the other SA threads when I first started on VJ and if you send in the checklist, attend the interview without the police clearance from Germany, they will approve your case but only issue a visa once the clearance is received. I read the letter you got from the consulate - I spoke with them today (I intend calling them every week to check on the status of my interview date), they said they will be scheduling for MAY soon and will contact me once my date is set (spoke with my case worker directly). Will keep you posted on info about the dates :-)

    OK, so the formForm DS-230 is 4 pages long but on the literature that came with the packet 3 it says "you only need to complete page 1 and 2". And if I am to fill out page 1 and 2 do I return all 4?

    Is this right for the US Fiance visa?

    I'm about to send this off so any help would be great!!!

    Only Part 1 of the DS230 (first two pages) get completed and sent back to the consulate with packet 3. Part 2 (pages 3 & 4) will get completed, sworn to and signed in front of the CO at your interview.

  14. I am a september filer...... I was approved on April 8th and ppl i didnt get any touches before!!! only once when i frst received my NOA1 for the 129 and that was it!!! till i was approved i never saw any updates in my dates.... so dont worry u will get approved real sooon :thumbs:

    Our experience was the same - August filer I130 and October filer I129F. We got touched (both cases) when I129F was received by USCIS (we suspect this is when our petitions were joined). No touches after that, NONE, then approval on 11 March. Strength to us all!!

  15. Soon my fiance will be waiting for Packet 3 to arrive, can he go ahead and get his police certificates or does he have proof that he needs them? He will have to travel about 300 miles to get one of them since he has moved in that last 3 years. Just wondering if we could get ahead a little bit.

    Hi Sarah,

    Congratulations on the approval! Just a note: the police clearance is valid for 6 months only, the consulate will not accept anything older - I confirmed this with them two weeks ago when I collected my packet 3.

  16. my I-130 was approved and sent to the nvc feb 21, 08 didnt hear anything from them so I called, they told me they sent my paperwork back to USCIS on march 21st, called USCIS they havent received anything from them. why would they do this? is this normal?

    I see you filed both an I130 and an I129F. Do you know whether both petitions were forwarded to the NVC? If so, they could have sent the I130 back and are processing the I129F. It would be good to determine that :-)

  17. Well, I cant join the militry cause I am physical DQ also I am too old.

    I wanted to go to the Airforce academy but I do not think I would of made it. I would gone ROTC.

    Since I was 3 yrs old I wanted to be a piliot, but God had differnt plans for me

    So I would of join the Airforce. Then Navy.

    My Parents met in the Air Guard. I had my Uncle who was a Marine ( and was wounded on Imo Jima) My mother's brother was in the Navy (he was a Navy Aviator and killed flying a Navy Jet) I have 2 cousions that were in the Navy,

    Airforce for me. MY job takes me on differnt branches of the militry and I notice the Air Force bases are more like a college campus, nicely groom and nice curb apeal.
