  1. That link talks about US citizens and Canadians going to Canada. Not foreigners. The OP does not state if they are Canadian or something else.

    It also says nothing about entering Canada when you are from a completely different country without a passport.

    There is a paragraph on the US website for Green card holders at the bottom.

  2. A lot of people think that they know the answer to this question and generally they do not. If you look at the following websites you will see the CORRECT answers for land crossings for LPR's to Canada.

    By the way, your friend is correct and US greencard holders are visa exempt when visiting Canada.

  3. I have been following this thread, but haven't added myself to the list because all of my dates have been identical to Hadrianina1, wierd coincidence. Today I had my interview, approved, oath is Thursday June 9th in Detroit.

    Highlight of interview, I had disclosed traffic tickets on the form, the officer asked if I was ever arrested for a crime, I said no and he changed the answer on my form to no. No excitement in the interview. Glad to be almost done with USCIS, one week to the oath.

  4. I had my interview today, and I had included my Excel spreadsheet with my original submission. I had updated my spreadsheet for my trips since filing, (I live in the Detroit area and the border is right here). The Officer took my dorky list because I had made it and asked, did you take any trips longer than 6 months? Were you out more than 18 months of the last 3 years? My answers, no & no, and we moved on.

    My point with saying this is that if you read the instructions and the M476, the intent of the question is to establish continuous residency and presence. Make your best estimate based on your habits. They will review your Passport stamps anyway.

  6. I looked into this to during AOS, I had been on TN and at the time had 36 credits, so we did I864 like normal.

    I have read other posts in the past about I 864W that say you need a certified Social Security Transcript, but theUSCIS form and instructions are not clear.

    You can file a regular I864 and use your husbands TN income as your relative to sponsor himself your (the US citizen's) spouse. Do a search on this website it has come up before.

    In our case I asked the interviewer about the 40 credits and she had no Idea. I had 36 when we filed and 40 by the time we interviewed so in effect my Wife's sponsorship of me ended before it started.

    Canadian Citizenship law changed in 2009 and the rules stated specifically related to Canadians in this article are outdated and wrong. For one thing the 28th year rule died with the old law.

    I would say a good rule of thumb when you are in the USA naturalized citizens are US, period. When you are in other countries, depends.

  8. You can get your TN before you move. Once you get a job offer you can go and get the TN status, and turn around and go back to Canada to pack etc. I would suggest that this is the best way.

    When I got my first TN, I got it a week before my job started, and returned home. This strategy also gives you time to correct any issues if you get denied and re-apply. If you live too far from the border you will need to come up with an alternate plan. At one point I had 2 TN's while changing jobs. I did not give notice at job 1 until TN for job 2 was approved, I had 2 TN's for about a week before I started job 2. Do whatever you can to minimize risk.

  9. There are really only 4 general ways to get a greencard. Family, Diversity lottery, Employment or Refugee.

    For Canadians, born in Canada, Rufugee and diversity are pretty much out. If by chance one of you was born in another country you may qualify for diversity. Family is out for you two unless you have other US family. That only leaves employment.

    In general AOS from TN can be done whther by family or employment It is a bit risky but people do it. You have to find a category of visa, generally:

    EB1 is for exceptional aliens (Phd's, MD's pro atheletes etc.)

    EB2 Masters degrees in certain fields

    EB3 Bachelors degrees in certain fields

    If one of you has a degree/job in above field you need employer support and $$ (about 6000 when I checked in 2005). It takes time and money and employer support since the employer files on your behalf, most professions cannot self petition.

    This is a family based site. Look around at some of the many many employment based websites. What you are looking to do is not easy on your own you most likely need employer support.

  10. You can continue to work but you CANNOT travel until your AP (131) is approved. Leaving the country before you have this document will automatically void/abandon your AOS application.

    This information is untrue for an H1b visa holder. As long as you are working for your H1b employer you can travel on your H1b during AOS. H1b is dual intent. (temporary work while pursuing green card). Since Canadians are visa exempt you can continue to travel. If you were from some other country with an H1b you still need the multiple entry visa stamp in your passport.

    You could apply for AP and EAD, they are included in the AOS cost, no harm no foul. an H1b visa holder does not need them unless you quit your job or are fired.

  11. If you (the parent) are Canadian born (in Canada) or naturalized Canadian, your child is Canadian. If by some chance, you were born outside Canada to Canadian Parent(s), your child is not Canadian if also born outside Canada (there are special rules for Canadian govt employees working outside Canada). The rules changed to this in April 2009.

    I was born in Canada, my son was born in USA in May 2009. We are both Canadian. I sent away for proof of citizenship to Nova Scotia and we had his certificate in less than 5 months. It is put away in case he ever wants or needs it. The fact that he is Canadian does not depend on having the certificate. It is only proof. He was Canadian the second he was born.

  12. I adjusted from H1b in 2007.

    You can continue to work and travel on H1b after marriage to USC. H1b is dual intent. You can apply for EAD and Advanced parole. It is included in the I-485 fees, you don't need to use them, but with the EAD you could work for anyone. If you lose your job or quit you could still travel on the advance parole, however neither is necessary for H1b.

    If your labor certification is approved, the company can use it for another employee. It is job specific not person specific. You could continue with employer based AOS, but depending what country you are from you may have to wait for your proirity date to be current. The spousal AOS is current when your spouse is USC.

    I have no knowledge for the name change process, however my wife (the USC) did not change her name when we got married. USCIS didn't seem to care.

  13. I did H1B to LPR in 2008. I did not tell my employer (or get them to update my I9) until I received my unrestricted SS card. I assume you will be getting conditional status (2 yr green card). If you show the conditional green card or EAD as your employment authorization document, you may get into issue during removing conditions when your greencard expires in 2 years.

    I was not beneficiary of a concurrent I485 through employment. If this is your case, I think that you can have 2 485's out there and just cancel the one through your employer once your family based is approved. No point to cancel the employment based until your family based is approved. Depends on your relationship with your employer.

  15. Do we now file for AOS with the I-485 checklist of items?

    We married after knowing eachother 3 years, I am not American, he is. We married inside the US.

    I also wonder since I am on a TN Visa if I were to quit my job or be laid off after filing for AOS what would happen?

    Once you apply for AOS, you are free to quit your job and you won't be out of status because now instead of being a TN visa holder, your status will be of foreign spouse adjusting status and this status doesn't a work or work offer.

    So should I wait until they send me something back with approval of adjustment of status before I quit my job? I'm tied to this job because of the TN but really want to quit if possible. So not just sending in the papers but I should wait until I hear back correct?

    I too know the noose that is working on TN. If you file AOS, also file I131 and I765. Once you get the EAD you can quit your job and work for any employer you want.

    Nik+Heather, Yes the economy is sucky, but some workers still have options depending on their background. Working TN can be really restrictive especially if you have other employment options that don't include employer sponsorship. Walk a mile in TN shoes before you judge.

  16. Well,

    My wife, son (USC's) and I (Canadian GC holder) had our Nexus interview last Friday. Our interview was in Detroit at the Ambassador Bridge. We signed in and gave over our respective ID's. The waiting area had about 10 people watching an information video about the program. The Canadian border services agent then updated the group on the list of changes to the program since the video was made.

    We were called up individually, my wife by Canadian Border Service and I by USCBP. They reviewed our applications, took our pictures and finger prints and that was it. For my 3 month old son the Canadians basically tried to get him to look at the Camera and that was it.

    I asked about the baby travelling with just one of us over the border, and they said that was no problem, but I still would not try it without the note. Also I asked what to do when I remove conditions, I was told to drop in with updated docs, no appointment necessary.

    Maybe they went easy on us since we were there with a baby, or maybe my wife and I look harmless. I found that saying that it was his fussy time and he could go off at any time really moved the process along.

  17. I have a very similar question as craigmcg and I don't know whether it's been answered or whether the answer to my question would be any different...

    I am on a TN VISA now (2009-2012). I married my husband October 2008 and recently decided that we will stay in the US and not in Canada. I am working full-time and want to apply for a greencard.

    My main concern is that I don't want to stop working throughout the process and will follow whatever route (AOS or direct consular processing) that enables me to maintain my job throughout the application process.

    Would direct consular processing result in cancellation of my TN Visa once the application's been processed? (since I have intent to stay evident by filing the application)

    I would think that once you file any paperwork you should consider yourself sequestered (no travel for sure). Also if you go to the consulate and they deny, you have no right to appeal from my understanding. You might want to bite the bullet and pay for AOS. As to whether filing cancels your TN, not sure. Maybe someone else here has experience with DCF from TN.
