  1. Hello Everyone,

     

    I'm not sure if there is a thread made for June '19 Filers for I-130 But if there's none yet, Let's congregate here in this thread.

     

    My mom (LPR)  filed for my sister yesterday. So here comes the journey for my sis.  She will turn 19 this June so I'm praying to God that she will have a smooth process from here and doesn't aged out.

    An expedite of a PD is not possible.

    It can actually cause a considerable wait if she does so as an LPR. If they approve the expedite on the I-130, she still needs to wait for the PD to become current. However, she will have less time covered by CSPA....she might age out from F2A to F2B. That will add several years to her timeline.

    This can be avoided if the mother naturalizes before she turns 21. But it's an unnecessary risk.

     

    Once the mother becomes a USC, then an expedite on the I-130 makes sense. There's no longer a wait for the PD to become current.

    An expedite would be needed again at the NVC/embassy stage.

     

    As for whether or not she qualifies for an expedite, that depends on the circumstances. There's no issue with requesting an expedite if you believe the case meets the criteria. Every expedite decision is discretionary. Worst thing is they say no.

    I will just note that expedite for medical reasons of the beneficiary is quite difficult. It typically requires evidence of the condition and that they cannot obtain sufficient treatment abroad.

    And as noted above, showing that she won't become a public charge may or may not be more difficult.

    Thank you all very much for the feedback. 

    My mom wasn't eligible for N400 since she just made 5 years as LPR. And our FO is New Orleans which when I checked it truly looks like its also going to take a year. 

     

    I spoke with her this morning to we decided to file now for my sis, and also file for N400. Upgrade later when applicable. 
    I'm so bummed because we could have filed a while back for  my sis but my sister has been having a lot of medical issues, cardiac related issues that I believe we can try to apply for "expedite" status for medical emergency.  All we can do is try, if they deny the medical emergency reason, we can always fall back to the regular processing timeline. 

     

    Any feedback on this?

    it's been a while since I was in VJ. 

     

    I just want to get feedback as to how long it might take for my sister to get an approval. Here are the details.

     

    Petitioner: My mom 

    Status: Permanent Resident

    Filing: i-130 

     

    Beneficiary: My sister, 18 years old. 

    Living in Philippines, right now.

    Filing date First week of May 2019

     

    Any feedback is appreciated

  5. An LPR can not file for an IR-2. Only a US citizen can file for an IR-2. Since the grandchild can't come, then you the US citizen stepparent filed for your stepdaughter as an Immediate Relative where there is no restrictions on the availability of a visa and no derivative beneficiary allowed. This is completely different from the OP where an LPR is petitioning for her child in the F2a category.

    You are going to give people false hope by not correctly identifying when a petitioner is a USC vs an LPR.

    I am a USC. My mom who is a LPR will be the one who's going to petition my sister. But I will be my mother's sponsor since she doesnt work.

    So question is, mom needs the form I-130 to file for my sister, correct?

    and so, there's still restrictions for visa availability?

  6. My wife is a LPR, and we started an IR-2 visa for her 19 year-old daughter about 13 months ago. She has her interview next week.We had a couple of issues, so there was some time delay in that 13 months. I'd say it would have taken about 9 months total.

    The daughter has a baby, but we can't start the process for the baby until the daughter gets here. Then it will take 18 - 24 months for the baby's visa to be approved. This is because the daughter can come as part of my wife's visa, which I sponsored as a US citizen, as long as she is under 21. The baby has to come as part of the daughter's LPR visa and will take longer.

    I think your friend's 6 month estimation was probably a derivative of a visa filed by a US citizen.

    I hope I explained this alright. It all makes my head spin a bit. haha

    this helped me a lot to approximate things. I needed this input from someone who went through the process. Good luck on the interview.

    It's been a little while since I was in any of the forums. But I just want to throw a quick question about how accurate my friends' info that they gave to me regarding how fast their relatives I-130 was processed.

    According to them, it took 6 months until approval for an LPR to receive an approval for an I -130 filed for unmarried child. I wasn't sure how true.

    Can somebody please share your experience in light of this issue. thank you very fast.

  8. CFO is not open on Saturday, and for PDOS for those emigrating is different then for Fiancee and Spouse seminars.

    oh, sorry for the misunderstanding. I was referring about 2GO if they are open until Saturday for possible pick-up.

    and BTW, out of whim.. i went to 2GO website and track the package, using the CASE NUMBER, and it worked!!!!

    Its now on transit.. it was transmitted yesterday to 2GO courier.

  9. How old is your mom? If she's above 60 years old, she's exempted to attend the seminar.     However, the CFO sticker is still mandatory when going through immigration's.

    There was a holiday on the 9th in PH. By experience & reports here in VJ, passport with visa will be forwarded to 2GO from USEM within 2-3 business days. She might receive a text from 2GO on friday or Saturday, if you guys are from Manila.

    My mom is only 50. So she still needs to attend the dang seminar. And yes, are just in Manila.

    When I checked the CEAC web, it says that they have issued the visa last April 7th, so discounting the holiday, She could possibly receive a text from 2GO Friday or Saturday?

    Are they open though on Saturday? Cos I can just have her pick it up in the 2GO headquarters even.

  10. From one of Hank's link, it says that mom an actually pick up the sticker at the Airport. But I need to call at least 2 days prior to picking it up.

    It's definitely worth a shot. That's why I'll have her call tomorrow and see what she can do with this situation.

  11. Today is April 10, well within the normal range of the time it takes to deliver the visa. So don't worry about this being a sign of problems.

    She can do her CFO before she collects the visa, but she will have to go back when she gets the visa to get her sticker. But if she is pressed for time, this might save a day or two, so you may want to consider this.

    What does ustraveldocs say? Issued yet? There is a way to track it once it is in the hands of 2Go but I don;t know the details

    But even if ustraveldocs says issued and 2Go has no record of it, still no need to worry. It takes some time to make its way from her embassy file to 2Go's delivery system

    This is government, which has 2 speeds: Slow and stop. Private industry would fire anyone who moved this slowly, but for government this speed is just fine. So please be patient. It will get there. Nothing you posted here shows me any sign of trouble.

    I didn't know she can actually do CFO already without her passport.

    What else she needs to bring if she doesn't have the visa/passport packet?

  12. Hello, anyone here had your interview last April 4 and still has not receive the isa packet?

    My mom was approved lady April 4, and she still has not receive her visa packet.

    Is their a way to verify if they have processed it already? Will 2GO send you notification that they receive the packet? Any number to call?

    Her flight will be on the 19th, and and I hope she can have her CFO sticker done before her flight.
