If the medical from ur country is less than 1 yr at time of application, then u only need to send in the supplement. u have to go to a civil surgeon to fill out the form here. u need to provide him the vaccination records. if u need more vaccination then u will need to have it done. the civil surgeon will then give the supplement on a sealed envelope to u in which u will include on ur AOS application. u probably will get a copy of the docs which u can bring to ur interview.

  2. the new law stating u have to appear is crazy. we live in Georgia so we have to go to washington DC to renew my husband's passport? it only cost $50 yet it will cost almost $1000 to fly both of us and hotel and stuff just to renew and then u can't get it right away because they have to send it off to philippines for printing. sobrang arte naman ng pilipinas. Here u can renew US passport by mail. does the phil govt think that people will get a fake philippine passport that's why u have to appear in person and can only be printed in the phil. man, if i really want a fake passport i would rather get a US one than phil one, wouldn't you?

  3. I just sent my husband's AOS papers 7/13/09. It was delivered on 7/15/09. I was looking through the paperworks that we have accumulated over the years working on the K3 visa, I-130 etc and i just realized that i sent in the wrong NOA. I sent the NOA 1 for the I-130 instead of the NOA2 approval notice for the I-130. oohh, this just makes me soooo mad. i just overlooked it and didn't check the notice type. ahhh!!!! Should i just wait for an RFE or sent it w/ a letter stating that we have mixed up the NOA's. Do they give u an NOA1, receipt notice before they actually check the documents or do they check it first for RFE then give u an NOA1.

  4. I am preparing for the AOS package for my husband. On the I-131 AP application, it states that it is not necessary to have advance parole if you are: a: K3 spouse of a US citizen AND AOS form I-485 was filed and PENDING w/ USCIS. since my husband has a K3 visa, he doesn't need this, right? so we can go to canada w/out any problems for him returning to the US or should we still file it just in case?

  5. i want to know if you can reschedule an AOS interview. I'm just thinking ahead. Our 2 yr anniversary is 8/18/09. I was planning to file AOS in July so that my husband can get the 10 yr greencard. I am also pregnant and due in october so what if the interview falls around my due date. My OB said that i am not allowed to travel even out of town at 36 wks. will we able to reschedule my husband's interview if it happens to fall at that time?

Yes, we had to go through the whole annulment because it is the law in the philippines that once u have a record even if it's not true or not, u still have to process it in the court. in our case, it was not a big issues because the priest was our witness and the so called woman was no where to be found which just tells us more that it is a case of identity use. and YES we waited for about 1 yr for the annulment. so if u count the time from the K1 filing to the K3 visa issuance--it's about 3 1/2 yrs.

    and yes, the background checks for the beneficiary is done at his/her country. there is no way of the US to check the marriage records of everyone in the world, that is why u have an interview at the beneficiary's country. yes, they can check criminal background check in the US so if the beneficiary has not been in the US, then of course, the result is negative. the approval here at the USCIS is only base on the papers that you hand in so if u hand in stating that u are free to marry then they assume that is correct. we don't even have a central record in the US for marriage or divorce so how do u think the USCIS can check other countries. that is why they have an interview and docs to prove relationship at the benficiary's country.

  7. I can answer everyones concerns! The approval here in the US is easy. They basically just looks at the papers given and may do a background check on the petitioner but they are not really checking the beneficiary, that is why u have an interview at the US embassy of the beneficiary's country. that's when they check everything about the beneficiary. It happened to us also but we did not lie or anything on the immigration form. My husband was not married ever but at the time of the interview, his CENOMAR in the Philippines showed up a marriage record so his VISA was not denied but put on administrative review. after 6 mos w/out hearing anything from the US embassy, i canceled the petition. to make story short, we had to go thru the annulment process even if it was identity theft. it's philippine law to go thru an annulment to get the marriage null and void. the court discovered w/ the priest as witness that it was not my husband that he married but a much older person using my husband's name. when the annulment decree was issued, we got married and so i re-petitioned for spousal visa.

    so, u have to refile once ur annulment has been issued.

  8. yes it is ok to file EAD first before AOS but you just have to pay additional $340 for it. My husband already filed for EAD as soon as he arrived here on K3 visa. we will file for AOS the month before our 2nd anniversary this coming august so that he will get a 10 yr green card. K3 visa expires in 2 yrs. so we have plenty of time to wait to filing the AOS.

  9. GUYS, BELOW IS FROM THE ADVANCE PAROLE INSTRUCTIONS. FROM MY UNDERSTANDING, U DONT NEED AP IF U ARE K3 AND HAS FILED FOR AOS. SO IF U HAVE NOT FILED AOS THEN U HAVE TO HAVE AP BEFORE GOING OUT OF THE COUNTRY? IS THAT RIGHT?

    NOTE: If you are in the United States and wish to travel abroad, you do not need to apply for advance parole if both conditions described below in A and B are met:

    A. You are in one of the following nonimmigrant categories:

    1. An H-1, temporary worker, or H-4, spouse, or child of an H-1; or

    2. An L-1, intracompany transferee, or L-2, spouse or child of an L-1; or

    ****3. A K-3, spouse, or K-4, child of a U.S. citizen; or

    4. A V-2, spouse, or V-3, child of a lawful permanent resident; and

    ***B. A Form I-485, Application to Register Permanent Residence or Adjust Status, was filed on your behalf and is pending with USCIS.

    However, upon returning to the United States, you must present your valid H, L, K, or V nonimmigrant visa and continue to remain eligible for that status.

Where are you imaskin? i just disconnected my aspen 2 way calling cellphone because my husband is on his way here. b4 i disconnected, i had issues w/ the cellphone because they have problems w/ their cellpone tower and they told me that they will disconnect the service all in all. if both ways have internet connection, here in US and there in the phil and ur family has good internet signal in philippines, i suggest the aspen 'vonage' type service they have. it's only $35/mo. they will have a US # there and they can call anywhere in the US and then u can call from any cell/landline if u have unlimited calls here in the US.
