  1. Hello to all!

    I am a green card holder and leaving the US for 4 years but be coming home every 4 to 6 months and staying for only 2 weeks every time I visit my family here in the US. My concern is, do I need to file for I-131? But they only allow 2 years to be out of the country. What should I do. I need to pursue my studies for my children's future. My husband and I can't afford to send me to school here in the states. That is why I need to go back to the Philippines to take up nursing.

    You need to file I-131 for a re-entry permit for periods out of the USA for more than 1 year but less than 2.

    Also do not forget to file IRS returns every year even if income is ZERO, you may be exempt from paying tax on foreign income, but are not exempt from filing returns.

    Maintaining Permanent Residence You may lose your permanent residence status if you commit an act that makes you removable from the United States under the law in section 237 of the Immigration and Nationality Act. If you commit such an act, you may be brought before the immigration courts to determine your right to remain a Permanent Resident.

    You may be found to have abandoned your permanent resident status if you:

    • Move to another country intending to live there permanently.

    • Remain outside of the US for more than one year without obtaining a reentry permit or returning resident visa. However in determining whether your status has been abandoned any length of absence from the US may be considered, even if it is less than one year.

    • Remain outside of the US for more than two years after issuance of a reentry permit without obtaining a returning resident visa. However in determining whether your status has been abandoned any length of absence from the US may be considered, even if it is less than one year.

    • Fail to file income tax returns while living outside of the US for any period.

    • Declare yourself a “nonimmigrant” on your tax returns.

  3. I just wanted to study in the Philippines. It is cheaper over there compared here. We don't want to have too much debt in school. It will only cost us almost $ 400 per semester. But I will back here in the State to work as soon I got my RN...

    I don't have a problem with my husband but I just wanted to be safe. Since he is the one to offer me to take the course in the Philippines. We are doing this for our children's future.

    I think the answer to your question lies in whether you have your husbands consent for the kids to travel abroad. If you do, no problem. If not, problem. Then it's a custody issue, not an immigration issue. As far as how long they can stay in the philippines, that depends on Philippine immigratation law. If they have joint citizenship, and I'm not even sure the Philippines allows joint citizenship, then they can stay as long as they want. Check into that, they may have philippine citizenship automatically.

    Curious though as to why you wouldn't stay in U.S. for school with so many hospitals willing to pay off education debts of RN's in return for a 2-3 year contract.

    I am planning to leaving the country for a 1 or 2 to take up nursing degree in my native land. I have my green card for 2 years now. I wonder if I need to get a document to come back or re-enter the country? When I reach my native land Philippines. Do I need to process any papers to stay longer? As what I have known to those green card holder are allowed to stay out of the country for only 6 months beyond that we need to get a re-entry permit. Where am I going to apply for it and what form should I use?

    Aside from that, I am also taking my children with me. Do I need to have their father's consent since he is not coming with us? I don't want to be in trouble. I wanted our trip to be safe and smoothing sealing. I don't want to be charge of kidnapping in case(God forbid).It is better to be safe than sorry. They are only allowed to stay in the Philippines for 90 days. What are the steps we have to take for them to stay with me longer. I can't leave my children behind. They need to be with their mother. I know for sure they need to have a passport to travel now a days. Where do I go? What agency?

    Please, does anyone can help me on what are the steps I need to take.

  6. In my case it took me almost 2 year before I got my green card. I takes about 90 days for them to process the papers. 90 except saturday,sunday and all national holidays. Be patience. If you already process it? No agency can help you. Just wait for the green card.

    Hello VJ Family,

    So my husband has been here for 7 weeks and he still has not received his GC. What is the general time frame for the green card to be delivered? Is there any agency that I can contact to inquire about it? He has not received the Welcome letter and we are not entirely sure what is his A#. I have read that on the MRIV, it is the registration number. Is this true? We need his A# so that he can apply for Financial Aid for his degree programme, which starts in Spring.

    I am planning to travel the Philippines to take up nursing degree. Since I have a bachelor's degree from my native land and it will only take me about 2 year to finish the course. I've been in the State for 5 years now and a green card holder. What are the papers I need to re-enter the country? I'll be back with in 2 years time or more it depends how long I will finish the nursing course. Do I need to process my papers here in US Immigration and in the Philippines as well?

    I am also taking my children with me they are both US Citizen. What are the travel document they needed aside from their passport? My husband is an American but he is not coming with us. Do I need a letter of consent from my husband to take our children with me to the Philippines? I don't want to be in trouble and charge for kidnapping. (God forbid...)I just wanted everything to be safe and smooth sealing. Do we need to go the Consulate to present my children. As what I have known they are only allowed to stay for 90 days. I need to know the answer as soon as possible. We are planning to leave by March. We only have a couple of month to process everything. We need to be there early coz I also need to process my school papers. I am planning to attend summer classes.

    Please help me!!!!!
