  1. Hello Everybody!

    I have been waiting to see my Baby for over 1.5 years! :crying:

    We filed k-1, had some RFE-filled hell,.....then had the Appointment in Stockholm (he is a Brit living there) ..........and were denied!!!!

    So--we filed the I-601 Waiver if Inadmissability. In Sweden, and it was sent the UK for Proccessing. No, I do NOT want to live in Sweden!

    I follow the London Embassy Website, and they very good about posting every week or so, but I track when the cases are Pending, and then when they go into Under Review, and finally when they are Complete! I keep track of dates!

    I have noticed some strange stuff. Some cases show up as Complete!

    Some cases go from Pending to Complete, and never go Under Review at all!

    One case this week (Jan 21) moved fom Under Review back to Pending....... some cases just fall off, no explanation....hmmmmmmm :wacko:

    Interviewed in July of 2008 (1 year of waiting)

    Denied

    Filed Waiver after months of getting all documents together

    IF we are approved by April, 2009, it will be 1 year and 9 months

    EU citizens get NO break. at least not that I can see!

    I am Sue, and my fiance is Barry. I am beginning to track all of the 601-w in London, and if you would not mind sharing your number with me and the date it popped up as pending, I would be happy to tell you how the wait times are going. I have made a spread sheet, and have added one other number to it, so I can see where we all are. I just got ours on the pending list last week, (Dec 10) so we have a ways to go.

    My fiance and I are also in this mess of waiting. We have been in the '601 show' since July, but just got all of our evidence to London December 10, when we got the electronic postcard. We are happy that this might really be over soon and we might be together, finally--it has been over 1 and 1/2 years since we saw each other and filed.

    Any help, even good thoughts, would be appreciated. Barry is in Sweden, the frozen wasteland, while I am here in relatively sunny Northern CA.

    I am tracking, too, but I cannot figure it out. We were third from the bottom of 'Pending", now we are second from the bottom. Hmmm???

  5. I was asked for 'further evidence" mo ths after we sent in the I-129f! I was rather upset about it, but I know of another couple who had to send in 'further evidence" during the Consukate interview! So I did what she did-and so should you!

    1. Make copies of 1 page of montly phone bils IF you have them, showing that you have had an on-going telephone relationship. IF you can put his/hr name in stead of the phone number, like I can with Verizon, do that. Personalisze it.

    2. Make copies of several pages of phone chats from MSN or whatever Chat you use.

    3. DO NOT put the photos on a disk! They do not have time for that! Print them out, either paper or take them to the instant photo place and take copies. Send them picciesof the two of you together, with dates and notes.

    4. ANYHTHING you two bought together, receipts! Barry paid for the I-129 paperwork with his bank account number while we were in Sweden! So i have proof I was there with him.

    5. My flight Itinerary, ticket stubs from my visit.

    6. E-mails to my family and friends talking about us together, sent from Sweden during the visit.

    7. Photos of Barry and his son taken by me, and photos of me and Barry taken by his son.

    8. Love letters!

    Honestly, anything and everytging...I had so much I had to go back and purge some of it. Make a nice little packet with a cover page and table of contents. Date everything!!!!!!!

    Good luck...we have been waiting for almost a year now! We have our Interview on Wednesday. (Barry has to sit for 10 hours on the bus from Sundsvall to Stockholm, 5 down, the interview, and 5 back!!!).and I can use some good thoughts here!

    can anyone tell me exactly how is the best way to send proof of our relationship??

    is it better to print the photos, or put them on a disc?

    and what other evidence should we send?

    we are planning on posting everything in the next few days so i wanna make sure we do it right.

  6. My Fiance and I have been aprt for almost 1 year. We We sent our I-129 in on Juyy 24, and it has been slow ever since. We are stillllll waiting to have the Doc appt and the actual Embassy appointment is just going to sometime AFTER the Police certificate shows up.

    My fiance has spent convictions in the UK where he is actually from---------and we sent off for the ACPO, it came back with not enough info, so now we have sent off for the Subject Access---whgcih hopefully does has info--but ten we think we will also have to send off for the actual court records..so how is YOUR day?

    Hey - Has anyone called and asked why VSC does this in 1/2 the time? I think they need to change the districts so that it is more balanced. I live in Chicago so Vermont is probably closer then CSC. I don't get it. It makes me so sad to see all the people the get the NOA2 in like 4 - 6 weeks when I have to wait 4 - 6 months. I'm sorry I'm whining, I realize life is not fair. I was just thinking of calling and complaining but I figure a lot of you already have.

    I heard a quote on Oprah the other day...

    I think we can all identify with this.

  7. I asked ACPO to provide an explanation of No Live Trace, this is their reply:-

    NO LIVE TRACE - this means that you do have a Police record and

    information is held about you on the Police National Computer. This

    information does not appear on your Police Certificate as it has been

    'stepped down' in accordance with the Retention Guidelines for Nominal

    Records held on the Police National Computer. The Retention Guidelines

    for Nominal Records can be found on the ACPO and Home Office websites.

    It must be stated that although your conviction/s may have been 'stepped

    down' they still form part of your criminal history. If asked whether

    you have been convicted of a criminal offence, you must declare all

    convictions. If your Police Certificate states 'NO LIVE TRACE' and you

    have not declared your convictions, you may be asked to explain this

    outcome which could delay your visa application.

    Yes, and thanks.......It also states on the forms sent to Barry by the US Embassy in Stockholm that he now provide them with adetaile Subject Access, and possible court records....He cannot simply explain as your post suggests--the seem to want proof, and details.

    Barry has just sent off for the Subject Access,and he clicked the box that said PNC.......and this is what they said they wanted/.

    Just trying to jump through all hoops here.

    So you think also that we will have no further info on this form??

    This delay and the unknowing of what the forms might/might not say and how to get them the info they want is daunting!

    Sue...The ACPO has merely replaced the subject access form, it is more expensive because having to include a photo and a signature to confirm ID and takes less time...ACPO is not 'useless' as the the subject access is no longer acceptable at least at the Embassy in the UK, which is why he was asked only to get this in the first place...the Subject Access goes through the same process as the ACPO. which really goes back to my main confusion as to why they asked him to get the SA.

    Ok, then since Barry has in-hand the new Subject Access form and the check to pay for it, what should he ask for? What we need is the detail portion of the report, charges, nature of crimes......and this is the form the Embassy has asked us to use. Barry has checked PNC box, and it goes to the Metro police.........do you have a better idea, becasue if I wait another 40 days and still get no more information, I will go quietly nuts. Also, he seems to think that the court records will take months.

    Any help will be apreciated, and I will forward it to Barry

  9. Barry was told by the US Embassy to ask for the Subject Access from the Metropolitan Police. It will have more iformation than the words No Live Trace, which is ALL was on the ACPO report. The PNC report ought to contain the nature of the offense and dates, and then he will have to explain in person. The irritating thisng is that he was asked to only get the ACPO first, and it cost 35 pounds. it was quick, but useless. Now we have to give them 40 days on the outside to process the PNC (.

    This just gets better and better. And as as a teacher, I thought I knew paperwork!

  10. I'm just surprised the consular has requested you get a Subject Access as well as your ACPO...it won't show show any more information than what you have already with the ACPO...He should just be able to get his court records which won't take anything like 40 days.

    The ACPO says JUSt No Live Trace, and nothing more!!! However, they ask that he remember everything such as dates, places, fines paid...and he cannot remmeber 20 years back when this all took place. It is nothing more than a library fine and one count of threatening behavior, no blows or anything, just a shouting match.

    Why so much Fol De Rol over this? I am not sure......I am thinking that if the Subject Access says nothing more, then where do we get any more info? I am at a standstill here!

    How does he get court records then, becasue he is about to send off for the stupid 'one more form' tomorrow!!!!

    PLUS Swden has no checks no Post Offices and no Money Orders (!!) so every time he has to send off anything it costs him as much as the fee itself for the check!

    I have my ACPO certificate with the real gross picture of me :lol: in front of me right now.

    It clearly states 'No Trace!'

    Does that mean that if a person certificate comes back with No Live Trace that they have a criminal past? :blink:

    Surely the filer knows that a police check will pick up anything they have done previously? :whistle:

    OK this is what happens with a "No live trace"

    Even though convictions are not listed on the police certificate, have been downgraded or spent, the consular official dealing with your application is advised automaticaly to pass the information that a "No live trace" certificate is on file to the London Fraud Prevention Manager. This is done in every case. The Fraud prevention Manager's office usualy does a quick check to see if there are any convictions which could carry a prison sentence of five years or over or crimes involving "moral terpitude" such as prostitution etc.

    The London Fraud prevention Manager's Office can sometimes temporarily pass an application which has a "No live trace" where the convictions are of a minor nature due to their workload, but will review it again later. This is where they will also look at the whole of the application again for discrepancies.

    If you have witheld information on any of the immigration forms by not crossing a box or by any other form of omision it is a FEDERAL offence and a felony. The authorities DO take this seriously and if you have witheld any information you will be charged. Usualy people witholding information are caught out when applying for their "green card" as all is checked again especialy employment records, criminal records and marriages and divorces.

    If by this time you are in the USA, you will be arrested and possibly deported as it is a felony even if you are married.

    You will find that it is better to be honest and declare everything possible rather than have the very real threat of arrest in the back of your mind all of the time.

    The US consular officials are not there to give you a hard time, but to check that the information which you give them is of a truthful nature. Contrary to poular belief they will not refuse your visa becuase you have a crminal record listing only minor offences.

    I Am concerned about those of you who have checked the Box that indicates that you ARE NOT a criminal, but have in fact also received a No Live Trace, and that you think you have therefore Nothing to worry about...think again!

    If you check the box Yes, and then are honest, you will have to provide the Subject Access from the UK from the national Police Computer.

    It will not take them long to review the paperwork and discer that they may have made a mistake!

    I plan on NOT being one that will need to AUDIT AFTER!!

    So, this is a warning, so better to be right than Fright!

    Did you check the box on the 156K that asked you if you have comitted a crime? IF youchecked No, and it came back as No Live Trace, I am surprised that no one caught it.

    SO, DID YOU CHECK YES OR NO? If you checked yes, and were truthful, and they still let you in with No Live Trace AND no further Subject Access forms, you were lucky.........

    It says that if you omot anything, and they discover it later, then you are sunk!!

    So, I will wait for the rest of the Forms and be safe rather than be sorry later after Barry gets here and then they discover their mistake!

    And they do check, all the time!

  15. Damian's interview was the beginning of the month and his said no live track and he was approved too. no problems at all.

    My Fiance e-mailed the Immigration officer at the Us Embassy in Sweden. That guy said ABSOLUTley we HAD TO HAVE ALL records concerning this. He said Barry would NOT BE Processed if he did not have all of his Subjects Access and court records. This was also so stated on the forms the Embassy sent him!!!! So Whatever!!!! (CALifornnia slang here, sorry)

    So, do you think maybe we should wing it and give it a shot, and see if anybody retches and makes us start over? Barry just sent off for the Subject Access. Waiting another 40 days is disgisting to us.

    On the London Embassy site it also says that if you have a No Live Trace that the interview will take longer, and you may be asked to come back again, and that you also had to apply for an extra form.....so none of that happened to you?

    Sue here. My fiance, Barry, is a UK citizen but has lived in Sweden for the last 23 years. He sent off for the ACPO, ( 35 pounds, 10 days) it came back, has NO LIVE Trace, which means there are SPENT charges, so now he has to ALSO send off for the Subject Access to the UK, and THIS costs just a bargain 10 pounds, but takes 40 days to process!.... :bonk:

    So If any of you out there think that the ACPO is the ONLY thing you need, you are Wrong Wrong wrong! You will need BOTH!!!!! You have to ALSO get copies of court records.....so b aware!!!

    His 'criminal offenses" include library fines from when he was in his 20's...no convictions, no jail, just a fine, if you have anything more than a traffic ticket, so will YOU NEED this Subject Access, so just send for it NOW.

    We had our wedding planned for August 2nd, now I hope he might get here just in time for the ceremony!!!!!

    We sent in our I-129K in July of 2007-------this has been the longest year of my life!!!!!!!!!

    Anybody else out there puting up with anything like this?

  17. I actually simply called and talked to real person at the NVC. He said that K-1 visas do not work on the automated system, and that my petition Is at the office, although I have recieved NO written affirmation of that. He was able to give me the case number ( becasue the file was sitting there on a desk, but had not been logged until April 22, but had been there since the 5th or so...........so if you call the number from the NVC website, and wait until after 9 pm EST, you will have a better chance of talking to someone. Good luck

    Our K1 was approved by the California Service Center on 2-4-08. It has yet to reach the National Visa Center. I am an attorney, and I managed to get the personal phone number of the director of the NVC and the personal e-mail of the CIS Ombudsman. I have also involved my Congressman. No one can give me or the Congressman's office a straight answer as to where this K1 actually is. Only that there is no reason to get excited unless more than 90 days have elapsed since the approval by CSC. Does anyone know where the petitions physically go after the CSC approval, and how one could be sitting someplace for 90 days without either the CSC or the NVC being able to give a straight answer as to where it is?
  18. My lover and I have been apart of 8.5 months...so I am little irritated----but..what can I do? CALL!!!!!

    I have just got off the phone with nice man from NVC....always best to talk to a living breathing person!!! And I called late, just kept trying and trying.............finally got through!!! Yea!!!!!!!! Tried all day, waiting IS All

    Received my I-797 (NOA2)on 4/11.

    Called on Tuesday 4/22, to the NVC phone number,got a nice man after 6pm Pacific time. He said that my notice had just been logged in on Monday, 4/21. He said that would stay about a week there, and then I would get a notice in the mail with my NVC number, but he gave it to me on the phone.

    HE SAID THAT THE AUTOMATED TELEPHONE RESPONSE SYSTEM DOES NOT WORK FOR K-1 VISA'S--------SO BE AWARE OF THAT!!!!!!

    I-130's DO work with the automated response, but K-1's do not!!!!

    It is much better to just call them and talk to A REAL PERSON!!!!! They were very nice....more later

    01/08/2008 RFE

    03/18/2008 Received RFE acknowleged

    04/4/2008 NOA @ says approved (but I have only heard this from the agebt I called today, on 4/11/2008 verbal, nothing else!)

    I think I used your RFE ideas to make mine easier! Thanks!

    My Barry is in Sweden!!!!! It has been eight months since we saw each other...........ohhhhhhhhhhh.

    My K1 Petition was approved today.

    10/18/07 USCIS received my K1 application

    02/27/08 USCIS responded with RFE

    03/20/08 USCIS signed my fedex package with RFE

    04/03/08 USCIS approved

    I am very happy that things are moving well and thought I would share these dates with people.

    What do I need to do next? I would appreciate all your input.

    My fiancee is from Peru and any Peru specific input would be greatly appreciated.

    Thanks to everyone who responded when I asked about how to handle the RFE.

    I'm glad to be a member of this forum community.
