There is nothing specific that says you must file it ASAP when the 90 day window opens. My husband and I filed his I-751 five weeks before his 2-year greencard was to expire, and everything worked out just fine (approval and 10 year greencard arrived in timely manner).

So the OP still has time, all be it only about 5 weeks

We used printouts from the insurance website that showed my husband as a beneficiary/dependent. We provided financial/bank statements from since we applied for AOS (2 years ago) through when we filed I-751, with a 3 month pattern (Jan, Apr, Jul, Oct, ...).

We were approved just in the past week without any RFE.

My husband and I faced a similar situation in 2010. My husband had lost his Greencard. We had gone to the local USCIS office and they too told us to file for a replacement greent card. At that point in time, we were 3 months from filing the I-751. We decided not to file for replacement. We visited the local USCIS office again right before the 90 day period was to begin, explaining he lost his greencard and that we were going to be filing the I-751. An officer told us to go ahead and file, include the copy of the greencard with the I-751 (luckily we had a copy, and only a copy of the front of the Greencard). He also told us, that once we filed and the I-751 was pending in the system, we could come back to the local USCIS office and get a I-551 stamp put in my husband's passport. So we filed, including the photocopy and all the other needed evidence. Once we received the NOA1, we waited about 2 weeks and then went back to the USCIS office with the NOA1 and every other piece of government paperwork we had ever filed. After about 1 minute of waiting, we got called up by the officer (same one who told us we could get a stamp put in the passport). Five minutes later we left with a nice I-551 stamp in his passport. And just earlier this week, our I-751 was approved and my husband's 10 year Greencard arrived yesterday.

Try making an infopass appointment and ask if once the I-751 is pending, if you can get a I-551 stamp. You can explain you have lost your greencard. The NOA1 from I-751 alone may not be enough for the DMV, because the NOA1 is to be shown with the actual expired Greencard. But some places are more flexible than others.

Stephen and I welcomed a son (Connor) into the world on March 28, 2009. Although he was completely unplanned, we are both ecstatic to have him!!!

We thought we'd have Stephen's GreenCard in hand by the end of November. It arrived in the mail today -- 10 days after the interview!!!

It was an exciting afternoon, almost made me want to leave work early to celebrate!!!!

We had our interview last week, and were approved as I posted last week. The case status online was updated November 7th to indicate the card production ordered. And last Friday we received the official letter stating card production ordered with the first line being "Welcome to the United States of America". It's a nice feeling to know we don't have to file anything again for 2 years.

We went to the AOS interview this morning ... 1 hour waiting, 15 minutes in the office, a few questions (how did we meet, how long we had known each other, when did we get married, how is married life?) ... more time spent in silence as he flipped through the original I-129F application and AOS documents we submitted. I saw him stamp it approved. He then asked for a copy of the marriage certificate (they seemed to have lost it in the file). He went to photo copy the marriage certificate and our drivers license. When he left the room I told Stephen to look where the approved stamp was (he was like, oh, WOW!). And that was it. He gave us a document explaining in 2 years we would need to apply to lift the conditions and that in three years Stephen could apply for citizenship. It was much easier than we expected. Should have the GC in 2 weeks.

Dumb question,

had a successfull K1 interview in Frankfurt earlier in the day.

Now noticed that they apparently kept my passport there. Is this correct or did something go wrong there and I should have gotten it back?

Yes, this is normal at Frankfurt. They will send your passport back with the visa foil in it, along with the brown envelope you will have to carry to your US Port of Entry and hand in.

Stephen's interview was May 13th. There was a delay in his medical reaching the Frankfurt embassy, however, we received his passport with visa foil and the brown envelope 10 days later in the mail (registered). So if your medical was there already, you will wait less time to get it back, barring there aren't any other problems.

Hey everyone .... boy this thread has gotten quiet since we've all moved along ....

Stephen and I are preparing for the AOS interview that is coming up 2 weeks from tomorrow. Otherwise, trying to settle in after the ceremonial wedding, however we are still busy with Youth Soccer and all the other things we are trying to do.

Another bonus though, Stephen went to get his driver's license last week (NC state has strict rules for immigrants and drivers licenses) -- he had to take the written test, sign test, vision test and road test ... but he passed them all. He was ecstatic to finally have a state issued ID!!!

Well we were hoping for a transfer ... but we got a letter this past monday with the notice for interview for AOS - that is scheduled for November 4th in Raleigh ...

More waiting, but gives us some time to prepare everything for the interview ...

Update on us ... we had our ceremonial wedding this past Saturday --- it's all a blur to both of us, you spend all this time planning, and I tell you, the time just disappears, but it was a fabulous time. Once we have some photos up online, I'll share them. On Monday, 9/22 we received a letter for AOS interview ... so we didn't get lucky with a transfer (probably because the raleigh office is new, and they are trying to do all the interviews!) So we have that interview on November 4th.

We received the AP travel documents last week on Thursday, 9/11 and Stephen's EAD work authorization card arrived in the mail Saturday, 9/13.

Still no update on AOS -- but our heads are wrapped up in the family/friends wedding we are having this weekend!!!

I randomly went and checked our case status online, and Stephen's EAD/Work Authorization and AP/Travel Document were approved this morning!!!!
