  4. I too have the exact same question. We have already forwarded our information like the sponsorship paperwork you mentioned. I looked up B2 Visitor Visa sponsor documents in google and got a list of info to provide the visa petitioner to present to the consul. I too want to know what best information is needed for the petitioner as ties to the country. What did people with visitor visas use when they got their approved. The more details the better.

  5. Diana,

    My mother had a couple of friends who claimed that they were also part of a case similar to what you just described. What they did was go to the US Embassy and file for political asylum with all the evidence they had and luckily they were granted asylum for 10 years. Now, that doesn't happen to many people since it's very difficult to prove the need for political asylum and just like with tourist visas, they get denied all the time.

    Another route would be request a tourist visa and if they get approved, file for political asylum as soon as they get here. They can do this by hiring a lawyer. They will automatically get their EAD card while their process is pending until it is approved, but if it's not approved, they have to go back to Colombia. Again, it is key to keep all kinds of evidence they can get their hands on.

    Unfortunately, there is not much you can do about it except maybe send them a letter of invitation and fill out an I-134 to show that you are willing to pay for their expenses while they visit the US.

    Thats what I was affraid of. Most of the stuff that they currently have is recent. I mean couple of days old. All their old evidence and case is with those officers that have turned their backs on them. They dont have anything else since the information that was obtained during the investigation process was solely used by the police intelligence. If they had all their old evidence it would be a cake walk.

  6. Hi Guys!! Looooong time no read/write!

    There's drama in Colombia (yeah i know! when isn't there). I need some advice and I thought the best recourse was all the people here who have been my guides and friends throughout the whole visa process.

    Here is the situation:

    My brother in law, (my husbands brother) was under police protection in Tulua, Valle. My Brother-in-laws fiancee was being extortioned by members of la guerrilla. She was told when she went to the authorities that she and my brother in law would be placed under police protection and moved to another country for their own good.

    After several members of this extortion team were caught, my brother-in-law and his fiance requested an audience with the Colombian President (which is a right for those who are helping in the efforts against las Farc) in order to facilitate an easy refugee process here to the US. Upon their request the police took it as a threat and removed all police protection. From what we understand and know about the situation is that the police withdrew their assistance because they wanted to keep the recompensa for catching the Guerrilla people. My brother in law and his fiance hired a lawyer to investigate what happened with their police protection. The lawyers were told that no such case existed, that no threats were made against our brother-in-law and his fiancee, and that they had no idea who they were.

    At this point the police intelligence has turned their back against our family members in order to keep the reward money. At this point we dont care about the reward money, only our family members safety. They are still recieving threats via phone and online chats and as I write you this post my brother in law and his fiance are in hiding. They will be initiating a process of getting assistance from "defensa del pueblo." With their assistance they are hoping to go to Bogota and present the case directly to the police their.

    Our question/consern is if there is a way to petition for a refugee? how do they go about getting a meeting with the overseas processing entity to validate their need to be moved here (the US). We really would like them to come to the US where we live and even offer to have them waive any assistance they may receive from the US. My husband and I would gladly send Affidavits of Support showing our income eligibility and how we could support them and assist them with their transition. We just want them out of the problem they are in and in a secure environment.

    Any assistance you could give us would be greatly appreciated!

  7. Hi Guys!

    Andres and I had his appointment yesterday and he was approved! The official took Andres' EAD and his I-94. Is that normal?

    Anyways...She stated that he would be getting his green card in two weeks.

    The appointment was relatively easy. She just asked how we met and requested our joint financial info. I gave her our 08 returns, joint bank accounts and joint credit cards. Thats it.

    Relatively easy and quick. the appointment was at 8:20 we went in at 8:40 and were out by 9:10.

    Andrea I hope you had good news yesterday! Please tell us you did!

  8. WE HAVE AN INTERVIEW DATE!!!! YAY!!! One step closer!!! Our interview is Feb. 20th which gives us a whole lot of time to prepare!

    Andrea! What is going on with your Paperwork! Why haven't they given you guys a green card yet! Whats happening with you its outrageous! Isn't there anything else that can be done to expedite your process?

  9. Ok, I am back from my trip to Bogota. Work kept me busy over the weekend so I am just now posting what happened. Well the visa was Not approved but at the same time it was not denied either. They have to do an “Administrative Procedure”; I guess it’s like an internal investigation.

    We showed up about 6:30 to the embassy. Got in Line 3 and waited a little while before they let us in the compound. Once in, we received the folders and list/order to put the documents; one folder for Brillit and one for her daughter. It can get a little loud some times and some time it is hard to hear the names coming over the speakers. I guess we missed the first time they called. We ran to the first window and the lady was very curt with Brillit. So she collected the folders and told her to wait. It seemed like forever but finally around 11 am they called her name. The interviewer spoke to Brillit briefly and then she waved me over. Brillit stood back behind the yellow line as the guy started asking all about the relationship; how we met, several questions on each trip I made to visit her, her family, about the fotos we had given, etc. Well after about few minutes, he asked me to ask Brillit to sit down; he did not want the integrity of the interview to be compromised. So I put down the phone and went over to ask her to sit and wait. He was writing down every answer I gave him. After about 25 minutes of questions he said he was finished with me and wanted me to go stand to the side of the court yard. I asked if he wanted me to get Brillit and he said no, not to speak to her and he would have her paged. I walked over to the side of the courtyard but was able to see the window. Brillit went over and picked up the phone. After about 30 minutes, she waved me over. The interviewer told me he had good news and not so good news. He said he believed the integrity of the relationship but that that something had come up in their database the required looking into. He said they would do an ‘Administrative Procedure’ (do some more investigation). He told me we should have an answer in no longer than 2 months. I asked him what had caused the flag in the database and he replied that for security reasons he could not say more than that. He said the embassy would call Brillit with information and when she could request a second interview. We asked if we all needed to attend the second interview and he said no, just she will need to come back to the embassy.

    Brillit has several trips out of the country on her DAS report and we think they are what got her flagged. She had an ex-boyfriend several years ago that took her a few trips to different places and she also has worked for a company in Barranquilla that does beauty (hair and skin) shows in Brazil. They would fly her to Brazil and she would work the show/expo selling their products. So she had a couple of those trips on the report.

    Obviously we were depressed that we did not get the visa but at least they did not deny it either. I think it helped that I was there. Without my interview, I think they would have denied her out right.

    So now we are waiting impatiently to hear from the embassy.

    We went through the same exact situation!! This was back in may when we had our interview. Andres and I showed up and they even went as far as approving us! Once we left the embassy they called us and told us "oh come back and pick up your passport" They were not going to issue the visa because of AP.

    At that point I wasn't allowed back into the embassy with my husband even though I was the US Citizen! Andres went in they explained about AP and he was offered his passport...he decided to leave it with them. I constantly called DOS to find out our status over the course of two months until one day they told me that the embassy has tried to call Andres to set up another interview. I took it upon myself to call the embassy and set up the interview from here and was met with a road block. The operator wouldn't give me an interview date because she didn't see in the notes that they had reached Andres so how could I the Petitioner have possibly known that he needed an interview! Eventually after quite a bit of arguing she gave me an expedited interview.

    At his second interview they didn't know what to do with him. They shuffled him from window to window...until the consul finally said "what are you doing here?" :wacko: Eventually they found his file saw that he didn't have a request for additional info and told him..."ok your visa is approved go pay at domesa" At the first interview we did since we were told we were approved that day and we told the consul this. He said "ok...wait for your visa in the mail then"

    A few days later Andres gets a call...mind you this is when he is already back in Tulua which is an 8 hour drive from Cali. They tell him he is in AP again and that he has to return to Bogota to pick up his passport!!! He goes off on the poor lady who was made to call him...she got so upset that she told him to hold while she got the consul on the phone to explain the situation. When the consul came on the phone 5 minutes later he said...."im sorry it was my mistake to have her call you...we will send out your visa today"

    So if Andres hadn't let his temper fly...who knows...we would still be in AP. Its sooo odd that this is happening to people in Colombia. Usually it is only the MENA countries that have the heaviest of AP's. The good thing is that they gave you a time frame! I hope they kept your finacee's passport. And I sincerely hope that you get through AP soon. I know of only one other such case...AlexisR...another colombian who emailed me about his AP. His thankfully only took 3 weeks.

    Your AP probably has to do with namechecks, thats what ours was about. It could be completely random or in truth it could have been something in the file. The good thing is that the FBI, CIA, and other agency's that do these checks for DOS have implemented a new system to expedite things for visa requests...I believe it took effect in september.

    Quick question...where you held back at the NVC level as well? Instead of it taking 3-6 days did it take a couple of weeks to even a month? Reason I ask is because at the NVC level we also got stuck in AP...could it be a coinsidence?

    Once again....I sincerely hope that things are fast and efficient and that your girl will be here soon!

  10. QUESTION!!!

    So my husband applied for his AOS back in August...so far we have gotten EAD, AP, SSN, and DL.

    There is one thing that has been plagueing me! I forgot to send in the proof for his vacines that he got while he was in colombia. He was required to have a medical exam for the visa process so he should be in the clear right? No RFE? I think since we got EAD and AP approved with no RFE we should be in the clear? I guess this just comes at a vexing time. Any info will be greatly appreciated!

  11. Hey you guys!!

    Still waiting for notice from Santa Ana to tell us we have an interview date. I was looking at other timelines and people who filed for AOS a month before us have there interviews this month.

    Do we know how long in advance they send out the interview letters? I checked the status of our case on the USCIS website and it still states pending. When I check the Santa Ana processing times it says they are processing on Feb 22??? thats like a year ago!! (but then again that date was updated on sept 30...so that means its no long feb 22 right?)

    Does anyone know when I should start to worry? I see that Dre has been waiting for a year....what is out of the norm for AOS interviews?

  12. That is pretty much all you can do on AP. "Wait." There isn't any way to get around it or even trick your way through it. (believe me I tried)

    Andres and I were on AP twice throughout the course of our k-1 visa. We were on AP at the NVC level and at the Embassy level. Our NVC wait wasn't too long compared to others. It didn't take them more than 30 days to transfer it to the US embassy in Colombia. The wait was exasperating but we got through it. After calling NVC (I dont know how many times) they informed me that it could have been a flag on one of our names or even a random selection. Personally since we went through AP twice I think it had something to do with one of our names.

    The AP to truly worry about would be the one at the Embassy level. But dont fret! You'll be out soon!

  13. Hello people!!!

    Long time no post! Been really busy with work and dealing with my husband :bonk: (hee hee). Its great to finally have him home and not have to deal with Administrative Processing. We have had a couple of fights with the DMV! Can you believe they didn't want to give him a license even though we had a SSN and EAD! Sheesh!

    Anyways...at this point we are just waiting for our interview notice!

    I hope everyone is doing good and that everyone has been having an easy time over at the embassy!

    Just wanted to join the band wagon and say that my husband is also waiting for the interview letter. Hope this all goes by quick...

    Question!

    We are renting in an apartment with another couple...we currently dont have any utilities because our rent includes those kinds of charges. We have joint bank accounts and credit cards together. What else can we use for proof?
