  1. you don't necessarily need a lawyer but one thing i would do and i have seen others here do, is draft an affadavit from your inlaws indicating that you have been living there as a family due to the economy and that you contribute to the household x dollars if you pay rent. others have also gone to a local stationary store where they have purchased a copy of a blank lease and filled it out to have a formal agreement in place.

    also it is secondary but affadavits from friends attesting to the validity of your relationship. more pictures of the immigrant spouse with the inlaws at holidays as well.

    Thankyou my inlaws have drafted affidavits stating we live with them and my sister in law who lives in an apartment will also write one. i will print picx of me and my inlaws together, good idea!

    we do not pay rent we acutally live for free, my inlaws are great they understand that my job is contract and not permanent we have a new baby and my wife is still laid off...

  2. maybe i did not provide enough info, but I thought I DID.. hmmm...the thing is iprovidedthe most recent bank statment showing both ournames on it with transaction history only for the month of august as i filedin sept..and also only a copy of 2009 tax return.. i should get the transcript for 2008 and 2009!!! im going to call irs now and get it faxed to my house and send it.wil this be OK??? and acceptable or should i order by mail, it says 2 weeks ...also did include few pix like 6 and coopies of our DL showing same add, copoesof car insurance showing cars covered with ournames and address, and copy print out of my medical insurance showing both our names on it....still not enough i believe!

    we have no bills really together on our names! as we are living with my inlaws (my wifes parents and my wife is the USCitizen). I do have a DISHnewtowk bill which i pay but its only on my name, can i include those monthly statements? it shows the address...

    so i will add copy of my newborn babys birth cert

    tax trasncritps d2008 2009 showing jointly filed

    2 addidavits from inlaws attesting the marriage is in good faith

    letter from bank managers (we have accts in 2 banks) so i will go to bank and ask them to write up a letter saying mr and mrs xxx have a bank acct here together checking and savings and actively participate in transactions as of xxx until present...

    copy of our debits cards

    copy of our gym cards

    how does this sound? should i go thur a lawyer/?????????

  3. the tax transcripts call 1 800-829-1040 ask the the years you need, three years, thay can mail it to you or you can ask them tofax it the same day,the evidence you need get utility bills cell phone bills togather, any club membership togather,joint credit cards,pictures togather,lease, driver lic showing the same address,send more bank statements,traval togather trips,you new born birthcertificate showing both names, two affidavits from friends stateing you are a happy loving couple, living togather, ...good luck

    thanks for the IRs number will call them first thing in the moring and ask for a fax.We do not have any utility bills as we stay under my inlaws house,due to rough economy when I first got here,and wife been laid off, we have a new born now so we decided not to move out until we both have dependable jobs. no club memberships, we have joint debit cards,which we use together from our joint account. we recently created a new account copule of weeks ago to save up for house.. i can print that statment. we have birrth cert for our new baby with our names on it... we will get 2 affidavits from my inlaws stating our marriage and that we lived with them since my arrival into us.. how do i get added to the CAR owndership and Car Loan do you have any idea?no gym membership and no lease. as we do not pay rent. We did already submit the drivers license copy showing our address and health insurance showing our coverage and car insurance showing our coverage together... we also submitted marriage cert and tax return 2009 but were not the official transcript which you mentioned...

    please help .. do you tthink if we submit the following we should be ok:

    baby birth cert

    2 addidavits showing relationship of me and my wife

    bank statment of new accoutn recently created

    copy of 2 shared debit cards (they have diff numbers though on each card but its the same account for debit usage)

    tax transcirpts from IRS

    is this ok?my wife wants to add me on her car loan and car title tomorrow, how can we do this? will this be a good move?

  4. Hello, I am returning after a very long time... Everything has been great... hope some ppl recoginize me from before...

    My wife is the USC and I am the Perm Resident. I filed for i751 9-18-2010 as it was 90 days prior to be greencard expiring...

    Reiceved my NOA on Sept 30 2010, which says they recvd my payment of 545 $. Then on Oct 15 I recvd the Appilication Service Center notice to give my biometrics which was scheduled for me in Nov.

    And today in the mail I receive a letter from USCIS which says on a BLUE colored paper that "the evidence submitted with your form is insufficient.USCIS required additional evidence to process your form."

    Why USCIS is sending this notice to you:

    "USICS has revd your petition to remove conditions on residence form I751 and your supporting evidence. Your supporting evidence does not establish that you and your spouse entered the marriage in good faith and contiue to share a life together.

    You submitted one joint bank acct statement, a copy of your 2009 taz return (which is not an official transcript, nor is it stamped by the issuing authority), evidence ofjoint health insurance converage, and evidence of joint car insurancecoverage. This evidence is insufficient. you did not show that your and your spouse share responsibility for most of the assets and liabilities of the marriage. You have not sent sufficient exaamples of shared assests and liablities soanning the entire period of the marriage to show that your continue to share a life together.

    WHAT ELSE CAN WE SEND THEM, WE HAD A BABY JUST RECENTLY SO WE CAN SEND THE BIRTH CERT OF BABY AND SOCIAL SEC CARD. HOW DO WE ADD A SPOUSE TO THE CAR OWNER AS MY WIFES NAME IS ON IT AND WE NEVER THOUGHT TO ADD MY NAME TO IT. WE CAN ALSO SEND OFFICIAL TAX TRANSCRIPTS BUT HOW DO WE DO THAT?

    PLEASE HELP SOMEONE :(

  5. i would say contact DOS

    and ask them whats the status of ur husbands case. dont wory its standard procedure , so its a matter of time. my husband just got doe with AP! just be patient and keep praying

    they will usually say currently under admin. processing. just ask them how long to expect. they usualy say 4-6 months.

    Sure, you can do that. What's the point. That IS what they'll say, no matter when you call or what you ask regarding AP. It's a black hole.

    its a black hold but there is light at the end of the tunnel. and you should call for your own satisfaction. iff you were in the same situation you would do the same.

    this is the best gift i could ever get in my life! to finally have my husband come home and to start our new life!!!!!!!inshAllah!

    just dont lose hope, like tammy said the visa will come!

    just want everyone to know my huby got his visa today in hand!

    our AP is over! alhum. hes been in AP since july 08. and today his visa was issued! alhumdulillah..

    all i can say is never give up and keep praying to Allah. he is the most powerful!

    just to let u know

    his interview in chennai was perfect. nothing wrong. everything in order and did not request any doc. i was present with him also.

    but cousular officer said i am confident you will get ur visa but i have to do some admin processing on your case, and it will take 4-6 weeks. but it actually took 5 months!!

    so dont woryy ppl inshallah the visa will come but keep in touch with embassy and dos even though dos is not helpful at all..

  8. some of yal may know me, as i was part of VJ for a long time!

    but guess what!! my husband finally got his visa.. it was one painful and long year!!!

    we were issued a 221 g at time of interview, and were told to wait 4-6 weeks for AP! but we waited 5 months!

    its over and hes finally coming home to be with me!!! inshallah!!

    never lose hope.. you will get the visa!!!!

  9. My husband got his visa!!!

    it has been a painful year, but forgot about all that and am thankful to God, that this day has come!

    got his visa issued Today from Chennai...

    delivered by VFS!!

    finally I can say AP iS OVER!!

    we have been in AP since july!!

    i cant believe it!

    last friday i emailed the embassy asking what is the status of our case , we were told at time of interview 4-6 weeks of AP, and it have been 5 months!

    so they emailed back the very same day, telling my husband to submit his passport to vfs to process his immigrant visa!

    and so we weere like hmm.. is this true or not? so my husband submitted his visa this past monday to vfs and they delivered it today!! in a matter of a week he recieved the passport back with this visa! CR1 category!

    im glad i emailed the embassy? or else i wonder when they would have contacted us..

    all i can say is calling DOS is a waste of time, when the embassy emailed us i called dos, they said we are currently under AP! so why did the embassy tell us to submit the passport?? ughh .. this process is screwed up. but it will come dont lose hope... just keep faith in God, and keep checking status with the embassy!

    we are hoping for his arrival before the new year inshallah!! :dance:

    2009 guys will be a good year for all of us stuck here in AP inshAllah!!!

  10. So we called DOS.

    The operator first told my husband there's no indication in the record that the visa has been approved.

    Then, she said... "Oh wait, wait, wait, my bad, my bad, I was looking in the wrong section... there's a note here that says the visa has been approved, everything has been reviewed. And that's it. Oh no, there's more, it has been printed and placed in the passport and it's just waiting for a courier. I don't know how the courier-service works there. But the important thing is it has been done."

    My husband asked her if the note is from today. And she wasn't sure and repeated, "The important stuff has been done already, so she should get the passport soon." (inshAllah).

    I guess the lesson I've learned from this is, when the embassy fails you, try DOS. At least she was able to give a little more information than "wait".

    I pray all of you who are on AP get to hear something comforting very soon inshAllah. And I pray I get my passport within a couple of days... Ameen.
