HI huney I don't know why your depressed and why you left home you are welcome home anytime you want. The lease is still in our names and im still paying it as usual and always ready to support you and take care of you. Well I understand that you have changed alot since you went home in December to visit your family and friends I don't know why but I still feel the same for you. You are not kicked out of our home I've always supported you and took care of you I know we have had difficulty in waiting for the Adjustment of Status I comforted you and always stood by you. Talk to her, it might just be hard on you guys because the AOS has delayed. Talk to her about your feelings and how you feel you have been treated. It might be a difference in culture.... I dont know.... All the best!

I just wanted to make an addition to the interview experience. WHen the IO stamped APPROVED on the file, he gave me a letter with my name and A# number and the date (3/24/09), and I think his number. It basically stated that I have been given conditional residence effective 3/24/09. He said that am now a permanent resident and the card would be coming soon, and if I have an emergency and needed to travel out of the country, I should request an infopass and have my passport stamped. Then we signed a similar letter which he retained, he said that was to cover himself in case we said he had not explained the removal of conditions part later on. This is what the letter states:

Pursuant to S. 216 of the Immmigration ACt, you have been granted conditional residence in the US as of the date you were admitted or adjusted by an officer of USCIS. You and your spouse MUST file a joint petition (FOrm I-751) to have the conditional basis of your status removed. The petition MUST be filed within the ninety (90) day period immediatelt precceding the secon anniversary of the date you were granted conditional status. If the petition to remove the conditional basis of your status is not filed within this period, your conditional permanent residence will be terminated automatically and you will be subject to deportation from the US
If you are travelling or need evidence of your permanent residence status, you must sign onto the website at WWW.USCIS.GOV and click on the INFOPASS icon. Appoinments are availale upto two weeks in advance.
So my question is, does this mean am now a resident? I know he said so but I have never read anything like this before????? Have you heard of this before?

Do not give up hope yet. Try and get your EAD renewed, then work and raise some money. Since your i-94 was taken at the interview its very likely you will be approved, sometimes people have waited after the AOS interview for long before they get their green card, it might be the same with you. Try to get an infopass, you already did the interview, so unless they ask you to go back for another interview ( which they have not) everything should be fine, just the long waits of USCIS. You might leave the country and then the green card arrives. Also am sure with the help of an attorney there is a way for you to stay here and remove conditions on your own if divorced after the 2 year Green card expires as long as the marriage was entered with the right intentions. In life there are many fights...... man this is one of them for you. DOnt give up hope, go to the mosque, church a friend and borrow money to extend your EAD so you can work raise money for possily an attorney, dont surrender. I really feel bad for you, I hope and pray that something works out soon. Never give up. God bless.

We had our AOS interview today at the Raleigh/ Durham office. We arrived about 10 minutes before the interview (9am) and found many people in line, so by the time we got to the lobby we were 15 minutes late. Didnt get called for another 30 minutes or so. We had prepared so much for the interview and photocopied many documents until this morning...Lol -thanks to VJ. When we finally got called to go inside, we took the oath and were sat down. The IO asked for my passport and I-94 and my wifes drivers license. He also asked for the marriage certificate and made a copy. He said the file didnt have a copy... am sure I sent a copy in my application for AOS. When he returned he began talking about how long it would take for me to get the green card in the mail. We volunteered a letter from my wifes school showing that we live together in an apartment at the school to explain why our mailing address was different. He stamped the stack of our forms Approved. I guess they keep all the documents from the initial fiance petition to AOS because the file was thick. He then handed us a form indicatiting that am a conditional resident and asked us to sign another form. He did afew things on the computer and said I was approved in the system and should recieve the green card soon. He explained removal of conditions and eventually citizenship. He didnt ask anything, we were amazed. He seemed to have gone over the file earlier because he commented about my wifes naturalization certifcate. I dont know what else to say but the interview went better than we expected, never asked us anything, the moment we walked in, he had already approved us, I guess he just wanted to confirm our identities. Waiting for it to update on the USCIS website.

I believe you because something similar happened to me. The individual wrote a nasty email to the embassy with bad allegations, but I had all my documents in order. After the first interview, I left thinking I was approved and when I returned to pick up the visa the following day, I was questioned again and this time approved. Live your life and trust God. As long as your relationship is genuine no one can destroy you. Also, with official 'stuff' no one can simply blackmail you and get away with it... your records are confidential and the gov't or agency does not give people's info anyhow. Have all your documents in order for the interview. I understand your fear but you will be fine. Good luck!

And while I am on my soap box...let me tell you something, the only thing ##### about these qualificaion numbers is that if you think you can really support a wife or family on these numbers, you are in for a big surprise. I earn MANY MANY times the amount needed for my family of 4 and we certainly are not "affluent". We have a budget and follow it closely. If you make 4-5 times the minimum it will not be enough for a comfortable life. You know you have to fork out another $1010 when she arrives, yes? And you know after you do this you have to meet the guidelines again with the I-864 form, yes? And you know there are there are many more expenses yet to come, yes? Maybe you have no clue what happens when a woman moves halfway 'round the world to be with you. My wife came with clothes and nothing else. What can they bring? Her electrical appliances wouldn't work here (except her computer) so we spent nearly $1000 the first two days she was here just to replace all the things she couldn't bring. Hey, blow dryers and irons and etc. etc adds up quick, and you think a bachelor has the stuff a woman needs? Dreamer.
So, you're one of those who think finding a spouse from some other country actually means acquiring a pet who just wantswantswants, needsneedsneeds, asksasksasks and demandsdemandsdemands and, therefore, you need to be making a fortune in order to pay for all those wishes and demands?
What if the person who's actually coming to the States has some, y'know, skills and knowledge and can live with just those clothes or whatever they bring until they're ready to start legally working? Believe it or not, there are so many of us.
I don't expect blow driers and irons to be bought for me when I arrive. We'll see if WE can buy those, or anything else we'll want, once I start contributing to our family budget. Or, you know, I might not even come there with a bag full of my clothes and just 50 cents to my name, in the first place.
But yes, we're all different, I know. Some things just make me sick more than the others.
I totally agree. I'm certainly not arriving empty handed. And anything I can't bring by way of electicals that have different voltage...well, if WE can't replace those at once I am prepared to wait until WE can. I'm fairly sure I can manage to live without a blow dryer.

Hey, there's a reason for the minimums. And there's a reason they're baaed on POVERY guidelines. POVERTY, right? Do you really want to live that close to the edge, and bring someone else to share in that status?
Moreover, if you (not a specific 'you', just those defending living on the minimums) wish to do so, that's your business ... until it affects taxpayers.
The purpose for the support affidavit is to ensure that this new immigrant to the US will not immediately be accepting welfare, Medicaid or other public assistance. There are millions of Americans unfortunately needing these underfunded programs already.
US Immigration law recognizes the right of US Citizens to be reunited with their loved ones. But only insofar as they can support them without public assistance. Why should I as a taxpayer have to subsidize your lifestyle and your choices? If you really can't afford, quite literally, to marry and be with your loved one, well - you wouldn't be the first. In times gone by people would WAIT to marry and start families when they could afford to.
If you can meet the thresholds on your own or find a co-sponsor to shoulder the responsibility jointly, fine. Welcome to America. But if you can't, why should you expect the taxpayer to effectively be your co-sponsor?
We've got enough corporate welfare cases on Wall Street these days. Who needs more?
Gary and uscandual: Please be couteous on this board. This is not a competition about who is more wealthy..... When people ask questions and post comments its because they genuinely need help. Please avoid mocking them. Tax payers do not co sponsor anyone! The government effectively recovers any money spent from the co sponsor. Am sorry about your relationships if all they are about is money, things property and who bought what in the house??? Fiance`s / fiancees from abroad also have a life and professions while in their countries. Try to be respectful there are many of them who are very learned and not beggers using this post/ board.

I have to file for AOS. I need current photos, right ? I do have the ones from the last year while applying for K1 visa.
Walgreen charges $ 8 for only two photos. Do we have a cheaper and better option ?
I used mine from the k1 embassy interview and they were accepted. Sent me letter for AOS interview. Did not get any rfe for photos???

The requirement of naturalization based on three years of marriage is that you STILL be marry and living in marital union at the time of the interview with the same US citizen.
There are people on VJ who have been approved even when they were divorced, but they had been married for three years before the divorce. It all depends...

My wife (USC) today come back home and asked me to seat;
She told me today she went and filed divorce papers (we live in Queens NY);
as she says
she feels unhappy and she thinks we dont love each other anymore;
Things have been quite heavy lately with my job and i come home exausted and
late every day, but I never expected such a SHOCKING decision;
The interview appointment for the N400 has to come yet (i filed on SEPT 08 so is coming up)but I feel bad to give up my marriage and my citizenship;
i tried to convince her and made change her mind but she said she is not going to change anything;
What happens now? can I dispute this divorce?
if i sign it will the Court record this separation/divorce?
If the appointment letter come in and i show up at local office, will they see
a separation recorded? will i be in danger/ risk to have my GREEN CARD taken away?

Am sorry about the divorce. Well if you have already filed for naturalisation, let the process go on and appear for the interview and if you are divorced by then then tell him or her ( interviewing officer). The ten year green card cannot be taken away from you because of the divorce. Also if you have been married for three years by the time of the divorce, it is likely that the interview will be approved even if you are already divorced by the time of the interview. The requirement for naturalisation through marriage is the three year marriage.
Even if you are not approved at the interview, you will only have to wait two extra years and naturalise by yourself. (If your naturalisation is not based on marriage you wait five years instead of three.)

Hi All,
Wanted to know if anyone has had any success in rescheduling an AOS interview.
I received a letter yesterday stating that my interview was scheduled for the 10th March at 8:50am at the Denver office. The problem with this is that I will be out of the country until the following day (this was even in my Advanced Parole application that I will be returning on the 11th March!)
In my advanced parole application (which I received a few weeks ago) I specified that I will be in Australia (my homeland) from the 19th Feb until the 11th March..... and they scheduled my interview for the 10th March!!! grrrrrrr!!! I've tried to change my ticket but they dont have any availability for the 8th or 9th March......
What do you think I should do? I've read some horror stories about people being denied because they have missed their original appointment although they have rescheduled.
Any help would be appreciated. Should I try an infopass? Not sure on these either.

You have done what I would have suggested (talk to the airline). However I think you should still try and call the airline again and try to see if there is anyway out, or if you can travel back by another airline. Alternatively, if you can postpone the flight until after the interview, or worst case scenario forego the trip if it is something you can forego. Rescheduling has great disavantages am sure you already know a great deal about. Only do it if you have no other option! If you do get an infopass and arrange. Good luck and all the best; I know it is difficult.

I am happy receiving my visa this morning, but when I check the visa, there is an error in my fiance name.
in the Annotation my fiance name is mispelled
it should be Steven, but they put Stiven
What should I do?pls help me.

Go back to the embassy and get it corrected. My visa also had a mistake and I asked the embassy to correct the mistake. Otherwise, Congs on getting the visa and Good Luck!

USCIS had recieved my I-485 in jun 2007 and I had applied for an EAD later and received it in 2 months or so. As I researched that most people receive there conditional green card around 1 year or so but till date haven't recieved anything. In 4months it'll be 2 years of my marriage, so my question is that if I don't receive my conditional green card within that time then can I do something through which I can get a Permanent greencard instead of a conditional greencard. From what I know the conditional greencard is issued within 2 years of marriage. What about after 2 years? Please let me know if anyone has had such experience...!!!

If you by the time you interview, you have been married for two years they will definately give you the ten year green card. I want to get an appointment at a local USCIS office, but at the same time, since you have waited this long, maybe try and wait for the four months so that you go there and get the ten year card. I dont know how urgently you need it. AM sorry about your predicament. Good luck

So....as long as we're married, we can stay here to sort things out, without getting into immigration trouble? I want to make sure that there wont be any sort of illegal immigration or visa violation type of thing put on his record, which would make it really hard later if we try again to either get him a marriage visa or permanent residence.
We're getting married in a few days, and I think my 2009 tax return next year will be enough to sponsor him, so if I try to wait that long, whats the worst that could happen?
Yes go ahead and get married. There are people here on VJ that have waited 2 years or even more to file for AOS and they have been fine. You will be out of status but thats better than not marrying within the 90 day timeline. Like someone said above; you do not need to wait for your tax returns to file for AOS. A letter from your employer(s) verifying the amount of money you are making and pay stubs should do for the AOS.

Hey guys.
I was just wondering if the tax returns need to be notarized, which are required as part of the Affidavit of Support (I-864) for our AOS package. The only reason I ask is that there was a delay in my being given my Fiance Visa at the London US Embassy because we didn't include my wife's notarized tax returns. According to the literature it says that photocopies should suffice, but just wanted to double check so I don't make the same mistake twice and delay matters.
